Tiffany Smith: HRPDC Question: What happens with plans which are submitted to localities after the July 2012 grandfathering deadline, but before a local stormwater program is adopted, and for which there will be no permit coverage by July 1, 2014? i.e., before a local government has the necessary ordinances in place to utilize the new technical criteria.

John Paine: Great question!

Joe Battiata: grandfathering can be very complex. we may not be able to adequately answer that question, but will try. I recomended a FAQ for DCR's website to help address all the diferent situations that exist.

normanpitt: will DCR offer stormwater inspection training classes

Tiffany Smith: HRPDC Question: Will the state provide some guidance on hearings/board for enforcement? What will be eligible to go in front of the board? Boards will make enforcement far more difficult for local governments.

Tiffany Smith: HRPDC Question: Does DCR expect localities to consolidate E&S control, stormwater management, and CBPA programs to mirror the State program?

Deborah Brewster: briefly discuss process for approval of state and federal agency programs (similar to loacl programs). would there be different requirements for an approval process for a state or federal program. our understanding is that without an approved program, each state or federal project must be submitted to DCR for approval

Greg Dodd: will this presentation discuss any technical information that would be of value to private consultants

Joe Battiata: yes. Scott crafton will get into some of those details

Craig Whitaker: any thought or option of a locality having a combined e&s and Stormwater mgmt ordinance instead of two seperate documents?

Boyd Church: Are there any annual reporting requirements associated with this?

Susanna Headly: when will you update the DCR website so that all of its links to the storm water regs actually refer to the NEW regulations. its very bad for the public to go to a DCR website and pull up the old regulations

Ben Eib: can the localities seek asssitance from private consultanting companies for training and/or implementation?

Mark Graham: Will DCR provide recommendations as to staffing levels needed to assure compliance such as how many reviewers/inspectors per acre per year would be needed?

Deborah Brewster: how will certification training affect those already certified as combined administrators?

Peter Huber 2: Will there be any tools or guideance documents to assist with estimating staffing and program funding requirments.

Joe Battiata: many localities plan to combine the local programs. The model ordinance will probably not provide that level of implementation.

Tiffany Smith: HRPDC Question: In the pre-draft model ordinance, Section 1-14 "Appeals," what local governing body may conduct the judicial review? Do localities need to set up a separate Board for this purpose?

Joe Battiata: There will be reporting requirements - but not beyond the MS4 reporting.

Joe Battiata: These are all great questions - and the appropriate staff are not on-line to answer. I could make up an answer, but I expect you would rather hear from DCR. We will ask them to end out answers to participants after the webcast. Please keep the questions coming!

John Neel: Is the final predevelopment condition forested or meadow when emploting the energy balance?

Greg Evanylo: Do increased leaching losses with increased infiltration reduce the value/credit of a SW BMP?

Jonet Prevost-White: Will there be classes to teach the new methods in the blue book in a more formal education arena. (Local community colleges)?

Steven Rowe: Is there any change to the 2 foot separation requirement for infiltration basins. In the coastal plain region two feet is almost impossible to achieve

Glenn Telfer: is the type of receiving channel determined at the property line or a certain distance downstream? For example, if the site discharges to a storm sewer which ends 50 feet past the property line, is that still considered a manmade channel?

Joe Battiata: The CSN Coastal Plain technical bulletin provides some great guidance on coastal plain issues

Joe Battiata: The regulations include provisions for the limits of analysis downstream o the discharge point

John Neel: Is DCR comfortable allowing the use of provisions of the new regulations prior to thier official adoption? This has been happening on a case by case basis to date - John Burke

Ben Leatherland: Will the energy balance approach effectively reduce the hydrograph peak for the Q1-Q2 channel-forming (bankfull) flow in natural streams? If so, we may see unanticipated stream channel morphology changes (e.g., reduced ability of Q1-Q2 bankfull flow to transport bedload, and subsequent potential for increased stream channel aggradation and lateral migration).
