2.  DATE OF INTENTED MARRRIAGE Click here to enter a date.

3.  PREVIOUSLY EXECUTED TESTAMENTARY DOCUMENTS

¡ A Will or Revocable Living Trust cannot override a Prenuptial Agreement; however, they can be more generous (i.e., give the survivor additional property than that provided for in a Prenuptial Agreement).

Life Insurance

¡ A “Term” life insurance policy does not have any cash surrender value; in other words, if the owner stopped paying the premiums, the insurance coverage would end and the owner wouldn’t get back any money. On the other hand, a Whole Life, Universal Life, and certain other types of insurance policies are in part like a savings account and thus do have a cash surrender value, which would be refunded to the owner if he/she stopped making the premium payments or otherwise terminated the policy.

6.  POST-MARITAL PROPERTY

¡ With the exception of property received by inheritance or gift (including gifts from one spouse to the other), anything acquired by married people is generally presumed to be community property, meaning that a husband and wife each have an equal share in it. However, this presumption can be reversed by your Prenuptial Agreement.
