Minutes of the meeting of Portreath Parish Council Planning Meeting held at Portreath C.P. School on Wednesday 11th January 2017

8302 Declarations of Interest

Councillor Frazer declared an interest in planning application PA16/11218

8303 Planning Matters

(a)  Various Tree works at Feadon Farm, Feadon Lane, Portreath for Mr G Zammit PA16/09975

Members discussed the removal of the trees. Cllr. Sanders felt that members should encourage the applicant to replace any trees that are removed.

Cllr. Sanders proposed that this Parish Council raised no objections but that Cornwall Council were informed that members of Portreath Parish Council would like to see any trees that are removed replaced with an indigenous species.

This motion was seconded by Cllr. Butler, put to the meeting and carried.

(b)  replacement of existing dwelling and construction of 1 additional dwelling at Capery Corner, Lighthouse Hill, Portreath for Mr J Street – PA16/11224

The Chairman suspended Standing Orders and invited members of the parish to speak.

Mr Massey, neighbour stated he had submitted his objections to the planning department on line, but felt it important to discuss his concerns with members of Portreath Parish Council. Mr Massey expressed the following concerns about the proposal:

-  The proposed properties are very high and will shadow his property in particular the solar panels he has, rendering them useless.

-  The stability of his property could be compromised with the construction of these properties.

-  This would be overdevelopment of the site

-  Privacy of his property would be lost with the proposed height of the dwellings

-  The plans show no green space, which is not in keeping with neighbouring properties.

-  The proposed properties are both 3 storey, all neighbouring properties are only 2 storeys.

Mr Massey noted that there were several boundary issues with the plans and suggested that a height restriction for development of this plot should be considered.

Mr Shepherd, neighbour expressed concern that the proposed properties will be over looking his property. The upstairs windows of the proposed dwellings (living areas) will look directly into the bedroom windows of his property. Concerns were also raised of the safety to the neighbouring properties with the work require to support the shale the rear of the proposed dwellings.

Mrs Shepherd, neighbour commented that the access to the site was very limited. The plans do not seem to show adequate turning and parking areas for owners/occupiers.

Mr May, neighbour commented that the proposed dwelling s would:

-  look directly into down the drive of his property, into the kitchen and the patio area

-  be over development of the very small site

Mr May also commented that the narrow access road would leave insufficient turning and parking areas for the proposed development.

Mr Bennett, neighbour refers to the access road as a well used footpath used by residents of Lighthouse Hill for accessing the village. Mr Bennett refers to this access being overdeveloped by neighbouring properties in recent years.

The Chairman thanked the members of the parish and reinstated Standing Orders

Councillors noted that they felt the proposal would be over development for the site. Councillors questioned the accuracy of the plans submitted. It was noted that the proposed dwellings would add a further 2 storeys from the original property at it stands currently. It was commented that the lack of green space on the plans could be cause for concern with regard for surface water runoff and lack of soak-a-ways detailed.

Cllr. Hitchen proposed that members of Portreath Parish Council OBJECT to the proposal on the following grounds:

1) The proposal if approved would result in overdevelopment of the site.
2) It was felt that the ridge height was excessive
3) The increased volume of vehicular traffic using the very narrow access lane to the site would cause great problems
4) There would be insufficient space to provide a vehicle turning area within the site.
5) There would be a lack of privacy for adjacent residents.
6) Concern regarding surface water disposal - lack of green space was also expressed.

This was seconded by Cllr. Butler put to the meeting and carried.

(c)  retention of works to back garden including decking, fence, shed and garden extension at 39, Tregea Close, Portreath for Mr. R. Rossignol – PA16/11246

Letters of objection from the Feadon Residents Group & Resident, V. Moyle were read to

the meeting.

During discussions Cllr Watts stated amazement that the applicant had gone ahead with the work in the wildlife corridor. Councillors commented that to give permission for this work to be retained would set precedence for neighbouring properties.

