APPROVAL OF WASTEWATER CONSTRUCTION GRANT FOR THE CITY OF STOCKTON REGIONAL WASTEWATER CONTROL FACILITY (SRWCF) STAGED EXPANSION PROGRAM STAGES I & II AS PROVIDED FOR IN PROPOSITION 13, THE SAFE DRINKING WATER, CLEAN WATER, WATERSHED PROTECTION, AND FLOOD PROTECTION BOND ACT

DISCUSSION

California voters approved Proposition 13 “The Safe Drinking Water, Clean Water, Watershed Protection, and Flood Protection Bond Act” (2000 Water Bond) in March 2000. The 2000 Water Bond contains $35.5 million for construction of wastewater treatment facilities in the cities of Stockton, Manteca, Tracy, and Orange Cove and delegates the administration of the program to the State Water Resources Control Board (SWRCB).

In order to provide the funds expeditiously, while ensuring substantial water quality benefit, the SWRCB will apply the State Revolving Fund (SRF) loan program policy[1] as the Wastewater Construction Grant program requirements. The City has submitted documentation that meets the State requirements of the SRF loan program policy.

The SRWCF serves the incorporated and unincorporated areas of the Stockton metropolitan area. The facility utilizes a trickling filter/activated sludge treatment system followed by settling/finishing ponds and gravity filtration. The tertiary effluent is discharged to the San Joaquin River.

The SRWCF has a rated treatment capacity of 38 million gallons per day (mgd). However, the SRWCF is now experiencing daily flows approaching 38 mgd and will exceed this capacity in the near future. The purpose of the proposed upgrade is to increase the capacity to meet future needs and increase system reliability and efficiency.

The City of Stockton (City) prepared a Mitigated Negative Declaration/Initial Study for the proposed project which was distributed to the public and circulated through the State Clearinghouse (SCH #1994022010) for review from February 4, 1994 through March 7, 1994. The City held a public meeting on February 3, 1994. During the review period, the City received comments from three public agencies. The City considered the comments, prepared adequate responses, and made appropriate changes to the environmental document. The City Council approved the Mitigated Negative Declaration and adopted a Mitigation Monitoring and Reporting Program on December 12, 1994. The City filed a Notice of Determination with the San Joaquin County Clerk and Governor’s Office of Planning and Research on December 14,1994.

POLICY ISSUE

Should the SWRCB approve a $9.68 million grant to the City, as provided for in the Safe Drinking Water, Clean Water, Watershed Protection, and Flood Protection Bond Act?

RWQCB IMPACT

The Central Valley Regional Water Quality Control Board has prescribed waste discharge requirements for the facilities to protect the beneficial uses of the waters of the State. The proposed projects will ensure compliance with the discharge requirements.

FISCAL IMPACT

The Water Bond does not provide guidance on fund allocation to the four communities. Therefore, the four communities met with Division of Clean Water Programs staff on May 11, 2000, and decided on the allocation of funding. The participants agreed upon the following allocations:

 The reduced distribution takes into account administrative and bond sale costs.

STAFF RECOMMENDATION

That the SWRCB adopt a resolution approving a $9.68 million grant to the City, as provided for in the Safe Drinking Water, Clean Water, Watershed Protection, and Flood Protection Bond Act.

APPROVAL OF A WASTEWATER CONSTRUCTION GRANT FOR THE CITY OF STOCKTON REGIONAL WASTEWATER CONTROL FACILITY STAGED EXPANSION PROGRAM STAGES I & II AS PROVIDED FOR IN PROPOSITION 13, THE SAFE DRINKING WATER, CLEAN WATER, WATERSHED PROTECTION, AND FLOOD PROTECTION BOND ACT

WHEREAS:

  1. Proposition 13, “The Safe Drinking Water, Clean Water, Watershed Protection, and Flood Protection Bond Act” (Water Bond), was approved by the voters on the March 7, 2000;
  1. Section 79122.2 of the Water Bond appropriates $35.5 million to the State Water Resources Control Board for the construction of wastewater treatment works for the Cities of Manteca, Stockton, Tracy, and Orange Cove;
  1. Division of Clean Water Programs staff met with representatives from the Cities of Manteca, Stockton, Tracy, and Orange Cove on May 11, 2000, and the four participants agreed upon the following grant funding allocations: Manteca $9 million, Stockton $10.5 million, Tracy $8.5 million, and Orange Cove $7.5 million;
  2. Section 79125 of the Water Bond allows for not more than three percent of the total allocation for administration costs. In addition, miscellaneous bond sale costs will be incurred, which could reduce the total funding to each City;
  3. The City of Stockton has submitted the necessary documentation for review by the Division of Clean Water Programs (Division) and the Division issued a Wastewater Construction Grant Approval letter on August 17, 2000; and
  4. The City adopted a Mitigated Negative Declaration for the proposed project (State Clearinghouse No. 1994022010) which has been reviewed and considered; and it has been determined that the proposed project will not result in significant negative environmental impacts.

THEREFORE BE IT RESOLVED THAT:

The State Water Resources Control Board approves a $9.68 million grant to the City of Stockton for construction of the Stockton Regional Wastewater Control Facility Staged Expansion Program Stages I and II. This funding is provided for in the Wastewater Construction Grant Subaccount, Section 79122.2, of the Safe Drinking Water, Clean Water, Watershed Protection, and Flood Protection Bond Act. If additional funds become available in the Wastewater Construction Grant Subaccount, the Division of Clean Water Programs has the authority to increase the amount of the grant.
