REQUEST FOR APPLICATIONS FOR
IDAHOCOUNTY PUBLIC DEFENDER SERVICES
The Board of Idaho County Commissioners is currently accepting applications from qualified attorneys for the position of Idaho County Public Defender.
MINIMUM QUALIFICATIONS:
- Applicants must be licensed to practice law in the State of Idaho and hold active status membership in good standing with the Idaho State Bar; and,
- Applicants must have a minimum of three (3) years experience in criminal defense or prosecution and otherwise be competent to counsel and defend persons charged with crimes; and,
- Applicants will be required, if selected, to maintain an office presence in IdahoCounty sufficient to adequately administer cases for assigned clients in a timely manner; and
- Applicants must be able to provide appropriate facilities and support staff for provision of required services, including adequate Idaho County office hours to service clients; furniture, equipment, books or computer research access. If the selected public defender or public defenders have any assistant public defenders in their offices those persons, their clerks, stenographers and secretaries will all be paid from the amount budgeted by the Board of County Commissioners.
APPOINTMENT PROCESS:
Names of all qualified applicants will be submitted for consideration and selection pursuant to the procedures set forth in Idaho Code 19-860(a).
TERM OF OFFICE
- The term of appointment will be a minimum of two (2) years.
- The Board of County Commissioners is seeking applications from qualified attorneys and will have the ability to reject all applications and to have the public defender services appointed on a case by case basis from members of the qualified bar if they so choose.
- The person or persons selected for appointment by the Board of County Commissioners will be an independent contractor and will be required to enter into a written contract with the County. The terms of the written agreement will be established by the Board of County Commissioners upon such appointment. For reference purposes only, applicants may obtain a copy of the present Idaho County Public Defender contract from the Idaho County Clerk at (208) 983-2751. Also statistics for the past year on the number of appointments for misdemeanors, child protective cases, mental hospitalization cases, juvenile, and felonies are available upon request. Final contract terms may be changed from the present contract. The amount budgeted for Public Defender services is $125,000 annuallyas base pay, plus a contingency line for hours worked in excess of 50 hours (per case). Additionally, the budget includes separate line items for expenses($10,000) and secretarial support staff ($28,000).
