Rental License (Contract)

This LICENSE made the ______day of ______between

THUNDER BAY UNITED CHURCH CAMPS INCORPORATED – THUNDERBAY

(The Owner)

And

(The Licensee)

Whereas the Owner owns the site and buildings and contents therein situated on property known as Duncan Memorial Church Camp on the shore of East Loon Lake (the camp);

IN CONSIDERATION of the fees to be paid, THE OWNER AND THE LICENSEE HEREBY AGREE THAT;

  1. The Licensee shall use the camp for the purposes of ______only and for no other purpose; for the term of ______commencing the ______day of ______at ______and ending the ______day of ______at ______.
  1. The Licensee shall pay to the Owner before the commencement of the rental period the sum of $ ______for the use of the camp.
  1. The Licensee shall pay to the Owner a booking deposit of $250.00 on the date of this agreement as part of said rental. Said deposit, or 30% of total rental fee, whichever is more will be forfeited for ALL cancellations made 90 days or less prior to rental date and is NON – REFUNDABLE. One hundred percent (100%) of the rental fee will be forfeited for ALL cancellations made 60 days or less prior to rental date.
  1. The Licensee shall compensate the Owner in full any costs incurred due to damage or loss of property and contents as listed in the kitchen of the main building, during the rental period. (Copy of property and contents is available on request). The Licensee acknowledges that it is his / her responsibility to satisfy him / her / themselves as to the condition of buildings and contents and to draw any irregularity to the attention of the Thunder Bay United Church Camps Incorporated representative before the Licensee goes into procession.
  1. The Licensee shall further provide the Owner a damage deposit of $300.00 on the date of the rental payment to be used to satisfy any damages and / or loss to the property and contents referred to in paragraph 4. This will also be used to the cost of cleaning and / or taking away any garbage that the Licensee failed to take care of.
  1. The Licensee shall be responsible for and to bring their own camping needs, including the following items:
  1. X Large garbage bags. You are responsible for the removal of ALL garbage. Failure to do so will result in the loss of your security deposit. Take your garbage home or to the McTavish dump. (Times posted and dump passage card located on the bulletin board).
  2. One ply bathroom tissue only
  3. All cleaning supplies, including oven cleaner

  1. Tea towels, hand towels and paper towels.
  2. Personal toiletries and insect repellent
  3. Bleach – 1 capful in 2nd sink (rinse for dishes); liquid dish soap; liquid hand soap
  4. Food
  5. Craft supplies; toys; games; balls
  6. All sleeping equipment
  7. First aid equipment / supplies
  1. The Licensee shall use the camp only for the purpose for which it was intended
  1. The Licensee shall keep the camp and grounds in a clean and sanitary condition, in good order and repair
  1. The Licensee shall not use the electrical or other services in a manner which exceeds the capacity of the service
  1. The Licensee shall provide and keep in force throughout the term of the licence for the benefit of the owner a general liability insurance in the amount of $2000, 000.00 in respect to injury to, or death of any one person or property damage, and that all insurance shall be affected with insurers and upon terms and conditions satisfactory to the Owner. The Licensee shall provide with rental payment to the Owner copies of insurance policies or other evidence satisfactory to the Owner of insurance and any renewals of it. If the Licensee fails to insure as required, or fails promptly to furnish to the Owner satisfactory evidence of insurance, or of the renewal of any policy before it’s expiration, the Owner may effect such insurance for the benefit of the Licensee for a period not exceeding one year, and any premium paid by the Owner shall be recoverable from the Licensee on demands as additional fees.
  1. The Licensee agrees to release and indemnify the Owner against all liability, claims, damages or expenses arising out of any act or neglect by the Licensee, its servants, employees, agents, invitees or licensees in and about the camp and grounds or arising out of any breach by the Licensee of any provision of this license, including liability for injury or damage to the person or property.
  1. The licensee agrees to release and indemnify the Owner against all liability, claims, damages or expenses arising out of any act or neglect of the Owner, it’s servants, employees, agents, invitees or licensees in and about the camp and grounds or arising out of any breach by the Licensee of any provision of this license, including liability for injury or damage to the person or property, or camp equipment, or caused directly or indirectly by the Owner, property, or camp equipment.
  1. The licensee shall not assign or sublicense its interest in this license without the written consent of the Owner, which may withhold consent. Furthermore, the Licensee will not mortgage or otherwise encumber its interest in this license nor permit any other person to occupy any part of the Licensee’s area.
  1. The Licensee shall observe and comply with the rules and regulations set forth in the attached Schedule “A” and deemed to be part of this Agreement. Failure to observe such may result in the forfeiture of all or part of the security deposit referred to in Paragraph 5.

