11. The data for wood shall not be used for the purpose of evaluating the target of a minimum of 15 % by weight for each packaging material, as provided for in article 6(1)(c) of Directive 94/62/EC, as amended by Directive 2004/12/EC

Method of Data Compilation

A compilation and processing of packaging and packaging waste data are based on the provisions of Act No. 529/2002 Coll. on Packaging and on Amendments to Some Acts, whichhas been effective since January 1st 2003. All requirements of Directive 94/62/EC of the European Parliament and of the Council of 20 December 1994 on packaging and packaging waste have been transformed to this Act. Since January 2003, the Packaging Act has been amended several times and these amendments have resulted, interalia, in changes of the obligation to meet binding limits for recovery and recycling of packaging wastes.Originally, the Act was based on individual responsibility of obliged persons to meet recovery and recycling targets, keep records and report particulars from these records to the Ministry of Environment of the SlovakRepublic. Nowadays, these legal obligations can be fulfilled also through so called “collective systems” of authorised organisations (the compliance scheme) though a responsibility for fulfilling of legal obligations remains on an individual. This change of the Packaging Act has improved the quality of packaging and packaging waste registration as well as data reporting from the registration of the Ministry of Environment of the SlovakRepublic.

Within the framework of accession negotiations of the Slovak Republic to the European Unionin accordance with Article 6 (11) of the Directive 94/62/EC of the European Parliament and Council on Packaging and Packaging Waste, as amended by subsequent regulations, a transition period has been negotiated applied in the Slovak Republic by now throughimplementationby the Government Order of the SR No 220/2005 Coll. establishing obligatory limits on the extent of recovery of packaging waste and on the extent of their recycling in relation to the total weight of packaging waste until 2012 as follows:

2. Obligatory limits on the extent of recycling of packaging waste

The report for the year 2007 is compiled from reports of obliged persons and five authorised organisations established by obliged persons according to Article 8 (2) of the Packaging Act. In the year 2007 following authorised organisations acted in the SlovakRepublic for this purpose:

The organisation ENVI-REA, a. swas authorised by the Ministry of the Environment of the SlovakRepublic in the year 2007.

The authorised organisations keep records of packaging put on the market and of fulfilment of binding limits for packaging waste recovery and recycling of obliged persons (their clients).These organisations report summarised data to the Ministry of the Environment of the SlovakRepublic.

Data from the reports of obliged persons and authorised organisations are processed by Slovak Environmental Agency - Centre of Waste Management and Basel Convention. The Centre of Waste Management and Basel Convention operates Packaging and Packaging Waste Information System (OBALY), developed for the purpose of fulfilment of reporting obligations at the SlovakRepublic and European Union levels. On coming period it is expected that the packaging data will be more and more precise and a quality of reports will be improved, as in 2008 the sixth authorised organisation was established:

At present, an overall harmonization of legal regulations of the SlovakRepublic with relevant EU legislation is ongoing through a new Packaging Act proposal that is under the legal procedure. The new Packaging Act shall fully transpose the Directive 94/62/EC of the European Parliament and of the Council of 20 December 1994 on packaging and packaging waste, as amended by subsequent regulations.

Determination of packaging waste amount

According to Article 2 (2) of Commission Decision 2005/270/EC, the determination of packaging waste amount came from the amount of packaging placed on the market in the SlovakRepublic in 2007 with respect to data on customs and production statistics.

In accordance with the Act No 529/2005 Coll. on Packaging and on Amendments to Some Acts the amount of reusable packaging has not been included into the amount of packaging placed on the market.

Calculation of recovered and recycled packaging waste quantity

The quantity of recovered and recycled packaging waste is calculated from reports of obliged persons and reports of five authorised organisation. Details of keeping records and reports on packaging and on fulfilling recycling and recovery limits of packaging waste are stipulated by the Decree of Ministry of Environment of SR No 210/2005 Coll. onimplementation of certain provisions of the Packaging Act.The format of report is compatible with the format of Commission Decision 2005/270/EC.

The total amount of recovered packaging waste consists of the amount of recycled packaging waste and of the amount of packaging waste recovered by R1 operation (utilization as a fuel or other means to generate energy). The total mount of recovered packaging waste is incinerated in incineration plants (Bratislava and Košice) with heat energy utilization or combustion in cement kilns in the SlovakRepublic
