FIRM FIXED pricing

Supplier will provide Regular Maintenance Services in accord with pricing located in the TASKS/SCHEDULE Exhibit for each site.

Time and materials pricing

Supplier may provide alternative tasks or extra work not included in firm fixed pricing. For WorkIdentified as alternative or extra, Supplier will provide LCRA a time and materials proposal, including any or all the following rates:

EXHIBIT E: CONTRACT SCOPE OF WORK

  1. General Description:

The general scope of work for this Contract is landscaping, grounds maintenance/irrigation repair and ancillary services for the LCRA facilities. Supplier shall supply all management, supervision, labor, tools, materials, and equipment necessary to perform these Services, unless expressly described as being provided by LCRA in this contract. LCRA reserves the right to make changes to the scope for work any time during the contract term. Any such changes will be made in accordance with the terms of the contract. No specific amount of work is guaranteed.

  1. Description of Deliverables:

Supplier will provide deliverables to LCRA according to LCRA stated requirements. Generation of these reports is at the expense of the Supplier.

2.1.Monthly Report: A detailed monthly report shall be provided in an Excel format 10 business days after the close of each month that includes at least the following elements:

2.1.1.LCRA Site Name

2.1.2.Service Date

2.1.3.Arrival Time

2.1.4.Departure Time

2.1.5.Supervisor On-Site during performed services

2.1.6.Tasks completed, i.e. mowing, mulching, etc.

2.2.Reportable Safety Incidents: Shall be provided immediately after a reportable incident.

2.2.1.Provide details to LCRA SME and Agent of events that lead to injury, property damage or vehicle damage as well as near misses or unsafe conditions.

2.3.Service Defects- Supplier will provide a detailed monthly summary in Excel format 10 business days after the close of each month that includes the elements below concerning defects as reported to Supplier by LCRA:

2.3.1.Definition of Defect: Scheduled service and/or task not completed for a specified location. Missed service and/or task must affect a majority of the named location and/or cause LCRA a noticeable inconvenience.

2.3.2.Example of Defect: Failure to mow per approved schedule, failure to pick up trash, failure to weed beds

2.3.3.All correspondence concerning service defects should be sent to the LCRA Agent with a copy to the Subject Matter Expert.

2.3.4.An example of this report is included as Exhibit O, Service Defect Report.

  3. Cleaning shift hours by site can be found in each site’s Tasks/Schedule Exhibit.
  4. LCRA is closed for various holidays and observances throughout a calendar year. The SME will provide LCRA’s dates of closure for upcoming calendar year when available. Supplier shall not be required to provide services on these days unless specifically requested by LCRA.
  5. Qualifications of Supplier’s Personnel
  6. Basic Qualifications
  7. Supplier’s personnel shall have the legal rights to work in the United States.
  8. Supplier’s personnel shall at all times wear apparel clearly identifying the Supplier’s company name, which easily designates the individual as an employee or contractor of the Supplier.
  9. Supplier shall insure that all uniforms are maintained in a neat and clean condition in accordance with the work being performed. Shirts with logos other than that of the Supplier are not permitted to be worn.
  10. Supplier’s personnel shall maintain a neat and orderly appearance at all times in accordance with the work being performed.
  11. LCRA reserves the right to approve or disapprove of uniforms.
  12. LCRA reserves the right to remove Supplier personnel at any time from its facilities.
  13. Supervision
  14. Supplier shall have supervision on-site for LCRA locations in which contractor provides more than one staff member to ensure that all the Services are appropriately performed to achieve or exceed Service expectations as described in Exhibit E – Contract Scope of Work.
  15. The supervisor shall be available to LCRA during all times while work is in progress. Supplier shall provide either a telephone or pager number for use in contacting each supervisor.
  16. Supervisors must be qualified and be able to effectively communicate with both LCRA personnel and the Supplier's personnel.
  17. Supplier shall take direction from LCRA SME and site managers for performance of specific tasks to be performed “upon request” or “as needed”.
  18. Health and Safety
  19. Supplier shall perform all work required by this contract in a safe and healthy manner.
  20. Supplier is directly responsible for and shall comply with all laws, rules, regulations, and good industry practices applicable to worker safety and health.
  21. Supplier shall use chemicals that are the least hazardous to employee health and the environment, and that meet the performance requirements.
  22. All equipment must have proper shields and guards as recommended by the equipment manufacturer.
  23. Materials Provided by Supplier
  24. Supplier shall provide all products, chemicals and required equipment for the performance of this contract. Products and chemicals shall be appropriate for the purpose and shall not in any way damage the area being serviced.
  25. LCRA reserves the right to approve materials or supplies provided by Supplier.
  26. Hazardous Materials or Dangerous Goods – Supplier shall submit Safety Data Sheets (SDS) a minimum of thirty days prior to contract performance for all chemicals and products intended for use at LCRA facilities (including for example, pesticides, herbicides and fertilizers) for approval. Recommendations include:
  27. Supplier will avoid using toxic, corrosive, or carcinogen chemicals, as noted on the SDS or the product label.
  28. Supplier will dispose of any chemical wastes in accordance with applicable laws and regulations.

