Incidents Alleged – Already Occurred
More than 1 Years Old Upon Discovery
by a Mandated DD Reporter

I. For any MUI that appears current, active, or less than 365 days old, follow current MUI requirements (see A. below). Report all UIs according to the UI requirements.A. Current MUI requirements for allegations whereby there is reason to believe in the occurrence of abuse, neglect, exploitation, theft, or any incident that may constitute a crime (see MUI Definitions):
1. Immediately ensure health and safety.
2. Notify Law Enforcement (LE) or 241-KIDs immediately.
3. Notify MUIP within 0-4 Hours of Discovery
4. Notify Guardians, SF, Provider asap (within same day)
DO NOT NOTIFY #4 PERSON IF ONE OF THOSE IS THE PPI (alleged person involved) or the SPOUSE/PARTNER/FAMILY MEMBER living directly with the PPI
5. Send written report to MUIP by 3:00 PM the next working day.
B. For any such allegation that is reported as having occurred over 1 year prior to discovery (over 365 days), the DD discoverer/reporter shall do the following:
1. Immediately ensure health and safety and document verification.
2. Quickly access the person’s main file and SSA/SF or familiar HCDDS Staff (relevant to the allegation time period) for any record of that allegation.
3. Identify if that allegation was investigated by Law Enforcement, 241-KIDs, and/or MUIP.
a. If the case was clearly investigated and concluded by LE or 241-KIDS:
i. simply complete an MUI Incident report (skip A2, A3, A4 above)
ii. LABEL the incident report: “OVER 1 YR + INVESTIGATION CONDUCTED BY…(Cincinnati Police, Hamco Sheriff, 241, KIDS etc.). “Safety Verified”
iii. send the written report to MUIP by 3:00 PM the next working day.
b. If the case was not investigated, then:
i. fulfill all the usual MUI requirements
ii. LABEL the incident report: “OVER 1 YR+ NO INVESTIGATION VERIFIED”
4. When calling to notify LE (Law Enforcement), call the LE Dept. who is located in the residential area that the individual lived in at the time of the incident. Notify them of the allegation and be sure to find out if they had investigated the matter previously or made any determination, record, etc. Ask for that record. Then send it to MUIP. If that record will be delayed, send what detail can be immediately gathered to MUIP and then follow up once the record is received.
***Though the case may have been investigated, you may still want to notify the guardian to ensure they know what is going on unless they are the PPI. Use good discretion.
II. GUIDE for determining MUI (helpful factors to consider)
A. There was/is a clear allegation, suspicion, or occurrence of abuse, neglect, exploitation, theft (or MUI that may constitute a crime) based on fact not opinion. See MUI rule for definitions.
B. There was/is “reason to believe” the incident occurred …the report’s information is “reasonably” credible (source is reliable & or facts are reliable)
C. The Individual was/is at a “likely”, significant risk of harm at the time of the incident (vs. a potential one)
III. If a, b, OR c, are not the case, follow through with Unusual Incident (UI) requirements and proceed with prevention measures and the UI requirements. If further efforts gain information that later meets an MUI level, proceed according to the MUI requirements.
IV. MUIP UNIT ACTION: This PCD assumes that the determination made deemed the matter an “MUI” or “MUI-but non-served status”. In other words, those incidents determined “UIs” will be simply handled according to UI requirements. In all cases (current or old), MUIP shall verify with a strong statement that “…the individual’s health, safety, and welfare WAS verified. If the individual is not currently healthy or safe, then commence and document immediate actions.
A. 364 Days or LESS: For all incidents reported as suspected/occurring 364 or less days from the discovery date, MUIP will determine and commence like any MUI/UI incident according to current MUI Rule OAC 5123:2-17-02.
B. 365 Days or OLDER, and individual was not served by a county board of DD/COG at the time of the incident:
1. MUIP shall determine non-served status
2. MUIP shall enter the non-served status on DODD ITS.
C. 365 Days or OLDER and a different county/COG investigated (not HCDDS) the MUI:
1. MUIP shall notify HCDDS’ Regional Consultant and verify other county entry.
2. MUIP shall NOT enter into ITS.
3. MUIP will enter into the MUIP Share Drive in the MUI tab with the MUI number (will not be a 031 code).
D. 365 Days or OLDER, LE/Children’s Services Investigated, but “no” MUI was reported, determined, or investigated, etc.:
1. MUIP shall will file the MUI in ITS
2. MUIP shall utilize the LE Report
3. MUIP will note (in the ITS Report) that due to the lapse in timely reporting and the formal investigation by LE or Children’s Services, that investigation will stand as the formal investigation stand in the place of the usual protocol requirements.
4. MUIP will rule in or out “Failure to Report”. If ruled in, MUIP shall follow the usual Failure to Report MUI requirements.
E. 365 Days or OLDER, LE/Children’s Services did not investigate, AND “no” MUI was reported, determined, or investigated, etc.:
1. MUIP shall determine an MUI or UI
2. MUIP shall follow through with all required MUI or UI steps as usual.
*NOTE: If there is no SSA/SF, then MUIP shall send the report to the appropriate teacher, QDDP, etc. Notify Guardians as appropriate. MUIP personnel may send this procedure to non-SSA, non-DODD MUI personnel per their discretion (optional appropriate).
