2009 the Texas Legislature passed Jenna’s Law, calling for each public school district to adopt and implement policy aimed at preventing child sexual abuse.
SB 471 amendments require child abuse and neglect training and policies in schools
Senate Bill 460 / Requires ALL district and open-enrollment charter school employees participate in a training to increase awareness about prevention techniques and recognition of sexual abuse and other forms of child maltreatment. Each school district and open-enrollment charter school must also maintain records that include the name of each district or charter school staff member who participates in the training.
Adopt and implement a policy addressing sexual abuse and other maltreatment of children, to be included in the district improvement plan and any informational handbook provided to students and parents.
Training Should include:
Characteristics, and identification of Mental and Emotional disorders
Effective Strategies for teaching and intervening with student with mental or emotional health disorders.
De-escalation, and Positive Behavior Intervention / Training must provide:
factors indicating a child is at-risk for sexual abuse or other maltreatment; likely warning signs indicating a child may be a victim of sexual abuse or other maltreatment; internal procedures for seeking assistance for a child who is at-risk for sexual abuse or other maltreatment, including referral to a school counselor, a social worker, or another mental health professional; techniques for reducing a child's risk of sexual abuse or other maltreatment;
Requires each school district and open-enrollment charter school maintain records that include the name of each district or charter school staff member who participated in the training.

This legislation makes changes to requirements for minimum academic qualifications for any educator certificate that requires a bachelor’s degree to also require persons to receive training in mental health, youth suicide, and substance abuse. Training materials must be selected from the list of recommended best practice-based programs that is provided by the Department of State Health Services, in coordination with the TEA. / Each school district shall adopt and implement a dating violence policy to be included in the district improvement plan under Section 11.252.
(b)A dating violence policy must:
(1)include a definition of dating violence that includes the intentional use of physical, sexual, verbal, or emotional abuse by a person to harm, threaten, intimidate, or control another person in a dating relationship, as defined by Section 71.0021, Family Code; and
(2)address safety planning, enforcement of protective orders, school-based alternatives to protective orders,
Change from current law: Under current law, requirements for minimum academic qualifications for a certificate require persons to receive training in the detection of students with mental or emotional disorders. The instruction for this training must be developed by a panel of experts in the diagnosis and treatment of mental or emotional disorders who are appointed by the State Board for Educator Certification (SBEC).
The bill repeals a requirement that the training be developed by a panel of experts.

Each school district shall provide child abuse anti-victimization programs in elementary and secondary schools. / The agency shall develop a policy governing the child abuse reports required by Chapter 261, Family Code, of school districts and their employees. The policy must provide for cooperation with law enforcement child abuse investigations without the consent of the child's parents if necessary, including investigations by the Department of Protective and Regulatory Services. Each school district shall adopt the policy.

The Texas Employment Discrimination Law requires that all state employees receive employment discrimination training, including coverage of sexual harassment issues, within thirty days of commencement of employment and every two years.

Health & Safety Code, Title 2, Subtitle D, Chapter 81 / Texas public school districts are required to implement blood borne pathogen exposure control plans.
Employees having "reasonably anticipated" exposure to blood or OPIM through skin, eye, mucous membrane, or broken skin by: (needlesticks, human bites, cuts, abrasions) that result from the performance of an employee's job duties.
Employees expected as part of their job duties to render first aid or medical assistance are covered by the requirements of the standard. / The standard excludes employees who perform unanticipated "Good Samaritan" acts; e.g. one employee may assist another who has a nosebleed or is bleeding as result of a fall. Misuse of Prescription Drugs / SB 968 / In adopting TEKS for health education, the SBOE must adopt TEKS that address the dangers, causes, consequences, signs, symptoms, and treatment of nonmedical use of prescription drugs.
TEA must compile a list of evidence-based prescription drug misuse awareness programs. A school district may choose a program from the TEA-compiled list to use in the district’s middle school, junior high school, and high school health curriculum. / This bill would require the SBOE to add standards specifically related to the dangers, causes, consequences, signs, symptoms, and treatment of nonmedical use of prescription drugs.
Disciplinary Procedures / TEC, Chapter 37, Section 37.0181 / Principal or other appropriate administrator who oversees student discipline / Training on the distinction between a discipline management technique under Section 37.002(a) and Section 37.002(b). E-Cigarettes not allowable in school / SB 97
Amends Sections 28.004(k) and 38.006, Education Code. Amends Sections 161.081(3) and (4); 161.082(a), (b), and (d), and adds 161.081(1-a), Health and Safety Code. / This legislation prohibits the sale or distribution of electronic cigarettes, or e-cigarettes, to persons younger than 18 years of age. / This definition is also added to the Texas Education Code, Chapter 38, Health and Safety. It also prohibits the possession, purchase, consumption or acceptance of e-cigarettes by an individual under the age of 18. / A school district must publish in the student handbook and post on the district’s Internet website whether the district has adopted and enforces policies and procedures that prescribe penalties for use of e-cigarettes.
College and Career Readiness / HB 18
Adds Sections 28.015, 28.016, 33.009, 51.3062(u), 130.008(g) and (h) and amends Sections 7.0561(b), (c), (d), and (j), and 28.009(b), Education Code. Amends §303.003(b-2), Labor Code / Each school district must provide instruction to students in grade seven or eight in preparing for high school, college, and a career. The instruction must include information regarding the following:
• Creation of a high school personal graduation plan
• Distinguished level of achievement
• Each endorsement
• College readiness standards
• Potential career choices and the education needed to enter those careers / The Center for Teaching and Learning must develop an online instructional program that districts may use to provide the instruction in preparing for high school, college, and a career required to be provided to students in grades seven or eight.
Diplomas / HB 181 / The requirement that school districts and charter schools print endorsements and performance acknowledgments on high school diplomas is removed. Districts must still include this information on high school academic achievement records/transcripts.
Graduation and EOC information regarding retaining. / SB 149

/ To be eligible to graduate and receive a high school diploma, a student must successfully complete the course requirements required by the State Board of Education for the foundation high school program or the minimum high school program (MHSP),
This bill would create a process by which students could earn a high school diploma without meeting all of the testing requirements. / Each school district and open-enrollment charter school is required to establish an individual graduation committee for each 11th or 12th grade student who fails to comply with the EOC assessment performance requirements for not more than two courses.

• the principal or his/her designee;
• the teacher of the course for which the student did not pass the EOC assessment;
• the department chair or lead teacher supervising the teacher of the course; and

Behavior coordinator for student removal. / SB 107
Adds Section 37.0012 and amends Sections 37.002(a), 37.007(a) and 37.009(a) and (f), Education Code / The bill requires a person at each campus to be designated as the campus behavior coordinator who will be the primary individual responsible for maintaining student discipline and addressing issues related to removing a student from class. The bill would establish the responsibilities of the campus behavior coordinator which includes notification to the parent or guardian if a student was removed.