3.6.Supplier Services

3.6.1.Supplier will perform, at a minimum, the Services Requirements as described in EXHIBIT F: LANDCAPING SERVICES TASK REQUIREMENTS.

3.6.2.Supplier shall provide the Services by LCRA location as described in detail in each site’s TASK/SCHEDULE Exhibit. Additional minimum service requirements by site may be described there as well.

3.6.3.Supplier shall provide sufficient labor and materials to meet the Service frequency.

3.6.4.Supplier shall use materials and supplies appropriate to the task to thoroughly complete the Services.

3.6.5.Alternative Tasks or Extra Work:

Work determined to be beyond the required tasks listed in above shall be considered “additional tasks” or “extra work”. Extra work will be planned, with estimated costs, line item costs of materials and labor rate in accordance with those prices as stated in Exhibit B Pricing. Any extra work shall be authorized by an LCRA Site Manager prior to performing the work. All quotes for Alternative Tasks or Extra Work will be itemized. A non-exhaustive list of examples of “additional tasks” includes:

3.6.5.1.Use of specificherbicides on an as-needed basis

3.6.5.2.Tree trimming above 15 feet off the ground under the supervision of a certified arborist

3.6.5.3.Planting upgrades based on prices for plants and labor.

3.6.5.4.Irrigation system additions, repair of leaks, vandalized sprinkler heads, and/or upgrades constitutes extra work.

