In this form and in the documentsappended, unless the context indicates otherwise, the term "competitions" refers to the competitions of the Ordre national du mériteagricole, the acronym "MAPAQ" and the term "Ministère" mean the Ministère de l’Agriculture, des Pêcheries et de l’Alimentation du Québec, and the term "Minister" means the minister entrusted with the operation and management of MAPAQ. Persons wishing to enter the competitions must read the participation rules and conditionsbeforehand.

  1. GENERAL CONDITIONS CONCERNING WHAT CONSTITUTES A COMPETING GROUP

The following can be members of a competing group:

  • any natural person who, throughout the reference period for the category in which the agricultural operation is entered, holds property rights in the principal agricultural operation. hereinafter called "owner";
  • the spouse of an owner;
  • a salaried employee of the principal agricultural operation of the participating business;
  • the child, nephew or niece of the owner or of the owner’s spouse.

The child, nephew or niece of an owner or of the owner’s spouse must, on May 1 of the competition year, also hold property rights in the principal agricultural operation, whose salaried employees must hold at least 20% of such property rights on the same date.

Apart from the owner or the owner’s spouse, any other member of a competing group must have shown ongoing involvement in the participating business for the entire reference period for the category in which it is entered. "Ongoing involvement" means participation in determining the goals for the business and in the decisions that concern it.

The child, nephew or niece of an owner or of the owner’s spouse enrolled full-time in a program of studies related to the activities of an agri-business, notably in agriculture, human resource management, business administration or marketing, is, during his or her studies, deemed to have an ongoing involvement in the participating business.

The above text is given only with a view to facilitating the processing of entries and has no legal value.

Documents for establishing the eligibility of the members of the competing group

All the documents needed to demonstrate the eligibility of each of the members of the competing group must be consulted by the recruiters before registration and by the judges, during the visit of your agri-business. Regarding property rights, you must make each of the following documents available if these property rights pertain to the shares of a legal person:

a)The statutes or letters patent of constitution or amendment of the legal person, describing its authorized capital stock within the five years preceding May 1 of the competition year;

b)The books or records of the legal person where the shareholders are listed, the number of shares of each shareholder, the payments made or to be made on these shares, and the dates of acquisition or transfer of the shares, where applicable, in the five years preceding May 1 of the competition year;

c)The register of transfer of shares for the same period.

  1. COMPETITION CATEGORY IN WHICH THE AGRI-BUSINESS IS ENTERED

Bronze

(The agri-business presented by the competing group must have been registered with MAPAQ for at least 5 years and as at May 1st of the competition year.)

The competing group consists solely ofeligible competitors who havenever won in the competitions. The group may compete only in the bronzecategory and enters in this category.

Silver

(The agri-business presented by the competing group must have been registered with MAPAQ for at least 10 years and as atMay 1st of the competition year.)

Groupconsisting of competitors who have won in the bronze category within a same group

The competing group consists solely ofeligible competitors who havewon in the competitions (in _____),
within a same group and in the bronze category. The group may participate and enter in the silver category. In so doing, it declares that it complies with all the participation conditions of the competitions, notably the conditions particular to the competition category concerned.

Groupconsisting of competitors who have won in the bronze category within a different group

The competing group consists solely ofeligible competitors who havewon in the competitions (in _____),
in the bronze category but within a different group. The group may participate and enter in the silver category. in the silver category but within a different group. The group may participate and enter in the gold category. In so doing, it declares that it complies with all the participation conditions of the competitions in these circumstances, notably the conditions particular to the competition category concerned.

Exception: Group containing at least one member who has won in the silver category

In so doing, it declares that it complies with all the participation conditions of the competitions in these circumstances, notably the conditions particular to the competition category.

  1. DESIGNATION OF A PERSON IN CHARGE (MANDATARY)

This person confirms that he/she accepts this mandate and agrees to be available throughout the competitions and to be present for the judges’ visit and at the awards ceremony, where applicable.

Designation of the above person as the mandatary of the agri-business is justified, where necessary, by:

the fact that the person is one of the main officers of the agri-business duly authorized pursuant to the powers conferred under the regulations of the agri-business, as attested to by the members of the competing group who are officers of the agri-business;

the fact that the person is an associate within the agri-business;

the fact that the competing agri-business consists of one or more legal persons and the members of the competing group are its only administrators. This section of the form is deemed to be a written resolution by these administrators designating the above person as the mandatary of this moral person or these moral persons and of the agri-business in general for the above purposes;

one or more powers of attorney and/or resolutions to this effect duly established and/or adopted by the proper authorities and a duplicate or duly authenticated copy of each of these documents provided with this form after having been acknowledged as genuine and signed for identification by the person designated as the mandatary.

7.4The judges’ visit will take place between June 25th and the end of July.The schedule for farm visits will, as much as possible, take into account your availability. However, if you foresee being absent for long periods, or if you change the dates after registration,please inform the Department before the beginning of the judging period. The Department reserves the right to refuse your applicationif it is impossible for the judges to visit you during the judging period.

  1. COMPLIANCE WITH ENVIRONMENTAL AND HEALTH AND SAFETY STANDARDS

9.1Declarations

The members of the competing group and the agri-business duly represented by the mandatary indicated in this formdeclare that:

a)The agri-business and property comply with the acts, regulations and orders-in-council governing environmental protection enacted by the competent authorities and agree to comply with all applicable provisions in this respect, to notify the Department of any notice, order or legal action in this regard and, where applicable, to take immediate steps to comply with all standards enacted under these acts, regulations and orders-in-council;

b)Notwithstanding the generality of the foregoing, that:

i)to the best of their knowledge, the property and its use and operation complied and continues to comply fully and at all times with all applicable acts, regulations, orders-in-council, agreements and policies in matters of the environment and health and safety adopted to date by the federal government, the provincial government and their jurisdictions;

ii)they have not been served notice or issued an order or a demand letter and do not foresee any liability arising from their knowledge or what they could have reasonably known about the lack of compliance of the property, its use and its operation with any requirement of the applicable federal, provincial or municipal acts or regulations, orders-in-council, agreements or policies in matters of the environment and health and safety, or have legal or administrative proceedings taken against them or are undergoing government investigation concerning any emissions, threat of emissions or the presence of any contaminant, pollutant, toxic substance, or hazardous material or waste into the environment or in any facility or structure, or the existence of any environmental nuisance or cause of lack of environmental safety.

9.2Consent – Access to information and documents

To enable the Department to verify the above, each member of the competing group, on his/her behalf and the mandatary designated above, in that person’s capacity as the duly authorized representative of the agri-business, authorizes access to any document, study or book in his/her possession or held by an agent or other public authority concerning the agri-business and the quality and situation of the property as regards its compliance with all standards or requirements in matters of the environment or health and safety, and the exercise of any activity in or on the property that could alter the quality of the environment or of health and safety, including, without limitation, authorization for the Ministère du Développement durable, de l’Environnement et de la Luttecontre les changementsclimatiques to provide the Ministère de l’Agriculture, des Pêcheries et de l’Alimentation with any useful or necessary information or document for verifying the accuracy of the declarations made herein.
