2007 Named Storm Plan Form

Whereas Harbour Village Marina Inc., herein after known as HVMI, has determined that in the event of a named storm such as a hurricane or tropical storm, a plan for the marina and vessels needs to be in place to protect from as much damage as possible.
It is necessary for all slip owners and slip renters involved to have this agreement executed to provide a clear understanding as to the necessary implementation of a quick and safe plan to help protect the boats and the marina.
This agreement is for a slip number______and is between HVMI and ______herein after known as slip owner or lessee (circle one) with the (boat name) ______, a _____foot ______(boat make).

I will be responsible for securing my vessel and equipment including all loose items and canvas removal if possible. I understand and agree that if I have not completed this process within 24 hours after the storm warning has been issued on the HVMI web site, HVMI will have their contractor make every effort to secure the boat and I agree that I will be billed $50.00 for this service plus the cost of the equipment used for this effort.

I authorize HVMI to have their contractor make every effort to have my boat secured in place using equipment onboard. Remove loose items including canvas if possible and store inside boat. I acknowledge that I will be billed $50.00 for this service. I will give access instructions with the Harbour Manager.

I authorize HVMI to have their contractor make every effort to have my boat secured in place using equipment not currently onboard. Remove loose items including canvas if possible and store inside boat. I acknowledge that I will be billed $50.00 for this service plus the cost of the equipment used for this effort. I will give access instructions with the Harbour Manager.

Emergency or sinking vessel, we will call one the one you circled, if you did not circle one than we will be using a rotating list.
Be advised that our contractor will remove and secure to the best of our ability any loose objects aboard the boat. Even if the owner has secured the boat, it will be inspected to insure that it was secured properly to protect others around it.
It is hereby agreed to by the undersigned that HVMI and their contractor cannot and will not be held responsible for any damage to said vessel while in the slip, ie; fire, wind, rain, flood, trees, vessels, docks or ground movement, and any moving objects etc. The owner of the above-described boat agrees to hold HVMI and their contractor harmless in case of any and all damage. Each owner must provide, with this signed and witnessed agreement, a copy of the current Insurance declaration coverage for this boat (if it is not already on file), which should include full liability coverage and fuel spill coverage at a minimum per the Rules and Regulations of Harbour Village Marina Inc..
I, the undersigned agree to be responsible for any and all charges incurred by this agreement including such charges as securing the boats and it’s equipment etc. All charges will be paid in full within ten (10) days after the storm has cleared the area. I also understand that in the event of my boat sinking, I authorize HVMI and/or their contractor to alert a Salvage company immediately. (using the above information if provided).
The owner of the above-described vessel also understands that storm paths are very unpredictable and that HVMI and their contractor must plan and make decisions early on in the event of a storm. Therefore, at some point, a storm may change course and not steer towards us after we have secured the boats. Charges will still incur for any work already performed as the process was preauthorized and agreed to be implemented and in place. We will be implementing the process at approximately 3 to 4 days ahead of a storm's predicted approach. Storm information will be placed on the Marina Web Site at our own discretion, not always coinciding with the Warnings and Watches put out by the National Weather Service. This amount of time is necessary to make every effort to see that all vessels are secure and still allow personnel time to leave and protect their own personal property and families.
I, ______as slip owner or lessee (circle one) of the ______(boat name) a ___foot______(boat make), agree to the entire plan as written above. _____ Enclosed is a copy of a valid insurance certificate, ____ a current Insurance Declaration on file in Marina Office. I understand that this agreement is for the 2007 Hurricane Season only and expires November 30, 2007. As indicated above, all charges are billed separately after each individual storm as they occur and due within ten (10) days after the storm has cleared the area. This agreement is not transferable. A copy of insurance and the Signed and Witnessed agreement must be received by July 1, 2007.
