Procedures for Evaluation of Forest Stands
Issued pursuant to Section 9, Paragraph three
and Section 10, Paragraph one, Clauses 3 and 4
of the Law on Completion of Land Reform in Rural Areas
1. These Regulations prescribe the procedures for evaluation of forest stands.
2. The owner or the lawful possessor of a forest shall submit an application for evaluation of the forest stand to the territorial office of the State Forest Service (hereinafter – State Regional Forest Office) in the territory of which the relevant forest property or possession is located.
3. The State Regional Forest Office shall evaluate a forest stand if:
3.1. a land unit boundary plan and a land unit situation plan (a technical document for cadastral land evaluation and performance of other tasks related to utilisation of the land) have been prepared;
3.2. boundary plans and situation plans for units of land are registered in the State Cadastre Register of Immovable Property ; and
3.3. a forest inventory has been performed in accordance with the procedures set out in regulatory enactments.
4. A forest stand shall be evaluated by utilising updated data of the State Forest Register. Evaluation of a forest stand is a charged-for service.
5. A forest stand shall be evaluated by sections delimited in a forest inventory in rural territories of parishes and towns, combining such stands into sections, and combining immovable property and lawful possession together, utilising the following indicators:
5.1. type of site conditions of the forest;
5.2. composition of the forest stand;
5.3. average height and diameter of the species constituting the forest;
5.4. density or basal area of the forest stand; and
5.5. restrictions of economic activity.
6. When evaluating a forest stand, the number of trees in each section shall be calculated and the quantity of industrial wood and low-grade wood shall be determined in accordance with Annex 1 of these Regulations.
7. Trees of species constituting less than 5 % of the total wood supply in a stand shall not be included in the evaluation of a forest stand.
8. When evaluating a forest stand, the full value of the forest stand and the purchase price of the forest stand shall be calculated.
9. The full value of a forest stand shall be calculated, in compliance with Paragraphs 6 and 7 of these Regulations, by summing up the values of industrial wood and low-grade wood derived by utilising the following formula:
V = Tv x Cr x 1.45 , where
V – the value of industrial wood or low-grade wood (LVL);
Tv – value of a tree (LVL; Annex 2);
Cr – coefficient for determination of the value of trees, taking account of the rate category (Annex 3);
1.45 – index of tree value.
10. The purchase price of a forest stand shall be calculated in accordance with Paragraph 9 of these Regulations, and it shall not include:
10.1. the undergrowth of forest stands;
10.2. forest areas in which final felling and thinning are prohibited; and
10.3 forest stands where the average diameter of the dominant species is 12 cm or less.
11. The purchase price of a forest stand shall be reduced by applying a coefficient of 0.5:
11.1. for forest stands in which only final felling is prohibited; and
11.2. for forest stands where the average diameter of the dominant species is 12.1 – 15.0 cm.
12. The list of values of an evaluated forest stand (evaluation of a forest stand by sections subdivided in a forest inventory into land units) shall be approved by the responsible official of the State Regional Forest Office.
13. The forest owner or the lawful possessor shall submit the list of values of the forest stand to the territorial office of the State Land Service.
14. Until the establishment of the State Forest Register, updated data of the “Forest Fund” [“Meža fonds”] database shall be utilised for evaluation of forest stands.
15. Cabinet Regulation No. 209 of 8 June 1999, Procedures for Evaluation of Forest Stands, is repealed (Latvijas Vēstnesis, 1999, No. 191/192).
