Obedience is to follow lawful instruction pertinent to the transaction.

Loyalty is to their interests above our own

Confidentiality is for motivation, urgency, financial position and personal secrets.

Disclosure is for whatever I know, they know. Sometimes those are facts and sometimes those are just things we hear.

Accountability; money, paperwork, and dates.

Reasonable care: minimum standard of care. There’s no expert care here. Its minimum standard, based on the scope of what your license allows.

So if we’re going to review this dialogue for the seller,

“Mr. and Mrs. Seller, please allow me to fulfill my legal responsibilities by describing the duties that I owe you in a transaction. These are called our Fiduciary/Statutory Duties you have always been entitled to these very special duties which are reserved for clients only.

I would like to remind you that I am obedient to your lawful instruction pertinent to the transaction. My job is to provide you with options, alternatives and ramifications to choices so that you can make educated decisions. I will then step back, allow you time to process your options and wait for your instructions.

With loyalty, I am also here to watch out for your needs above my own.” Really, when’s the last time a salesperson said that to you? I am not in sales. I’m in service. As a service provider I am not here to push you in any way. This is a very important transaction and I want to take action when you are ready.

With my duty of disclosure, “Whatever I know, you know. Sometimes what I know is fact, but sometimes what I know I have heard and I may have no idea whether it’s true or not. It’s not my job to decide what’s important for you, only you can do that, so I will tell you and then you can decide what to do with that information.

I am an excellent secret keeper, Mr. and Mrs. Seller. I promise you now that with my responsibility of confidentiality, I will not betray your motivation, urgency, financial position or personal secrets. I cannot discuss your confidential information with anyone, including your friends or family, as well as the agents in my office.

I’m accountable to you by law for your money, or paperwork, and your dates. Even if your attorney says that they will watch the dates on your performance issues, please realize my license hangs in the balance and I am obligated to be apprised of that.”

The minimum standard of care in this state is reasonable, and I think if you read my resume you’re going to get a lot more than that!

“Now, Mr. and Mrs. Seller, I know that you are probably interviewing others. Why don’t you ask them what our legal duties are in this state because only a true professional would be able to describe them the way I have.”

Most agents don't even know what the fiduciary or statutory duties are, let alone explain them so the power is in the dialogue. Know what you are trying to convey, bring your personality to the table and please speak from your heart. This dialogue is just a guide for you so that you will have the confidence to speak to them about the most important duties that we have. Trust me, you will eliminate most of the competition by just telling people what you are obligated to do and that you are committed to doing it the right way for them.
