CONTEST REGULATIONS

«ASSASSIN’S CREED FAN DAY CONTEST»

1.Purpose

UBISOFT EMEA, a limited liability company, registered number RCS Bobigny B 432 573 624, having its registered office at 28, rue Armand Carrel, 93108 Montreuil-sous-Bois Cedex, (hereinafter referred to as "UBI SOFT"), represented by ALAIN CORRE in his capacity as Chief Executive, hereinafter referred to as "UBISOFT", is organising a free contest with no purchase obligation involving the online registration of players of UBISOFT video games known as the «ASSASSIN’S CREED FAN DAY CONTEST».

2.Definitions

"Contest": means the contest organised by UBISOFT to encourage players to register online at the website .

"Video game": means all video games produced and distributed by UBISOFT and belonging thereto.

3.Conditions of entry

Entry in this Contest is open to any individual residing in mainland France, Italy,UK and Germany, except for persons involved in the organisation of the Contest and employees of UBISOFT, of any of its subsidiaries, of its parent company or of any of its affiliates, as well as their families (with the same name and living at the same address).

Minors may take part provided that they have obtained prior permission from their parents (or legal guardian). UBISOFT reserves the right to request written proof of such permission at any time and to carry out any checks, as well as to disqualify any minor who does not furnish such proof immediately or within such reasonable period of time as may be granted. In case of disqualification of a minor who is one of the Contest winners and thus entitled to one of the prizes described in Article 6 of these regulations (hereinafter the “Regulations”), an extra draw shall be held to award the disqualified entrant’s prize to another winner.

Entry in this Contest is limited to one per household (same name and address) every three months, or a total of four entries during the Contest period and per person, regardless of the number of email addresses held.

If multiple entries are made, especially using different email addresses, the entrant shall be disqualified from the Contest.

4.Contest procedures

The Contest shall start on 17/10/07 at 19:00 and shall end on 29/10/07 at 18:59 (French time).

5.Selection of Winners

The list of winners shall be available from the website (two) days after each draw.

Winners shall also be notified on the day of the draw by email sent to the email address supplied when they entered the Contest.

Said email shall also inform the winners that their prize will be sent by post within six weeks of the publication of the results to the address supplied when they entered the Contest.

If a winner has not received his or her prize within forty-five (45) days of receiving the notification email, he or she shall have ninety (90) days from being notified by email of his/her prize or from the publication online of the winners’ names in which to complain. After this time, the winner shall forfeit his/her right to the prize and a new draw shall be held to award his/her prize to another winner. Winners shall receive their prize by post at the address supplied when they entered the Contest.

Under no circumstances may UBISOFT be held liable in case of loss of or damage to prizes in the post and/or if the postal service is not working properly.

7.Prize-giving conditions

Only one prize may be awarded to each household (same name and address) and per number of authorised entries (a maximum of four). Winners must satisfy the conditions set forth in the Regulations before prizes can be sent out.

None of the prizes awarded may be contested in any way by the winner or exchanged for its cash value or for a replacement or otherwise exchanged for any reason whatsoever. However, if UBISOFT is unable to provide the prize won, it reserves the right to replace the advertised prizes with prizes that are equivalent in value or that have similar characteristics. Winners hereby waive their right to claim compensation from UBISOFT due to damage caused by the acceptance and/or use of the prize.

It is hereby stipulated that the request must mention the title of the Contest and the full name and address of the person requesting the information. Upon request, postage may be refunded on a second-class basis (subject to one request per household with the same name and address). The refund request must be accompanied by account details (bank or post office). The refund will be by bank transfer.

UBISOFT reserves the right in certain circumstances to postpone, modify or cancel this Contest, to change the entry period and to issue an immediate and final decision to resolve any difficulties arising during the Contest. UBISOFT shall not be held liable if, due to an unforeseeable and compelling event beyond its control, the obligations arising under these Regulations are unable to be fulfilled wholly or in part.

