In accordance with Art. 8, paragraph 3, item 1and Art. 16, item 3 and Art. 9 paragraph 2, item 3 of the Articles of Association of the Serbian Business Registers Agency („Official Gazette of the RS”n. 85/04, 52/05), in connection with Art. 77 of the Law on Business Registration („Official Gazette of the RS”n. 55/04, 61/05) and Articles 6 and 11 of the Decree on the fee for the registration of data in business registers and other services provided by the Serbian Business Registers Agency („Official Gazette of the RS” n. 109/05), Serbian Business Registers Agency’s Board of Directors on 16/6/2006 hereby adopts this:
REGULATIONON THE PROCEDURE FOR THE DELIVERY OF ELECTRONIC DATA ANDON THE LEVEL OF FEESCHARGED BY THE SERBIAN BUSINESS REGISTERS AGENCY FOR ISSUING CERTIFICATES IN ELECTRONIC FORMAT
Art 1
This Regulationestablishes the level of fees for services provided by the Serbian Business Registers Agency (hereinafter: the Agency) of delivery of electronic data to interested parties, (hereinafter: the users), which are an integral part of the certificateand which are delivered in electronic format, in accordance with Art. 6 and Art.11 of the Decree on the level of fees for the registration of data in the Business Register and for other services offered by the Serbian Business Registers Agency (hereinafter: the Decree), through the electronic service provided by the Agency.
Art 2
Electronic data contained in the certificate set forth in Art. 1 of this Regulation are divided into four categories.
First category data (hereinafter: basic data) are: the registration number, full companyname, registered office address and tax identification number for those business entities for which the Agency has registered data.
Second category data are: data on the founders (company name or name and surname, identification number, not including data on capital assets/ownership), name and surname and identification number of persons authorized to represent and data on the predominant activity.
Third category data are: data on the total capital assets of the business entity and data on the capital assets of each founder individually (not including data on capital assets of shareholders in joint stock companies).
All data which are not listed in any of the previously mentioned categories, which are available on the Agency’s website, are classified as fourth category data.
Any order for delivery ofdata from a numerically higher category is at the same time a request for delivery of data from the previous, numerically lower categories.
Art. 3
All data set forth in the previous Article shall be delivered by the Agency to the users in electronic format and media, with an overview of the situation on the date specified by the user in the order.
The media in which the Agency shall deliver data to the users are:
- Read-only compact disc (CD)
- Read-only large capacity disk (DVD)
- USB memory (submitted by the user)
- Through FTP server.
Electronic formats in which the Agency shall deliver data to its users are:
- Excel sheets version 30 to 2000
- Access database
- CSV (comma separated values) files
- Text files.
If the user does not specify how he/she shall take delivery of the data, it shall be deemed that the data shall be picked up personally, at the Agency’s registered office address.
Art. 4
The fee prescribed for delivery of data specified in the categories set forth in Art. 2, per business entity, is:
- for first category data: 5dinars (in letters: five dinars),
- for second category data: 10dinars (in letters: ten dinars),
- for third category data: 15dinars (in letters: fifteen dinars),
- for fourth category data: 20 dinars (in letters: twenty dinars).
Art. 5
The user is obliged to deliver information on the search criteria required for obtaining the data set forth in the categories listed above (hereinafter: the criteria).
The search criteria which the user may request are:
- company name
- legal status, i.e. type of organization
- predominant activity (an activity code must be specified in the order, as prescribed by the Law on the classification of activities and the Register of classification units
- region (administrative district, city, municipality),
- persons authorized to represent (with identification number),
- members of the company’s Board of Directors
- name of the registration body (if data is sought for business entities which have been re-registered into the Companies Register of the Agency)
- founder (identification number of the person).
The user may submit a request order for multiple search criteria (e.g. business entities in which a certain natural person is the member of the Board of Directors or Director, or all public companies on the territory of a municipality and similar).
Art. 6
The user shall effect payment of the required fee in accordance with the quantity of data that he/she has taken delivery of, within three days from the date of receipt of the invoice.
Upon payment effected by the user, as set forth in the previous paragraph of this Article, the Agency shall enable the user to take delivery of the data requested in the request order, within two days from the date of submittal of evidence of payment by the user, in accordance with the invoice.
Art. 7
This Regulationshall take effect on the date of its adoption.
