Proof of identity and Right to Work in the UK

In order to comply with the regulations regarding employment we are required to carry out a Right to Work in the UK check on every candidate prior to offering employment. In addition to the Right to Work requirements, every candidate also needs to prove their identity.

What do candidates need to provide?

Proof of identity

Every candidate needs to prove their identity. This is in addition to the Right to Work criteria, although in some cases the same document may satisfy both requirements. Only original documents are acceptable. EAL will not accept Home Office travel documents on their own as proof of identity.

General proof of identity documents required for every candidate
UK Nationals / EU Nationals / Non-EU Nationals
Full and valid British passport or
Photographic British driving licence / Full and valid EU passport

National identity card / Full and valid passport

Original Home Office document confirming the right to be in the UK

Right to Work in the UK

There are three different Lists of documentation that you can show to satisfy Right to Work in the UK. If you have any of the documents from List1, documentation from any of the other combination lists will not be required. If you do not have a document from List one, you must present documents from List 2 or 3.

List1

A passport showing that the holder is a British citizen, or has the right of abode in the UK. / A national passport or national identity card showing that the holder is a national of an EEA country or Switzerland
A residence permit, registration certificate or document certifying or indicating permanent residence issued by the Home Office or the Border and Immigration Agency (UKBA) to a national of a European Economic Area country or Switzerland / A passport or other travel document endorsed to show that the holder is allowed to stay indefinitely in the United Kingdom, has the right of abode in the United Kingdom, or has no time limit on their stay in the United Kingdom
A permanent residence card issued by the Home Office or the UKBA to the family member of a national of a European Economic Area country or Switzerland / A Biometric Immigration Document issued by the UKBA to the holder which indicates that the person named in it is allowed to stay indefinitely in the United Kingdom, or has no time limit on their stay in the United Kingdom
A passport or travel document endorsed to show that the holder is allowed to stay in the United Kingdom and is allowed to do the type of work in question, provided that it does not require the issue of a work permit / A Biometric Immigration Document issued by the UKBA to the holder which indicates that the person named in it can stay in the United Kingdom and is allowed to do the work in question.
A residence card or document issued by the Home Office or UKBA to a family member of a national of an EEA country or Switzerland

List2- combination documents*

You must provide document A, plus one of the documents listed B-H.

A. An official document issued by a previous employer or Government agency, e.g. HM Revenue and Customs, the Department for Work and Pensions, Jobcentre Plus, the Employment Service, the Training and Employment Agency (Northern Ireland) or the Northern Ireland Social Security Agency, which contains the permanent National Insurance number and name of the person (e.g. P45, P60, NI card)
B.An Immigration Status Document issued by the Home Office or the UKBA to the holder with an endorsement indicating that the person named in it is allowed to stay indefinitely in the United Kingdom or has no time limit on their stay in the United Kingdom / C.A full birth certificate issued by the United Kingdom which includes the name(s) of at least one of the holder’s parents / D.A full adoption certificate issued by the United Kingdom which includes the name(s) of at least one of the holder’s adoptive parents
E.A full birth certificate issued in the Channel Islands, the Isle of Man or Ireland / F.An adoption certificate issued in the Channel Islands, the Isle of Man or Ireland / G.A certificate of registration or naturalization as a British citizen
H.A letter issued by the Home Office , the Border and Immigration Agency, or UK Border Agency to the holder which indicates that the person named in it is allowed to stay indefinitely in the United Kingdom

List 3 – combination documents*

An immigration status document issued by the Home Office or the UKBA to the holder with an endorsement indicating that the person named in it can stay in the UK, and is allowed to do the work in question, when produced in combination with an official document giving the person’s permanent National Insurance (NI) number and their name issued by a government agency or previous employer (e.g. P45, P60, NI card). / A letter issued by the Home Office or the UKBA to the holder or the employer or prospective employer, which indicates that the person named in it can stay in the UK and is allowed to do the work in question, when produced in combination with an official document giving the person’s permanent National Insurance (NI) number and their name issued by a government agency or previous employer (e.g. P45, P60, NI card). / A work permit or other approval to take employment issued by the Home Office or UKBA when produced in combination with either a passport or another travel document endorsed to show the holder is allowed to stay in the United Kingdom and is allowed to do the work in question, or a letter issued by the Home Office or UKBA to the holder or the employer or prospective employer confirming the same.
A certificate of application issued by the Home Office or UKBA to or for a family member of a national of a EEA country or Switzerland stating that the holder is permitted to take employment which is less than 6 months old when produced in combination with evidence of verification by the UKBA Employer Checking Service / An application registration card (ARC) issued by the Home Office or UKBA stating that the holder is permitted to take employment when produced in combination with evidence of verification by the UKBA employer checking service.
