USER PARTICIPATION AGREEMENTAND
EXPRESS ASSUMPTION OF RISK AND RELEASE OF LIABILITY

In consideration of Central Washington University furnishing services and/or equipment to enable me to participate in Winter sport activities, including snowshoeing, cross country skiing, and snow camping, I agree as follows:I fully understand and acknowledge that outdoor recreational activities have: (a) inherent risks, dangers, and hazards and such exists in my use of winter recreational equipment including, snowshoe equipment, cross country ski equipment and my participation in winter activities; (b) my participation in such activities and /or use of such equipment may result in injury or illness including, but not limited to, bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability; (c) these risks and dangers may be caused by the negligence of the employees, officers, volunteers or agents of Central Washington University; the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes. Risks and dangers may arise from foreseeable or unforeseeable causes including, but not limited to, staff decision making, including that staff may misjudge terrain, weather, trail or route location, and elevation level, risks of hypothermia and such other risks, hazards and dangers that are integral to recreational activities that take place in a wilderness, outdoor or recreational environment; and (d) by my participation in these activities and/or use of equipment, I hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the employees, officers, volunteers or agents of Central Washington University.
I, on behalf of myself, my personal representatives and my heirs hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Central Washington University, its officers, employees, volunteers and agents from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use winter recreational equipment including, snowshoe equipment, cross country ski equipment or my participation in all winter recreation activities. I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by the officers, employees, volunteers or agents of Central Washington University.
The Venue of any dispute that may arise out of this agreement or otherwise between the parties to which CENTRAL WASHINGTON UNIVERSITYis a party shall be entered into in the County of Kittitas, Washington or the State Supreme Court in Kittitas County, Washington.
As a parent or legal guardian of a participant under 18 years of age, I have read and voluntarily agreed that said minor may participate in this winter activity, and I sign this release on their behalf. In addition, I give CentralWashingtonUniversity, its officers, agents, volunteers and employee’s permission to treat said minor in case of illness, injury, emergency, or accident. Should emergency medical services become necessary for the undersigned participant or minor the expenses are the sole responsibility of the participant and not that of CentralWashingtonUniversity.
CentralWashingtonUniversityreserves the right to accept or deny service to any person. I hereby agree to follow all rules, regulations, and instructions of CentralWashingtonUniversity staff. I agree and am aware that as a condition of being allowed to participate in the activities of Central Washington University, I will not consume any alcoholic beverages or other substance including, but not limited to any drugs or medication which would impair my senses before or while participating in any University recreational activities and I hereby agree to wear all safety equipment provided to me and/or my minor childat all times during the recreational activity. I also certifythat I and any minor on whose behalf I am signing are physically and mentally capable of participating in these activities.
セントラルワシントン大学が提供する、スノーシュー、クロスカントリー、雪上キャンピングを含む全てのウィンタースポーツに使用する備品レンタルサービスに対し、次の事項に合意します。私はアウトドア・アクティビティに関し、次の事項を理解し、認識します。（a）ウィンタースポーツには本質的に危険が伴うこと、また冬期レクリエーション用具（スノーシュー用具、クロスカントリー用具、ウインターアクティビティーなど）の使用にあたっても危険があること、そして私のウィンタースポーツ参加そのものに危険性が伴うこと。（ｂ）私がそのような活動に参加すること、そして／またそのような備品の使用により、結果的に負傷したり病気になることに限らず、身体的負傷、疾患、捻挫、骨折、部分または全身麻痺、死亡その他の疾患により、重大な障害につながる可能性があること。（ｃ）これらの危機や危険は雇用者や管理者、ボランティア、セントラルワシントン大学の代理人の職務怠慢によってもたらされる場合、または参加者自身や他の参加者の怠慢、事故、契約不履行、自然などの力による理由があること。危機と危険は原因が予測できることとできないことがあること。例えば、自然の中でのアウトドアまたはレクリエーション環境の中でスタッフが決断を誤ったり、地形、道、位置、高度、低体温に対する危険性が常に付随すること。（ｄ）これらの活動に私が参加することまた用具を使用するにあたって、すべての危機や危険性を理解し、自己の怠慢や雇用者、管理者、ボランティア、セントラルワシントン大学の代理人が原因となる全体的または部分的なあらゆる損失、そして／または損害に対し、責任を負います。
私は、私自身と私の代理人および私の相続人に代わり、私が被った身体的損傷、所有物の損失、不慮の死、サービスの停止、または冬期レクリエーション用具、スノーシュー用具、クロスカントリー用具の使用停止、また全ての冬季レクリエーション活動への参加停止に対し、セントラルワシントン大学、その管理者、雇用者、ボランティア、代理人に責任を求めることはいたしません。
この合意書に関してセントラルワシントン大学が関与する裁判地は、ワシントン州Kittitas郡またはワシントン州Kittitas郡最高裁判所とします。
18歳未満の学生の親または法的親権者として、私は合意書を読み、私の子供がこの冬期活動に参加することに同意します。また、この合意書に子供の代わりにサインします。加えて、私はセントラルワシントン大学、その管理者、代理人、ボランティア、雇用者に対し、私の子供が病気になったり、けがをしたり、緊急事態に陥ったり、事故にあったりしたときの対応に当たることをお願いします。もしこの参加者に対し緊急医療処置が必要になった場合、その費用は全て参加者の負担とし、セントラルワシントン大学への請求はいたしません。
セントラルワシントン大学は全ての人に対し、サービスを提供するか否かを決める権利を有します。私はセントラルワシントン大学スタッフの全ての規則、規程、指導に従います。私はセントラルワシントン大学にアクティビティへの参加を許可されたものとして、アクティビティへの参加前および参加中、アルコール類またはそれに順ずるものを摂取せず、運動能力を鈍らせる薬物または治療を受けないことに合意し、認識します。また私および／または私の子供は、どのような大学アクティビティに参加しているときにも参加中には支給された安全器具の装着を怠らないことに合意します。私または／および代理でサインする私の子供は、身体的精神的にこれらの活動に参加できる状態であることを確認いたします。
I HAVE READ THE WAIVER AND RELEASE ON THE REVERSE SIDE AND BY SIGNING IT AGREE. IT IS MYINTENTION TO EXEMPT AND RELIEVE CENTRALWASHINGTONUNIVERSITYFROM LIABILITY FORPERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.
This is a release of liability. Do not sign this release if you do not understand or do not agree with its terms.