  1. The owner and all persons authorized by it shall have the right from time to time to enter the camp for any purpose and entry shall be deemed not to be an interference with the Licensee and the Licensee’s privileges granted by this license.
  1. The Camp shall be exclusive to the Licensee for the term of this agreement.
  1. The Owner will supply electricity in reasonable amounts to the Licensee’s area
  1. The waiver of acquiescence by the Owner of or in any breach of the Licensee of any covenant or condition shall not be deemed to be a waiver of the covenant or condition or any subsequent or other breach of any covenant or condition of this license.

Schedule “A”

Rules and Regulations

  1. The Licensee shall not perform acts or carry on any practices which may damage the buildings compromising the camp, and shall keep the Licensee’s area at all times orderly and tidy and shall keep the Licensee’s area clean and free from rubbish and dirt and shall store all trash and garbage within the camp and arrange for the regular removal of such trash and garbage. The Licensee shall not burn any trash or garbage within the confines of the camp. Doing so will result in forfeiture of deposit.
  1. The Licensee shall not make any alteration in or addition to the camp without the prior written consent of the Owner. If alterations become necessary because of the application of laws or government regulations or because of any act or default of the Licensee or because the Licensee has overloaded any facility, the licensee shall make such alterations at it’s own expense after first obtaining the Owners written approval of plans and specifications and furnishing such indemnification against liens, cost, damages and expenses as the owner may reasonably require.
  1. The Licensee shall observe such other and further rules and regulations as the Owner may make pertaining to the operating, reputation, safety, care, or cleanliness of the camp, the operation and maintenance of the buildings and equipment and maintaining of a suitable image to the community, provided such rules and regulations are reasonable and consistent with the provisions of this license. The Owner shall have the right from time to time to change the rules and regulations and shall not be responsible to the Licensee for the non-observance or violation of any such rules and regulations by any other tenant or any person.
  1. The Licensee shall not carry any stock or goods or have anything upon the camp, the licensee’s area of buildings or do or omit to do or suffer anything to be done in or about the camp which will in any way impair or invalidate the obligation of any policy of insurance effected by the owner of the camp.
  1. If the insurance rates in respect of the camp or any part of it or any tenant of any licensee in it shall be increased above the insurance rates in effect on the date the licensee opens for business in the licensees area by reason of the licensee’s use of the camp the licensee shall pay to the owner upon demand all premium increases resulting from such increases in rates.

  1. Absolutely no smoking in cabins, or on the property except in designated areas
  1. For insurance reasons no matches, lighters, candles, hair dryers, curling irons, or flammable materials allowed in cabins. “Pic” coils to be lit and supervised by an adult and placed on a non flammable surface such as a tin plate / tin foil.
  1. No sleeping in Craft rooms, or on the floors of the cabins. One person per bunk.
  1. The Licensee must have knowledge of operating / lighting procedures of the stove and the water heater in the tool shed.
  1. No composting which attracts wildlife
  1. No cutting of the trees. Dead fall may be collected and cut. You are obliged to bring your own firewood
  1. Motor homes for extra sleeping accommodations only. Use of microwaves, air conditioning units, televisions, etc is prohibited A fee of $5.00 per day per unit will be charged in addition to the rental fee. Hydro hook-up for lighting purposes only.
  1. Tents are permitted for extra sleeping accommodations on the camp grounds
  1. The cabins provide sleeping accommodations for a maximum of 77 persons. Exceeding this number is dangerous and illegal.
  1. All litter must be picked up from the upper / lower camp grounds, and beach area before you leave.
  1. All cabins to be thoroughly cleaned and all equipment (life jackets, paddles, etc.) must be returned to its proper place.
  1. Do not flush paper towels, or feminine products down the toilet.
  1. Please note that failure to adhere to the rules and regulations within this contract can, and will result in the loss of your security deposit.
  1. Remove all camping supplies when vacating premises.
