Prodigy Studios Service Contract
Terms and Conditions
Prodigy Studios will provide the following services at the price listed:
Ceremony Session Package: $0000.00(CA Sales Tax 7.75% included)
- 2 hours of on-location session
- $50 credit towards purchasing prints

Terms and Conditions
Payment/Fees
The client shall remit a $50 booking retainer with this signed contract, to reserve the date and services of their portrait session. This retainer will be applied to the session fee if the session is not rescheduled or missed. Any charges incurred in shipping proofs, prints or products will be billed to the client. Prices for prints and products are valid for a period to any work beginning on the ordered images or product. Remaining amount must first be paid before any photos and packages are mailed or delivered to clients. All payments by check should be made payable to “Prodigy Studios”.
Additional Charges
Unforeseen fee, parking and tolls incurred with traveling to and from the photo location will be charged tothe Client.
Postponement/Cancellation
In the event of a postponement or cancellation of the affair or contract within 1 (one) month before scheduled date, any monies paid less the non-refundable reservation fee will be refunded. In the event of a postponement or cancellation of the affair or contract within less than 1 (one) month before thescheduled date, half (50%) of monies paid less the non-refundable reservation fee will be refunded.
Failure to Perform
If Prodigy Studios is unable to perform services agreed upon because of acts of God, labor strikes or other reasons and cannot perform these duties on another date, and have made a good faith effort to find another provider, Prodigy Studioswill refund all collected fees less the non-refundable reservation fee. Prodigy Studios will not be held responsible for circumstances beyond our control, including, but not limited to powerfailure, equipment malfunction or defective tape stock, photographer illness, fire, or other casualty. Prodigy Studios willreturn all money paid including the reservation fee, but not be held liable beyond the costs already paid by the Client to Prodigy Studios.
Assigns/Substitutions
In the event of illness or any reason outside the control of Prodigy Studios, Prodigy Studios reserves the right to substitutethe photographer(s) assigned.
Exclusive Rights
It is understood that Prodigy Studios is the exclusive official photographer retained to perform the services requested on this contract.
Permissions
Client will secure permission of the church, synagogue, or other officials/representatives to allow photos to be taken at the ceremony and reception locations. The reservation fee is non-refundable if such officials/representatives prevent photographing. Prodigy Studios will abide by the rules of the church/synagogue regarding camera, lighting and camera placement at the ceremony.
Production and Editorial Control
Prodigy Studios is granted full production and editorial control by the client regarding all aspects of the production and post-production services for this event. In the case a particular segment of the event is either not photographed, partially photographed, or not part of the images, it is at the sole discretion of Prodigy Studios as the exclusive producer of theevent photo shooting. Prodigy Studios has editorial rights to your images. Due to our style and unobtrusive nature, Prodigy Studios attempts to capture your event as-is. Prodigy Studios will attemptto use existing ambient light at all event locations. However, if necessary, we will use the camera’s flash toacquire a satisfactory image.
Copyright and Release
Prodigy Studios reserves the right to use photos for display, publication, promotional material or other purposes. All photo images remain the exclusive property of Prodigy Studios unless purchased outright. It is a violation of federal copyright law to allow photographs created by Prodigy Studios to be reprinted, duplicated, digitally reproduced, copied, scanned or altered without written permission.
Delivery of Finished Product
Prodigy Studios will deliver the final package to the Client, either via hand delivery or via courier.
Please note that Post-Production editing usually takes up to 12 weeks to complete. This is predicated upon delivery of allnecessary assets from other vendors or the Client. During peak seasons, Post-Production editing may take longer.
Service Agreement and Liability
This confirms our contracting Agreement: We agree that Prodigy Studios shall provide services to photograph you to the best of our abilities in accordance with the portrait session selected. Every effort will be made to assure your satisfaction according to industry standards. Any Artistic interpretations by the photographer will be deemed acceptable and correct. If you are not satisfied with your images through fault of Prodigy Studios, your images will be retaken. If you are not satisfied with your product through fault of Prodigy Studios, they will be replaced. Notification of dissatisfaction must be received in writing within one week of receipt of images or upon receipt of product(s) in order to receive a refund or replacement. Prodigy Studios will do all that we can to ensure that you are satisfied with you images and products. We cannot be responsible for dissatisfaction due to circumstances beyond our control. In the event that photographic materials are damaged or lost through camera or computer malfunction, the photographer’s liability will be limited to a retake of the session whenever possible or a refund of the cost of session fee, if images cannot be retaken. If the session fee must be refunded, Prodigy Studios will have no further obligation to the client.
WARRANTIES
PRODIGY STUDIOS MAKES NO WARRANTIES, EXPRESSED OR IMPLIED WITH RESPECT TO THE WORK OR PROPERTY THAT IS THE SUBJECT MATTER OF THIS CONTRACT.
