Regular Monthly Meeting of the Board of Trustees of the Village of Newark Valley Was Held

Regular meeting of the Board of Trustees of the Village of Newark Valley was held Tuesday evening, May 13, 2008 at 7:00 PM in the Municipal Building. Present were:

Regular meeting was called to order by the Mayor at 7:00 PM. Guests were given the privilege of the floor. Mayor spoke about sidewalk issues and told residents that the village would lend out sidewalk forms on a first come first serve bases along with Public Works schedule and availability. He also encouraged the residents to communicate with the Code Enforcement Office to let him know what they can do. Some residents suggested a community project. We will meet two weeks from tonight, May 27th, at 7:00 PM and have a discussion after our Public Hearing. Mayor called for a five-minute recess.

MINUTES: Minutes from April 8, 22, 29, and 30th, last three being informational meetings, were read and approved as presented with a motion by Schaffer, seconded by DeHaas. Carried.

FINANCIAL REPORT: Discussed as presented.

BILLS: Presented. Approved in the amount of

$ 19,712.09, abstract numbers 187, 188, and 189 with a Motion by DeHaas, seconded by Schaffer. Carried.

WORK IN PROGRESS: Scott Evans spoke of the information sessions and felt that they went well.

Bridge at the Trout Ponds has begun. Looking for funding for bike park. One of the kids won a $4000 bike ramp, from Nike, and is donating it to the park.

Audit of codes - The planning board will be working on these when they are up and running.

TC Soil & Water is meeting with Dick Beirl next week to go over plans of the run off pond, and may have them close off the pipe at the bottom of the pond.

Reservoir property deed is almost complete. Attorney Como has some minor things to do and will have it completed before June 10th meeting.

Attorney Como will be working on the letter for the water outside residents, per their request from a previous meeting.

NEW BUSINESS: Business Permit – Thrift & Community Center was approved with a motion by Kaufman, seconded by Schaffer. Carried.

Business Permit – Cardinal Family Diner was approved with a motion by Kaufman, seconded by DeHaas. Carried.

Village of Newark Valley hereby accepts the plan by NTYL to install a batting cage and lights on the concession stand to shine on the dugouts at their expense with the understanding that the batting cage remains the property of NTYL and that they will assume any and all liability for it, and endemnify and hold harmless the Village from any third party liability. Motion by Schaffer, seconded by Kaufman. Carried.

RESOLUTION # 34-08 Water System Improvements (copy attached) adopted with a motion by a Roll call vote. DeHaas, Kaufman, Schaffer, Blee, Tornatore – Yes. 0 – No. Carried.

RESOLUTION # 35-08 Water System Improvements Project (copy attached) adopted with a motion by a Roll call vote. DeHaas, Kaufman, Schaffer, Blee, Tornatore – Yes. 0 – No. Carried.

RESOLUTION # 36-08 To hold a Public Hearing (copy attached) adopted with a motion by Schaffer, seconded by Kaufman. Carried. Roll call vote. DeHaas, Kaufman, Schaffer, Blee, Tornatore – Yes. 0 – No. Carried.

RESOLUTION # 37-08 Proposal for Additions & Alterations to Tappan Spaulding Library (copy attached) adopted with a motion by Blee, seconded by DeHaas. Carried. Roll call vote. DeHaas, Kaufman, Schaffer, Blee, Tornatore – Yes. 0 – No. Carried.

COMMITTEE REPORTS: Code Enforcement – Swagler - Residents from 34 Brook Street were asking about tires located on a tire rack and why that would be a violation. Also asked about the code for unlicensed vehicles that were specifically for racing and could not be licensed. They were told that tires could be a health issue due to a concern of West Nile Virus, and that the unlicensable cars should be kept in the garage.

Public Works – Foster – Jim Callahan wanted the village to know that he would be using the right-of-way road on Elm Street to bring firewood off the hill. He has the right-of-way as the village does and it is written in his deed, but wanted us to know in case there were any questions.

Motion to go into Execuive Session for personnel at 10:00 PM by Schaffer, seconded by Kaufman. Carried. Returned to regular session at 10:25 PM.

Motion by Kaufman, seconded by Blee to adjourn at 10:25 PM. Carried.
