TO OPEN A SUMMARY ASSIGNMENT proceeding, please file the following:

Form Number / Name of Form
PR-1840 / Summary Assignment – Petition (complete all sections and insert exact value of assets as of the date of death of decedent.You must list the names of all interested persons on page 2 and answer Questions 9 and 10.
Will (if any) / Original Will
PR-1843 / Summary Assignment – Order for Hearing and Notice (if required – see below)
PR-1846 / Waiver and Consent from all interested parties
PR-1806 / Proof of Heirship
PR-1842 / Summary Assignment – Notice to Creditors (complete all blanks except the case number and date that property is to be assigned.After Court personnel have entered the date, you must take a copy to the newspaper for publication.

HEARING:In most cases a hearing is not required by the Court, but may be set depending on individual circumstances.

FEES:An Inventory Filing fee of .2% of assets or a minimum of $20 is due when the Petition is filed.

SPECIAL

ADMINISTRATOR:If you also need to be appointed Special Administrator, please see next page.

MEDICAL ASSISTANCE (TITLE 19):Sec. 867.02, Wis. Stats. requires that you notify the Department of Health and Family Services. Mail a copy of the Petition and Notice to Creditors by certified mail, return receipt requested to: Department of Health and Family Services, Estate Recovery Program, P.O. Box 309, Madison, WI 53701-0309.

NOTE:A Summary Assignment Affidavit (Form PR-1841) must be completed and filed if a detailed list of assets is not provided in the Petition.

AFTER NOTICE TO CREDITORS IS PUBLISHED, file the following:

Obtain from Newspaper / Proof of Publication (showing date that newspaper published the notice to creditors)
PR-1817 / Affidavit of Mailing showing when a copy of the Petition and Notice of Hearing was mailed to DHFS (attach certified mail receipt card)
PR-1844 / Summary Assignment – Findings and Order

TO ALSO BE APPOINTED SPECIAL ADMINISTRATOR at the same time you open the Summary Assignment, complete and file the following:

PR-1853 / Letters of Special Administrator
  • If you are requesting to be appointed Special Administrator complete question Nos. 8 and 10 on page 3 of the Petition.
  • A bond may be required before Letters can be issued.This would be decided by the Court and based on the value of the estate, the type of assets and the terms of the will.
  • If you need certified copies of the Letters of Special Administration, the statutory fee applies of $3.00 for the certificate and $1.00 for each page to be certified.

TO CLOSE THE SPECIAL ADMINISTRATION, please file the following:

CERTIFIED COPIES:If certified copies are required, the cost is $3.00 for the certificate and $1.00 for each page copied or compared.
