Summary of the legal requirements

Accountable Manager (AM):

(ORA.GEN.210, AMC1.ORA.GEN.200(a)(6)(4 en 5)

Shall be appointed by the organisation;

has the authority for ensuring that all activities can be financed;

has the authority for ensuring that all activities can be carried out in accordance with the applicable requirements;

shall be responsible for establishing and maintaining an effective management system.

In the case of a non-complex organisation, the accountable manager may act as compliance monitoring manager provided he/she has demonstrated relevant knowledge, background and appropriate experience related to the activities of the organisation; including knowledge and experience in compliance monitoring.

In the case the same person acts as compliance monitoring manager and as safety manager, the accountable manager, with regards to his/her direct accountability for safety, should ensure that sufficient resources are allocated to both functions, taking into account the size of the organisation and the nature and complexity of its activities.

Head of Training (HT):

(ORA.ATO.110, AMC1.ORA.ATO.110b, ORA.ATO.210)

Shall be nominated;

has extensive experience as an instructor in the areas relevant for the training provided by the ATO;

possess sound managerial capability.

ensures that the training provided is in compliance with Part-FCL;

ensures the satisfactory integration of flight training in an aircraft or a flight simulation training device (FSTD) and theoretical knowledge instruction;

supervises the progress of individual students.

Has the overall responsibility to ensure that the training is in compliance with the appropriate requirements.

In an ATO providing training courses for different aircraft categories, the HT shall be assisted by one or more nominated deputy HT(s) for certain flight training courses.

Additional requirements for ATOs providing training for CPL, MPL and ATPL and the associated ratings and certificates:

Has extensive experience in training as an instructor for professional pilot licences and associated ratings or certificates.

Hold or have held in the 3 years prior to first appointment as HT, a professional pilot licence and associated ratings or certificates issued in accordance with Part-FCL, related to the flight training courses provided.

Compliance Monitoring Manager (CMM):

(ORA.GEN.210(b), AMC1 ORA.GEN.200(a)(6)(3)

Shall be nominated by the organisation;

ensures that the organisation continues to meet the requirements of this Part and other applicable Parts;

shall be responsible for ensuring that the compliance monitoring programme is properly implemented, maintained and continually reviewed and improved;

has direct access to the accountable manager;

shall be able to demonstrate relevant knowledge, background and appropriate experience related to the activities of the organisation; including knowledge and experience in compliance monitoring;

has access to all parts of the organisation, and as necessary, any contracted organisation;

shall be independent;

ensures that audits and inspections are carried out by personnel not responsible for the function, procedure or products being audited.

Safety Manager (SM):

(AMC1 ORA.GEN.a1;2;3;5;c)

Identified by the organisation;

responsible for coordinating the safety management system (SMS);

may be the accountable manager or a person with an operational role in the organisation.

Chief flight Instructor (CFI)

(ORA.ATO.210(b), AMC2.ORA.ATO.210 (b)

Additional requirements for ATOs providing training for CPL, MPL and ATPL and the associated ratings and certificates:

Shall be nominated;

shall be responsible for the supervision of flight and flight simulation training instructors and for the standardisation of all flight instruction and flight simulation instruction;

shall hold the highest professional pilot licence and associated ratings related to the flight training courses conducted and hold an instructor certificate with the privilege to instruct for at least one of the training courses provided.

Is ultimately responsible for ensuring quality and standards.

Shall have completed 1 000 hours of flight time as pilot-in-command (PIC). At least 500 of those hours should be on flying instructional duties related to the flying courses provided, of which 200 hours may be instrument ground time.

Chief Theoretical Knowledge Instructor (CTKI)

Additional requirements for ATOs providing training for CPL, MPL and ATPL and the associated ratings and certificates:

Shall be nominated;

shall be responsible for the supervision of all theoretical knowledge instructors and for the standardisation of all theoretical knowledge instruction;

shall have extensive experience as a theoretical knowledge instructor in the areas relevant for the training provided by the ATO.
