Project Development Undertaken by Former Roe 8 Alliance Team

1. Introduction

The former Roe 8 alliance is undertaking project development on the following four projects, prior to them being delivered by D&C contracts in the usual manner:

  • Kwinana Fwy Northbound Widening
  • Wanneroo Rd / Joondalup Dr Interchange
  • Armadale to North Lake Rd Bridge over Kwinana Fwy
  • Karel Ave Upgrade (delivery model to be confirmed, depending on project scope)

The alliance non-owner participants (constructors and designers) will not be prevented from tendering for the D&C contracts.

The alliance members will have a perceived advantage over other contractors/consultants when submitting an application for expressions of interest and subsequently, if shortlisted, will also have a perceived advantage when submitting a detailed proposal during the RFP phase. Special probity requirements will therefore be required.

2. Probity principles to be followed by alliance team

The following initiatives will be implemented by the alliance team during the project development phase:

  • The alliance will not be used to prepare contract documents (eg SWTC) except for some drawings (eg concept plans, site plans, lane configuration plans).
  • The alliance will not be used to prepare cost estimates, procurement plans, business cases or similar.
  • Main Roads will hold a joint risk workshop with the alliance team and release the output document to EOI applicants.
  • The alliance team will be available at the industry briefing to respond to questions from potential applicants.
  • Alliance team constructor members involved in development work must not be involved in preparing EOI applications or Proposals. Appropriate information barriers to be put in place and declarations signed.
  • Alliance team members involved in preparing EOI applications must be withdrawn from the alliance team,may not work on applications from the alliance office and will not be paid as direct costs under the alliance.
  • The alliance team will cease work on developing a particular project once the RFP is issued for that project, except for specific items that may carry forward into the RFP phase (eg environmental approvals).
  • In relation to these specific activities, information barriers will be established to prevent flow of information between alliance team members involved in the ongoing activities and those involved in preparing the proposal.
  • Proponents in the RFP phase to be invited to meetings held by the alliance team with key stakeholders.
  • Alliance team members involved in preparing proposals must be withdrawn from the alliance office, may not work on proposals from the alliance office and will not be paid as direct costs under the alliance. (This measure recognises that even though the alliance team has ceased work on a project that has commenced RFP, they may still be developing other projects that have not yet commenced RFP).
  • Keydocuments, including the following, are to be prepared by the alliance and provided to all applicants / proponents during the EOI and RFP phases:

- Minutes of all meetings (ie with stakeholders and community)

- The status of all development activities, updated on a regular basis

- The outputs of all development activities (ie reports, commitments registers)

  • Applicants / proponents will be given the opportunity to submit questions to the alliance (via Main Roads) for response.
  • Third party audits of the alliance to include a review of governance arrangements to ensure compliance with the probity plan.

3. Additional EOI initiatives

Main Roads will implement the following additional initiatives in the EOI process, to reduce the perceived advantage that the alliance non-owner participants may have:

  • Early advice to industry of proposed EOI timing.
  • Alliance non-owner participants need to submit an EOI application, no different to other applicants.
  • Adoption of revised and streamlined EOI process (reduced evaluation criteria) that will make applications less onerous.
  • No additional time to prepare applications – the usual EOI period will apply.
  • In order to minimise the perceived advantage, the “Preliminary Concept Statement” sub-criteria will be deleted from the “Project Appreciation” main criteria.
  • Shortlist four applicants instead of the usual three, if an alliance constructor non-owner participant is shortlisted.
  • Main Roads’ alliance team members not part of EOI evaluation.
  • Main Roads Alliance Board members not part of EOI evaluation.

4. Additional RFP initiatives

Main Roads will implement the following additional initiatives in the RFP process, to reduce the perceived advantage that the alliance non-owner participants may have:

  • Early advice to applicants of proposed RFP timing.
  • Additional time to prepare proposals, if an alliance non-owner participant is shortlisted.
  • Proponents that do not include alliance participants (constructor or designer) to be paid a specified amount for preparing their proposals.
  • Main Roads’ alliance team members not part of RFP evaluation.
  • Main Roads Alliance Board members not part of RFP evaluation.
  • EOI scores not carried across into RFP evaluation. Value for Money assessment to be applied to the Technical Merit part of the Proposal, but not the Capability & Key Personnel.
