On March 20, 2012, the Commission served all Parties to this proceeding with the Initial Decision of Administrative Law JudgeDavid A. Salapa. Exceptions were due on or before April 9, 2012 and Replies to Exceptions were due on or before April 19, 2012.

On March 28, 2012, UGI Penn Natural Gas, Inc. (PNG) filed a request for a thirty day extension of time to file Exceptions and Replies to Exceptionsin light of the fact that the Parties were engaged in settlement negotiations and desired additional time to facilitate the resolution of these matters. The Commission granted the Parties’ request by Secretarial Letter dated March29, 2012.

On April 27, 2012, PNG filed a second request for a thirty day extension of time to file Exceptions and Reply Exceptions. PNG explained that the Parties were in the process of finalizing a settlement agreement and needed additional time to finalize and file the settlement. PNG represented that all Parties to the case consented to the request for an extension. The Commission granted the Parties’ request by Secretarial Letter dated April 30, 2012.

On May 25, 2012, PNG filed a third request for a thirty day extension of time to file Exceptions and Reply Exceptions. PNG again explained that the Parties were in the process of finalizing a settlement agreement and needed additional time to finalize and file the settlement. PNG again represented that all Parties to the case consented to the request for an extension.

The Commission’s Regulations at 52 Pa. Code § 1.15 permit a party to request an extension of time to perform an act. Where the request is made before the expiration of the specified period, the party must show good cause for the extension. The Commission finds that PNG has demonstrated good cause for the requested extension and hereby grants the request. Exceptions shall be due on or before Friday, June 29, 2012, and Replies to Exceptions shall be due on or before Monday, July 9, 2012.
