Regular Council Meeting April 17, 2008

Mayor Thomas L. Hardesty called the meeting to order at 6:30 p.m. with the following Councilmembers present: Alan Matthews, Mike Zoeller, Donna Eaton,Valoise Owens, and Michael Miller. Shane Suttor absent.

City Employees present: Chief Robert Schutte, Frank Willoughby, Jesse Pauley, Carla Wainscott, and Chief Willard Tucker.

City Attorney: Frank Chuppe.

Councilmember Matthews gave the invocation.

All present pledged allegiance to the flag.

Minutes/April 3, 2008

Councilmember Owens moved to approve the minutes of April 3, 2008 as read by Council members prior to the meeting. Seconded by Councilmember Matthews.

All voted “aye” and motion carried. Shane Suttor absent.

New Employee – Chief Schutte introduced new police officer, Jesse Paulley.

Ordinance/Authorizing the Execution and Delivery of a Grant Agreement with Nifco North America – 2nd Reading - Frank Chuppe

Frank Chuppe, City Attorney, read an ordinance authorizing the execution and delivery of a Grant Agreement with Nifco North America providing for a grant to the company of an amount equal to 1/3 of the 1.5% occupational license fee collected by the company with respect to its employees over a period of 5 years.

It was introduced for second reading by Councilmember Zoeller. Seconded by Councilmember Matthews.

Upon roll call, Miller, Owens, Eaton, Zoeller, and Matthews voted “aye”. Councilmember Suttor absent.

Ordinance/Authorizing the Issuance of $19,500,000 Principle Amount of City of Shelbyville Tax Exempt and Taxable Industrial Building Revenue Bonds Series 2008A and Series 2008B – 2nd Reading – Frank Chuppe

Frank Chuppe, City Attorney read an ordinance authorizing the issuance of $19,500,000 principle tax-exempt and taxable industrial building revenue bonds Series 2008A and Series 2008B for the purpose of financing the acquisition, construction, and equipping of an industrial facility for Nifco North America.

It was introduced for second reading by Councilmember Owens. Seconded by Councilmember Zoeller.

Upon roll call, Councilmembers Miller, Owens, Eaton, Zoeller, and Matthews voted ‘aye’. Councilmember Suttor absent.

Proclamation – Youth Appreciation Week April 14-18, 2008 presented to the Optimist Club – Read by Mayor Hardesty

Presentation – Requesting Community Development Block Grant participation by the City of Shelbyville – Mrs. Trish Fegenbush on behalf of Child Town.

Child Town is growing and they have a waiting list of 150 plus children and no place to go. We are looking for a 2nd location out in Breighton Place Circle and requesting a CDBG to build a place there. Child Town program is 31 years old. They are hoping this new place will hold an additional 300 children. They are looking for the city’s approval for this CDBG application. They want the city to write a letter of recommendation.

Ordinance/Adopting a New Official Zoning Map – 1st Reading – Frank Chuppe

Frank Chuppe, City Attorney, read the ordinance. This is an ordinance adopting a new official zoning map for the City of Shelbyville. The existing zoning map is outdated, damaged, and does not accurately reflect all the property, all the current property zoned within the city and Triple S Planning & Zoning Commission after conducting public hearing is recommending that a new zoning map be adopted as the new official map for the county. This ordinance would adopt that map which may be attached. It is the same map Mr. Libke provided to the Council a couple of weeks ago. Mayor Hardesty commented there were no changes to the map. It’s just adopting a new map because it’s outdated and damaged. Mr. Libke replied, “That’s correct, Mayor”.

It was introduced for first reading by Councilmember Zoeller. Seconded by Councilmember Matthews.

Presentation – Shelbyville Public Roadways – Willis Avenue; Old Vine Street; Short Street; and Equity Street – Austin Hays, Attorney, along with Larry Tingle from Tingle Surveys and a representative from the Western District Warehouse Corporation.

They would like to widen streets so that businesses such as Webb Funeral Home and Shannon Funeral Home will have an alternate exit route in case Main Street is closed.

Mayor Hardesty would like for the Property Committee to look over the report.

Department Reports

Eilene Collins, Shelby Development Corporation, reported that Clear Creek Clean-up is scheduled for April 19, 2008, 9:00 a.m. – Noon. SDC Board Meeting was changed from April 24 to April 22.

Chief Willard Tucker, Fire Department, reported they are wrapping up Spring run of inspections this week. The department has made 900-950 inspections within the last 2 ½ months. On April 29, 2008, Captain Herndon and Chief Tucker are flying to Louisiana for last inspection of new fire truck. Delivery is scheduled for the 2nd week of May, if no problems. Mayor Hardesty and Chief Tucker are looking at preliminary sketches for Fire Station No. 3.

Chief Robert Schutte, Police Department, reported that juvenile suspect was arrested on several burglaries on Bell Avenue. He is currently in the process of interviewing three more candidates for police officer. Chief Schutte reported he has a team of four for the Charity Golf Scramble.

Mayor’s Report

Charity Golf Scramble will be held on April 21, 2008. Residential Clean-Up Week is April 21-25, 2008. The Moonlight Social at Settle Gym is April 26, 2008. Beginning April 28, 2008, work will begin on refinishing the gym floor. Mayor attended KMCA Conference. Mr. Minnis is pouring the slab for the Kiosik at the Welcome Center

Council Reports

Councilmember Suttor reported that Code Enforcement has a website so people can complain on-line.

May 17, 2008, is the preliminary date to open the Skate Park.

Councilmember Eaton moved to adjourn meeting at 7:27 p.m. Seconded by Councilmember Suttor.