9.Protection of personal data

The recipient of the information contained in the Contest is UBISOFT. UBISOFT hereby advises entrants in the Contest that their names are processed electronically and kept in an electronic file, which it reserves the right to use for commercial purposes or to sell.

Winning entrants hereby authorise UBISOFT to use their full name and email address free of charge for the purposes of advertising the contest and/or publishing the results in any format and for a period of five (5) years from the announcement of the winners.

We would specifically like to draw the attention of parents and/or legal guardians to the use of our website by minors.

Parents should ensure that their children only disclose their personal details and take part in contests with their permission. Each entry form asks for the entrant’s date of birth. Minors shall be prevented from taking part until they have parental authorisation. We advise parents to use the supervisory tools available online or in-store to help them restrict Internet access and prevent their children from disclosing information without their permission.

Under the French Information Technology and Civil Liberties Act of 6 January 1978, entrants may request the right to access and correct their personal information and may ask that their details are not used for publicity or promotional purposes by contacting the organisation in their country of residence indicated below.

10.Refund of entry costs

Internet connection costs shall be refunded on request by any entrant under the following conditions. The postage paid when submitting the request shall also be refunded on request. The request must be sent by post no more than seventy-two (72) hours following the player’s entry in the Contest, with the postmark being taken as proof. Requests should be sent to the organisation based in the entrant’s country of residence, as indicated below.

To be valid, the request must be on plain paper indicating the name of the Contest, the entrant’s full name, email address and postal address, as well as the date and time of the Internet connection.

The refund request must be accompanied by bank or post office account details. Refunds shall be by bank transfer. Postage shall be refunded on a second-class letter basis.

Only one refund may be made per household (same name and address) and per number of authorised entries (a maximum of four) during the Contest. Any requests containing incomplete, altered or illegible details shall not be processed. UBISOFT shall not be liable for unprocessed requests.

Connection costs and postage shall be refunded as follows:

- Internet connection costs: refund based on five (5) minutes, the first full minute at EUR 0.12 and then each additional minute at EUR 0.02, or five (5) minutes at EUR 0.20.

It is hereby agreed that any entry in the Contest that uses unlimited Internet access (e.g. cable, broadband, etc.) shall not be refunded, since the service is taken out by the Internet user for his or her general usage, and the mere fact of taking part in the Contest does not give rise to any additional cost.

The refund request must be accompanied by supporting documents attesting to the fact that the entrant does not have unlimited Internet access.

- for postage costs: based on second-class letter postage.

The refund shall be made within around four (4) weeks from receipt of the request by UBISOFT.

11.Limitation of liability of UBISOFT

Entry in the Contest implies knowledge and acceptance of the characteristics and limits of the Internet, particularly with regard to technical performance, the response time for consulting, querying or sending information, the risks of interruption and in general any risks relating to Internet connection and transmission, the absence of protection of certain data from misuse and the risks of contamination by any viruses on the network.

Consequently, UBISOFT may in no way be held liable for the following, listed as, but not restricted to:

  • transmission and/or reception of any data and/or information over the Internet;
  • any malfunction in the Internet preventing the satisfactory performance or operation of the Contest;
  • any failure of receiving equipment or lines of communication;
  • the loss of any email or of any data in general;
  • routing problems;
  • the functionality of any software;
  • the consequences of any virus, computer bug, anomaly or technical failure;
  • any damage caused to an entrant’s computer;
  • any technical, hardware or software failure of any type whatsoever preventing or limiting entry in the Contest or causing damage to an entrant’s system.

12.Applicable law and jurisdiction

The Contest shall be governed by and construed in accordance with French law. It shall come under the jurisdiction of the relevant French courts in accordance with the rules set forth in the New Code of Civil Procedure. Entry in the Contest implies unconditional acceptance of all of these Regulations, the Internet code of conduct and the laws, regulations and other applicable texts in France.
