Requirements:

Planning Applications: Drug and alcohol treatment facilities are listed as Type III Community Service uses per Section 8.0112.O of the City Development Code. In addition, a change in use (from prior commercial use to a community service use) requires a DR-C (Design Review-C) review. These are normally processed concurrently.

District and Review Standards: Community services are permitted within the SC district but are subject to planning reviews specifically designed to address the potential for use impacts. Since the site is already developed, most standards relative to new development proposals will not be applicable. However, since this use did not go through a City of Gresham planning review when it first went into operation, it is currently operating without City permits and will require such a review at this time in lieu of enforcement action.

Site characteristics such as existing parking and landscaping will be reviewed, as applicable, in addition to the operation of the use as part of the community service review process.

The applicant’s information has indicated the facility has been operating for 9 years. Drug and alcohol treatment facilities require a community service planning review—the applicant did not go through this review or obtain appropriate City permits/business licenses at the time, though they were required. The facility is, therefore, operating in violation of City standards and will need to file for appropriate permits in order to continue operation. Such permits will include: community service review, design review, occupancy permit, business license. The planning review will consist of the community service and design reviews. City enforcement action is on hold pending completion of required permit review processes.

Fees: The community services (Type III) review will cost $6203 plus a 1% surcharge (total is $6265.03) and requires a public hearing with the City Hearing’s Officer. The design review-C is normally an administrative review, but in this case would be done concurrently with the community service review. The DR-C fee is $1775 plus a 1% surcharge (total of $1792.75).

Other fees for follow up can be verified once the planning review has been completed.

Processing Time: Building and business license permits cannot be issued until the planning reviews (including appeals) have been completed (see following).

DEVELOPMENT ENGINEERING PRE-APPLICATION COMMENTS:

The project is located on the northwest corner of E Burnside Street and NE 162nd Avenue, in the Station Center (SC) Land Use District. The applicant proposes to continue the existing drug treatment program. The following comments are from Development Engineering.

A5.000: GENERAL

This pre-application memo is used to acquaint the applicant with ordinances and standards relating to public facilities. Information provided is preliminary and general in nature, and is intended to assist the applicant in identifying pertinent public facilities issues. It should not be considered final, and may contain unintentional errors or omissions. Any changes to the proposal after this date may void any statements made. Design and construction of all public facility improvements shall be in conformance with applicable sections of Gresham Community Development Code (GCDC), Gresham Public Works Standards (PWS), Water Quality Manual (WQM) and Gresham Revised Code (GRC).

A5.100: SANITARY SEWER FACILITIES

This parcel is provided wastewater service from City of Portland. No wastewater facilities are proposed at this time.

A5.200: SURFACE WATER MANAGEMENT SYSTEMS

The site lies within the designated sump area of the Columbia Slough Drainage Basin. No changes have been proposed to the site. Should any pavement or other impervious surfaces be constructed that total more than 1000 sf, detention and water quality treatment will be required.

Because this site was developed many years ago and is located in the designated sump area, it is possible that there are existing drywells. The developer will be required to contact Oregon Department of Environmental Quality (DEQ) prior to release of building permits/occupancy. DEQ will determine if the particular facilities require registration under the Underground Injection Control (UIC) program. DEQ may require water quality treatment that is in excess of that required by the City. Information can be obtained by calling DEQ at 503-229-5945, or visiting their website at http://www.deq.state.or.us/wq/uic/uic.htm. Please note that DEQ regulations apply for existing drywells, independent of impacts from development activities.

A5.300: WATER FACILITIES

The site lies in the Rockwood Water People's Utility District. No water facilities are proposed at this time.

CHARGES AND FEES:

A check of engineering records shows no liens or assessments against the property. System Development Charges (SDCs) and connection fees for parks, transportation, storm drainage, and sanitary service are payable to the City of Gresham prior to building permit issuance. Please check with the Permit Center for updated fees as the project progresses, as rates are subject to change and are those in effect at time of building permit application. Contact Rockwood Water for water-related SDCs and fees.

Parks and Transportation SDCs may apply to this development. All prior uses of the site will need to be determined to assess credits due. There are no City records indicating prior uses; the applicant will need to provide this information in order to be credited for the impacts of prior uses.

A person challenging the calculation of a system development charge or a facilities charge must appeal within 10 calendar days of the date the building permit relating to the charge is issued. The appellant shall file with the City Manager a written notice of appeal pursuant to GRC 1.05.025.

TRANSPORTATION PLANNING COMMENTS:

Development Transportation Planning has reviewed the proposal and given that it is a change in primary use from a commercial use to a Community Service Use, which is essentially a Commercial Tenant Improvement with no outward building/site changes and traffic impacts expected for a commercial area, and given that the drug and alcohol treatment aspect of the clinic use is anticipated to generate no additional traffic than a health clinic without drug and alcohol treatment, there are no comments or issues. A Neighborhood Circulation Plan will not be required.

1.  Provide fire flow per Oregon Fire Code Appendix B. Fire flow for commercial buildings varies based on construction and square footage; At 6720 Sq. Ft. Type VB Const. the flow would be 2250 GPM at 20 PSI. OFC App B Table B105.1.

2.  Submit a fire hydrant flow test report. The fire flow report will verify that the correct fire flow is available from the nearest fire hydrant. To schedule the flow test contact your local Water Utility District .OFC 508.4

3.  Fire hydrant locations are not shown on the plans. Additional hydrants may be required on site and spaced per the Oregon Fire Code. Show existing and all new fire hydrants on a separate civil plan that clearly delineates the fire hydrants. OFC App. C

5.  Fire department access roads shall extend to within 150’ of all portions of the facility. OFC 503.2.1

6.  No Parking Fire Lane signs or curb marking may be required on site. The marking will be indicated on future plans. OFC App D-103.6

7.  The turning radius for all emergency apparatus roads shall be 28’ inside and 48’ outside radius. OFC 503.2.4

8.  If a gate is installed across a fire access road, it must meet the requirements of the Gresham Fire Gate Policy. If it is across the “main” access road as determined by the fire official, it will need to be electrically operated. A SUPRA lock box will need to be installed with the card reader. It shall have a toggle switch inside to open the gate. This policy and lock box order forms can be faxed to you if requested. OFC 506.1

  1. Fire sprinkler and fire alarm systems may be required due to building size, construction type, occupancy, and fire flow available.