The Chairman proposed that members of Portreath Parish Council STRONGLY OBJECT to this proposal which would:
1) Disrupt the wildlife corridor.
2) Create a precedence for future similar applications.
3) A mains water supply is located under this wildlife corridor.

This was seconded by Cllr. Sanders put to the meeting and carried.

(d)  retention of lean-to log store and continued use of land for domestic storage

on land adjacent to Chygarder Farm, New Portreath Road for Nr. N. Hill –

PA16/11218

Cllr. Frazer left the meeting whilst this matter was discussed.

No objections were raised for this proposal however,

Cllr. Sanders proposed it should be recorded that members of Portreath Parish Council have no objections to this proposal subject to the inclusion of a condition restricting the use of the building to a log store in perpetuity.

This was seconded by Cllr. Butler put to the meeting and carried.

Cllr. Frazer rejoined the meeting.

(e)  demolition of existing extension and proposed two-storey extension at Primrose

Cottage, Mill Hill, Porthtowan for Mr. & Mrs. Healey – PA16/11860

It was resolved to raise no objections to this proposal

(f)  demolition of existing mundic bungalow and erection of four flats at Seaskape,

Penberthy Road, Portreath for Mr. M. Bellman – PA16/10960

The Chairman explained that consultee comments have been received and that the following have raised concerns regarding this application:

-  Historic Environment Planning ( West)

-  Environment Agency

-  World Heritage Site Office

The Chairman also reported that the Cornwall Council are minded to refuse this application.

The Chairman suspended Standing Orders and invited members of the parish to speak.

Mr Kendall, neighbour expressed a number of concerns about the proposal including:

-  The proposed dwellings are very large for the site

-  The ridge height of the proposed dwelling is excessive

-  The raised entrance level would mean the entrance to the proposed dwellings would be directly in line with the windows in his neighbouring property

-  There is a historic listed milestone outside the property, the plans show no evidence of retaining this feature

-  The potential occupancy for these dwelling could be upward of 16 people, leading to over occupancy of the site

The Chairman thanked Mr Kendall and reinstated Standing Orders

Councillors discussed Mr Kendall’s concerns and added that there limited parking detailed on the plans and considered the impact of this on the area taking note of the Millennimum hall and school traffic.

Cllr. Butler proposed that Members of Portreath Parish Council Object to this proposal on the following grounds:
1) The proposal is within the flood zone.
2) The site is opposite to a listed building and contains a listed milestone.
3) The development would result in a lack of privacy for neighbours.
4) The proposal if approved would result in over development of the site.
5) It as felt that an insufficient amount of parking space was to be provided.
6) It was felt that the ridge height would be excessive.

This was seconded by Cllr. Sanders put to the meeting and carried.

(g)  Modification of S106 relating to decisions PA93/00756F, PA95/00452F, PA97/00331/F to allow part of the accommodation to be sold, Collets Court, Feadon Lane, Porteath, Mr Collet

Councillors discussed the reasoning behind the 106 being placed on these flats. Councillors also discussed the original use of the building and expressed surprise that the building had never been listed it was never listed.

It was resolved to raise no objections to this proposal

(h)  5 day notice in relation to erection of 7 four bedroom second homes at Cambridge Barn, New Portreath Road, for Mr. M. Hitchen – PA16/10342

Cllr Hitchen declared an interest in this application and left the meeting.

The clerk reported that the planning officer was minded to support this application. Councillors were asked if they would

1)  Support the recommendations of the planning officer

2)  Agree to disagree with the recommendations of the planning officer

3)  Request consideration by the planning committee

Chairman Cllr Mr Watts proposed that members of Portreath Parish Council would support the decision of the planning officer.

This was seconded by Cllr. Frazer put to the meeting and carried.

Cllr. Hitchen rejoined the meeting.

8304 Correspondence

(a)  Councillors received an invitation to the launch of the Cornwall AONB Natural Capital Project report. Councillors were unavailable to attend this launch therefore declined the invitation.

(b)  Councillors received notice from the planning inspectorate of the diversion of footpath 5