3.6.5.7.Landscape design, creation or edging set up of flower or landscape beds

  1. Other Requirements:
  2. Supplier shall notify LCRA Contact and sign in upon arrival to job site
  3. Supplier will fully conform to all local, state, and Federal safety regulations, in performance of all work being performed for and/or on LCRA property.
  4. The Supplier will notify the designated LCRA Contact or other authorized representative immediately by telephone of any unexpected emergency.
  5. The Supplier will remove all work related debris from the site and clean affected work areas. The Supplier shall leave all affected areas as they were prior to beginning work.
  6. The Supplier will erect and maintain adequate barricades around all areas where equipment and materials are stored and used. During all phases of the work, where needed, the Supplier shall make proper use of interior and exterior type temporary scaffolding and/or rigging, during the actual work. LCRA buildings included in this Statement of Work do not have tie-off points. The supplier must have ability to use ladders from the ground.
  7. At all times, a member of Supplier’s crew must have knowledge of and experience with the care, maintenance, planting specifications, and treatment of native plants and grasses, as well as foreign botanicals and invasive species. No invasive species will be utilized in any LCRA landscape.
  8. For Ozone Action Days, Supplier’s equipment, including, but not limited to, mowers, line trimmers, blowers, edgers and hedge trimmers, must be alternative-fuel powered, such as electric or propane powered, manual raking and sweeping, and should meet applicable EPA air quality and emissions guidelines.
  9. Supplier must either assign a staff member, or have access to a Certified Arborist to personally oversee all large tree trimming projects.
  10. For pesticides, herbicides and fertilization matters, Supplier must assign a Licensed Commercial Applicator who is in full compliance with the Texas Department of Agriculture’s certification/licensure requirements and guidelines. They must also be compliant and/or familiar with provisions and specifications contained in TEXAS ADMINISTRATIVE CODE, TITLE 4 (AGRICULTURE), and the TEXAS AGRICULTURE CODE, to perform such services. The Licensed Applicator must be knowledgeable and experienced with organic and regulated fertilizers, pesticides, and herbicides, zoning application requirements, procedures, wind conditions, environmental effects, precise selection of product to problem, protection of surrounding botanicals, maintenance of proper soil balance, and all other aspects related thereto.
  11. At all times, a member of Supplier’s selected crew will be able to quickly recognize and properly identify common, prone or unusual diseases and pests; have a clear understanding of the problem source, comprehension of the infecting pest, its feeding habits and life cycle; and have the ability to suggest the appropriate treatment(s), preferably organic, to eradicate same.
  12. Upon proper identification, and if applicable, utilize pesticides that are organic or contain the least amount of toxicity to eradicate same.
  13. In areas suspected of having disease Supplier will take a sample of the area in order to understand and present a viable solution to LCRA for approval, examples include:Algae, Brown Patch, Helminthosporium,Pythium Blight.
  14. Supplier shall supply a crew member that is experienced, knowledgeable and well-versed with irrigation systems troubleshooting, with the ability to suggest problem solving and preventative measure solutions, and aware of new advancements in the field.
  15. Supplier shall assure a maximum twenty-four (24) hour response time from the time LCRA contacts it for the need of any irrigation repairs to the time Supplier appears on-site and begins repairs.
  16. The LCRA Contact designated by LCRA will inspect treated areas for completeness according to the Scope of Work and determine acceptability of all work and/or services performed. If the work and/or services are not acceptable, the Supplier will review and correct all problem areas without additional cost to the LCRA. Upon notification, the Supplier will perform repairs to deficient work and/or services in accordance with a mutually agreed schedule.
  17. Supplier must be flexible as to potential scheduling differentials based on each site, particular circumstances, functions and or guests, and be able to work around same by providing re-scheduled services at said site, within a 72 hour period.
  18. LCRA Responsibilities: LCRA will provide utilities such as water and electricity as required.
  1. Locations: For locations to receive Services (and Site Maps) refer to Exhibit G through Exhibit N TASKS/SCHEDULES.
  1. Schedule:
  2. The schedule of services by location shall be described in Exhibit G through Exhibit N TASKS/SCHEDULES.
  3. All work must be performed during times listed on Landscaping Services Task Requirements and Tasks/ Schedule, unless mutually agreed upon. Access to any property must be coordinated with the LCRA Contact identified for each facility, or an authorized representative.

  2. Services shall be accepted upon receipt and review of the Deliverables as described above in Section 2.1 of Exhibit E – Contract Scope of Work.
  3. Any disputes shall be made within 20 business days after the close of the month to allow for reasonable review of deliverables as described above in Section 2.1 of Exhibit E – Contract Scope of Work.

  2. Required work shall be completed prior to the Supplier’s issuance of an invoice.
  3. Invoices shall be presented in the proper format with the required supporting documentation.
  4. Proper format and documentation includes: Purchase Order #, location serviced, location contact name, description of services, and date of services completed.
  5. All Invoices shall be generated at the first day of the month for the completion of the prior month.
  6. Rejected invoices must be corrected and resubmitted on the next billing cycle for payment.

