RESOLUTION DECLARING EMERGENCY DUE TO CATASTROPHIC WEATHER AND DELEGATING AUTHORITY TO SUPERINTENDENT TO PROCURE GOODS AND SERVICES NECESSARY TO REPAIR AND REMEDIATE STORM DAMAGE

WHEREAS, the Board of Trustees of the Victoria Independent School District acknowledges that beginning on August 25, 2017 and continuing for several days thereafter, Victoria County and more specifically Victoria Independent School District was subjected to the effects of Hurricane/Tropical Storm Harvey causing catastrophic damage to VISD facilities, school equipment, and personal property.

WHEREAS, as a result of the Hurricane/Tropical Storm Harvey school equipment, school facilities, or a portion of school facilities have been destroyed, severely damaged and/or have experienced a major operational or structural damage.

WHEREAS, the Board of Trustees determines and finds that the delay posed by the contract methods required by Chapter 44 of the Texas Education Code and by §44.031 of that Chapter would prevent or substantially impair the conduct of classes or other essential school activities.

WHEREAS, the Board also finds and determines that contracts for the replacement or repair of the equipment, school facility or facilities, or a portion of school facilities may be made by a method other than the methods required by Chapter 44 of the Texas Education Code and specifically §44.031.

WHEREAS, under §44.031(h) of the Texas Education Code as a result of the catastrophe, emergency, and natural disaster from Hurricane/Tropical Storm Harvey and its effects on Victoria Independent School District, the Board of Trustees delegates to the Superintendent of Schools, Robert Jaklich, Ed.D. the authority to contract for the replacement, construction or repair of school equipment or facilities under sub-chapter B of Chapter 44 of the Texas Education Code because the emergency, replacement, construction, and/or repair is necessary for the health and safety of VISD students and staff.

WHEREAS, the Superintendent shall report the nature and amount of the goods and services, and/or contracts executed by the Superintendent to the Board of Trustees at the next meeting following such procurement or contract(s).

NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of the Victoria Independent School District declares the emergency outlined above under Texas Education Code §44.031(h) and delegates the authority to Superintendent Dr. Robert Jaklich, to procure goods and services necessary for repair and remediate storm damage as described above, to negotiate and execute contracts as necessary to implement disaster restoration and resume the conduct of classes and other essential school activities.
