Preamble:

In the G.O. read at Sl.No.(1) above, Government had approved the consortium led by Siemens represented by Siemens Project Venture, GmbH, Flughafen Zurich AG and Larsen and Toubro Ltd., as the private sector joint venture partner (JVP) for the Bangalore International Airport Project (BIAP) near Devanahalli. The state promoters Government of Karnataka represented by KSIIDC and Government of India represented by AAI signed the Share Holders agreement [SHA] with the Joint Venture Partners on 23.01.02.

2. The KSIIDC is the Nodal Agency for implementation of Bangalore International Airport Project (BIAP). A BIAP cell was created within KSIIDC headed by a General Manager to give focussed attention to the project. Even after BIAL was set up KSIIDC continues to provide support, backup services and vital inputs for the implementation of the project vide Government Order read at Sl.No.2 above.

In the letter dated 3.06.02 read at Sl.No. (3) above the Managing Director, KSIIDC had intimated that M/s Dalal Mott MacDonald have been appointed as owner’s engineers for KSIIDC/GoK on the recommendation of IL & FS the project advisers, in anticipation of the Board’s ratification of the appointment. In the letter dated 19.8.02 read at Sl. No.(4) above the M.D, KSIIDC had conveyed the Board’s ratification of the appointment and had sought exemption under KTPP Act as desired by the Board.

4. In Government Letter read at Sl. No.(7) above certain clarifications were sought on the violation of clauses of the KTPP Act.

5. In letter dated 27.01.03 read at Sl. No. (5) letter dated 12.10.06 read at Sl.No.6 and letter dated 15.03.07 read at Sl. No. (8), while furnishing clarifications sought by Government, KSIIDC has requested reimbursement of an amount of Rs. 57.33 lakhs incurred by it towards the payments made to M/s. Dala Matt Mac Donald Owner’s engineers for BIAP.

6. Government have examined the proposal in detail and hence this order.

GOVERNMENT ORDER NO. IDD 35 DIA 2002,

BANGALORE DATED 24.08.2007

Sanction is accorded to release a sum of Rs.57,32,375.00 (Rupees Fifty seven lakhs thirty two thousand three hundred and seventy five) only towards reimbursement of expenses incurred by KSIIDC on the appointment of Owners Engineers for the Bangalore International Airport Project, in the year 2002. Out of this, an amount of Rs.25.00 lakhs is released out of the budget provision under the Head of Account 5465-01-190-2-03-KSIIDC-BIAP Cell–211 Investments (Plan) during 2007-08.

2. The balance amount of Rs.32,32,375.00 shall be met through reappropriation from the head of account 5465-01-190-2-02-BIAL State Support Project – 100 Financial Assistance (Plan) to the head of account 5465-01-190-2-03-KSIIDC-BIAP Cell – 211 –Investments (Plan). Suitable reappropriation order to this effect has been issued vide G.O.No.FD 172 BRS 2007 dated 28.07.2007.

3. The MD, KSIIDC is authorized to draw the above amount of Rs.57,32,375.00 (Rupees Fifty seven lakhs thirty two thousand three hundred and seventy five) only on a payees receipt counter signed by the Under Secretary to Government, Infrastructure Development Department.

4. This order issues with the concurrence of Finance Department vide Endorsement No. FD 741 Exp.I /07, dated 28.7.2007.
