Review Your Deed
Carefully review your Deed. If you notice any errors or omissions on your Deed resulting from mistakes made in your TotalLegal online interview responses, you may log in to your account to make the necessary corrections. Then, click "Download Document" on the Summary page to access your revised Deed. To make any other changes, you may download your Deed in Microsoft Word. Then, revise as needed, save and print.
Signing
The Grantor(s) must sign the Deed in front of a Notary Public. In addition, one of the Grantors must sign line above "Affiant" in the Oath of Consideration located at the end of the Deed. This must also be signed in front of a Notary Public. Before signing, the Grantor who will be signing (also known as the Affiant) must also fill in the actual fair market value of the property. After the Notary Public acknowledges the signature(s) of the Grantor(s), he or she will complete the blank lines in the Acknowledgment section, sign and stamp it.
If there is more than one Grantor, all Grantors will sign in front of the same Notary Public. If it is not possible for all Grantor(s) to sign at the same time, you may download your Deed in Microsoft Word and use the "copy and paste" function to add additional Notary sections for any Grantor who cannot be present.
Filing and Recording
Take the Deed to the office that maintains land records in the county where the property is located and request that it be recorded. Depending on the state, the terms “registered” or “filed” may be used instead of recorded, and the land records office may be called the Register of Deeds, the Recorder’s Office, or the Land Registry Office. Generally, a fee is charged when a Deed is recorded. Contact the land records office in your county to confirm location and the recording fee.
If the Deed is sent for recording by mail, the original recorded Deed will be sent to the return address indicated on the deed. If the Deed is presented in person, a recorded copy will generally be given to the person who presented the Deed for recording immediately.
The property tax statements will be sent to the person designated to receive property tax statements in the upper left corner of the Deed.
