NOTICE OF INTENTION TO ENTER INTO QUALIFYING LONG TERM AGREEMENT (section 20 LANDLORD AND TENANT ACT 1985)

It is the intention of your landlord to enter into a qualifying longterm agreement in respect of which we are required to consult tenants.
In accordance with Section 20 of Landlord and Tenant Act 1985 as amended by the Commonhold and Leasehold Reform Act 2002 (‘the Act’), landlords are required to give notice to tenants, leaseholders and recognised tenants’ associations of the landlord’s intention to enter into agreements described in the Act as ‘qualifying long term agreements’.
These are agreements entered into by or on behalf of a landlord or a superior landlord for a term of more than 12 months in respect of services (referred to below as “the relevant matters”) in respect of which we are required to consult leaseholders.

Description of the relevant matters
The agreement which your landlord intends to enter into will be for the provision of buildings insurance with a contract duration of 3-5 years.
Reasons for entering into the Agreement
The reasons your landlord considers it necessary to enter into the agreementfor the provision of buildings insurance is to comply with our obligations under the terms of your lease, and to do so in a way that is the best value for money and because our existing agreementwill end on 31 September 2014.

Written observations(whether by email or in hardcopy) must be delivered to the email address or the postal address stated above on or before 7 July 2014.A response form is included for your convenience, but the response form is not part of this notice.
The consultation period will end on 7 July 2014. Additional days have been added to the statutory 30 days to take in to consideration postal delays and to provide landlords who need to onward consult with any tenants they have on a variable service charge with time to do so.
Reason you are unable to nominate a contractor.
Your landlord is not invitingleaseholdersto nominatepersons from whom your landlord should try to obtain estimates for the relevant matters because public notice is required.
Your landlord will be utilising the Government Procurement Service and Pro 5 (GPS pro 5) procedure, which was subjected to a public notice via the Official Journal of the European Union (OJEU) in 2012. Details can be found on their website: and ccs.cabinetoffice.gov.uk/contracts/rm958.
Your landlord will engage a global insurance broker to procure a buildings insurance provider through competitive tender using contractors listed in the Lot 1 framework collaboratively put together by Crown Commercial Service and YPO on behalf of Pro 5.
The contract will be awarded on the basis of the most economically advantageous tender – in other words, the best value for money and service, however, insurance carriers will be required to carry a financial rating commensurate with underwriting for a large national provider of housing.
