ORDINANCE NO. 1

AN ORDINANCE APPROVING THE HOUSING PROGRAM OF THE MUNICIPALITY OF MIAG-AO, PROVINCE OF ILOILO AND CREATING THE MIAG-AO HOUSING AGENCY IN IMPLEMENTATION THEREOF
BE IT ORDAINED by the Sangguniang Bayan of the Municipality of Miag-ao, Province of Iloilo, that:
Section 1.0 Mission
To provide affordable and adequate housing for homeless families and afford their access to social services and economic development as part of the municipality’s program to develop self-reliant communities.
Section 2.0 Organization
The Miag-ao Housing Agency is hereby created as an office under the Office of the Municipal Mayor. Its staff shall initially be limited to two (2) personnel, the first one as agency head, to be designated by the Municipal Mayor from any of the officials of the municipality, and the second one as his assistant, which shall also serve in concurrent capacity. The organization and staffing of the Miag-ao Housing Agency shall be decided by the Sangguniang Bayan of Miag-ao, Iloilo. A consultant pro bono may also be appointed.
Section 3.0 Objectives
The Miag-ao Housing Agency (MHA) is created with the following objectives:
3.1 To provide and maintain adequate housing for homeless residents of the Municipality of Miag-ao, Iloilo and administer such project within the guidance of the Sangguniang Bayan of Miag-ao, Iloilo subject to the provisions of existing national laws on housing programs.
3.2 To administer the property of the Municipality of Miag-ao, Iloilo known as the Rural Bliss I (RB I) project at Camp Monteclaro, Miag-ao, Iloilo, hereinafter referred to as the Miag-ao Housing I, composed of fifty (50) housing units covering an area of approximately two and one-half (2 ½) hectares, and such other future housing projects of the municipality.
3.3 To undertake housing development resettlement and other activities that would enhance the provision of housing to homeless low-income residents of the municipality.
Section 4.0 General Policies
4.1 The initial project in the Miag-ao Housing Agency Project I (MHA I) and all other subsequent projects have to be approved by the Sangguniang Bayan and the Municipal Mayor.
4.2 Miag-ao Housing I shall be developed, enhanced and sold to the original legitimate occupants or their legal heirs and other recipients as may be determined by appropriate authority.
4.3 A socio-economic survey shall be conducted on the present occupants of housing units of Miag-ao Housing I, the results of which shall be used as a tool in the planning and development of the project.
4.4 The price of the each of the existing fifty (50) housing units as well as the terms and conditions of sales shall be determined by the Sangguniang Bayan and subject to the approval of the Municipal Mayor.
4.5 The determination of recipients and awarding of housing units shall be subject to the review and approval of the Municipal Mayor based upon the recommendation of the MHA Administrator.
4.6 The expansion of the Miag-ao Housing I at the vicinity of the present site is hereby authorized, the plan for which shall be subject to the review and approval of the Sangguniang Bayan and Municipal Mayor.
4.7 To fund the project, the National Housing Authority and other government lending institutions mandated to provide capital for low-cost housing projects shall be tapped. Local entrepreneurs from the municipality, City and Province of Iloilo shall also be considered.
4.8 The recipients of housing units may be organized into an association to enhance the socio-economic well-being of the Miag-ao Housing I. The organization shall be under the guidance and supervision of the MHA Administrator.
4.9 All other policies shall be consistent with the provisions of the National Housing Authority Law and such other existing laws on housing.
Section 5.0 Funding
5.1 All funding requirements shall be subject to the approval of the Sangguniang Bayan.
5.2 Initially, the amount of Twenty Five Thousand Pesos (P25,000.00) shall be allocated from any available fund for the conduct of the socio-economic survey and to finance other operational expenses subject to the usual auditing rules and procedures.
Section 6.0 Separability Clause
If, for any reason, any provision, section or part of this ordinance is declared not valid, suspended or revoked by a court of competent jurisdiction, such judgement shall not affect or impair the remaining provisions or sections of this ordinance.
Section 7.0 Effectivity
This ordinance shall take effect fifteen (15) days after its approval and publication.