EXHIBIT f: LANDCAPING SERVICES TASK REQUIREMENTS

Regular Maintenance Services: Supplier will at a minimum perform the following tasks as described below

Service / Description
MOW/EDGE/TRIMTURF / A. MOWING
1)The height of cutting shall be maintained consistently to prevent scalping or burn. The mowing height shall be appropriate to the turf species. Mowing shall be done in such a manner such that that no more than 1/3 of the leaf blade shall be removed at one time. Unless otherwise stated in specific site Task Schedule, grass length shall be:
-Kentucky Blue, St. Augustine-2-3 in. - Bermuda Grass- 1-1.5 in.
-Tall Fescue - 2.5 to 3.5 in. – Zoysia Grass- 1-1.5 in.
2)Excessive grass clippings shall be collected and disposed of. All sidewalks and streets shall be left clean of clippings.
3)Mowing patterns shall be alternated each mowing to avoid creating ruts and compaction.
4)All mowers shall be of mulching type or bag type, maintained in good condition with sharp blades.
B.TRIMMING/EDGING
1)All lawn edges along sidewalks and curbs shall be edged during each mowing per schedule.
2)The cut edge should appear as a clean, straight line so as to maintain a neat appearance of the landscaped boundaries.
3)A monofilament line trimmer shall be used to trim around obstacles within the lawn area. Care shall be taken to insure that the bark of trees and shrubs are not damaged or stripped by the line trimmer.
4)Lawn sprinkler heads shall only be edged to allow for proper distribution of water.
GROUND COVERS / A. MOWING
Some ground covers may require cutting back to remove woody growth andpromote vigor.
B. TRIMMING/EDGING
1) Established ground covers bordering sidewalks or curbs shall be edged as often asnecessary to prevent encroachment.
2) Ground covers shall not be allowed to touch or cover the crowns of shrubs andtrees.
AERATION/COMPOST / 1)Plug aeration shall be performed by using an aerating tool or machine that removes soil plugs approximately 2 — 3 inches deep and 0.5 — 0.75 inches in diameter, and about 2 — 3 inches apart.
2)Compost shall be applied ½” deep per application if LCRA chooses to have this alternative task performed.
TURF GRASS, BED AND TREE FERTILIZATION / Fertilizer application must be performed at a rate of ½ pound nitrogen per 1000 square feet, per LCRA direction. LCRA prefers Supplier to use fertilizer which is organic, contains the least amount of toxicity, with no more than 3% phosphorus weed and feed shall not be used on site.
1)The timing and rates must be coordinated with and approved by the LCRA site manager.
2)If Supplier is unable to complete fertilization due to inclement weather, Supplier can work with the LCRA site manager to schedule, or re-schedule, an appropriate time. Fertilizer shall not be applied if rain is predicted within 24 hours.
3)Should chlorosis (iron deficiency) occur in woody plants, an iron supplement may be used.
INSECT AND WEED CONTROL / A. REGULAR INSECT AND WEED CONTROL
Examples of areas which should be included in specified areas include: lawn, paved areas, sidewalks, paths, trails, trees, and flower and landscape beds.
1)Identify and control ants, pests, insects and disease in specified area. Spot treat, if necessary with an organic pesticide/herbicide.
2)Control all weeds in specified area. Weeds may be removed manually. Spot treat, if necessary with an organic pesticide/herbicide.
3)Identify any unwanted plant growth and remove either by hand or by tool.
B. WEED CONTROL – Alternate Tasks
Pre-Emergent Control
1)All areas dressed with decomposed granite or natural ground shall be treated with pre-emergent herbicide. The pre-emergent must receive 0.511 of rain or be watered in within 10 days of application.
2)Areas seeded with wild-flowers shall be identified by LCRA and shall not be treated with pre-emergent herbicide.
Post-Emergent Control
1)All specified areas shall be treated with herbicides, per manufacturer instructions, which specifically target weeds and do not harm other surrounding or adjacent plants.
MULCH / 1)Supplier shall inspect and maintain proper mulching requirements and levels. A two (2) inch layer of hardwood native mulch shall be maintained in all bed areas at all times.
2)For trees and shrubs, Supplier must spread a 1-inch layer of organic compost around plant base.
3)No soil surface shall be left exposed to wind and rain.
4)Any areas which become bare of vegetation or subject to erosion shall be covered with mulch.
