Photos Request for Marketing
Please provide a minimum of 6 high resolution photos (including a front elevation photo) of the property to be used to market it on our web site, auction brochure and etc.

Updating the MLS
Please add or update the property listing in the MLS, noting that the property will be sold at auction. Recommended verbiage:

This property is now under auction terms.All offers to include pre-auction offers must be submitted via the website at . This property is subject to a 5% or $2,500minimum buyer’s premiumpursuant to the Auction Terms & Conditions. Commission for Co-op agent paid at escrow is 2% or $750 minimum. *Commission based off the high bid.

Note: If there are any restrictions by your MLS that prohibit the verbiage above, please be sure to adjust accordingly and notify H&M. Note that H&M is not aware of your local MLS guidelines and doesnot suggest infringement of regulations.

Open House Dates
For all properties that are vacant the seller requires two open houses to be held on September 23 and 24, 2017,from1:00 – 3:00 PM. The Open Houses allow potential buyers to come and preview the property to confirm condition and value prior to bidding at auction and critical to success of the auction. If for some reason you cannot participate please notify me immediately so that I may notify the seller and update the web site to have showings by appointment only.

Submitting Offers
All offers must be submitted to Hudson & Marshall during the entire auction series. ‘Pre-sale’ offers can be submitted via our Bid Now! pre-auction offer program by clicking on the Bid Now! button on the Property Details page and completing the form.Offers will be submitted to the Seller in the order they are received and the Seller can accept an offer at any time during the presale period. Upon approval of a bid, the property will be considered ‘SOLD’, and no other offers will be considered. The deadline to submit pre-auction offers is listed above and on the Property Details page at

Terms of Sale
Successful bidders will be required to render certified funds (cashier’s check, cash or wire) down as Earnest Money upon Seller approval when signing the Purchase & Sale Agreement. Earnest Money is not considered an "Option" payment and will not be refunded under any circumstances. When placing a bid the bidders are agreeing to close on the property. Bidders are responsible to perform due diligence, including but not limited to, personal on-site inspection of each property prior to submitting an offer online. All properties are sold "as is, where is" with no warranties expressed or implied. Unless otherwise stated properties will be conveyed by Special Warranty Deed, and the owner's title policy will be paid at the expense of the Seller when using the Seller’s designated vendor. A Buyer's Premium fee will be added to the final bid amount on each property sold at this auction. The High Bid amount plus the Buyer's Premium equals the Total Purchase Price.
All properties must close on or before 30 - 45 days of seller execution date on the Purchase & Sale Agreement. It is important that prospects have obtained preliminary loan approval, if they wish to finance the property, prior to bidding on the property. This is a cash sale and is not contingent on the buyer's ability to obtain financing.

All bids will be subject to Seller's approval - the Seller reserves the right to accept counter or reject any bid.

Selling Agent Commission
All commissions paid are based off the high bid. In order to qualify for the selling agent 2% / $750 minimum commission, the selling agent must abide by and complete the following:

  • Review the Terms & Conditions of the sale (located online) with each presented client
  • Professionally assist the buyer by providing property information and previewing the property
  • Complete and sign the Co-op agent portion of the contract
  • Attend the live auction (if applicable) and complete the cooperating broker information on the back of your prospect’s bidder card at the registration table before the auction starts
  • Complete the Purchase & Sale agreement at the auction with your client
