The Plano International Festival Corporation is a 501(c)(3) Texas nonprofit organization charged with the responsibility of organizing and conducting the annual Plano International Festival to showcase the multicultural aspects of the City of Plano. Special Requirements*
This Agreement provides the set of circumstances under which a Wellness Fair Vendor may present at the Festival. Please initial each number item below
1.Weather Conditions.The Festival is an outdoor event, and weather conditions may arise that are hazardous to all concerned; in that event, the Festival may be canceled. In the event of a cancellation, the Plano International Festival Corporation will only be responsible for refunding initial deposits, not any donations or fees.
2.Obligations of Plano International Festival Corporation..The Wellness Fair will take place at the Courtyard Theater, 1501 Avenue H Plano, TX 75074. The Festival will provide one 6’ x 3’ table and two chairs per Vendor. If you need any additional tables please specify in Special Requirements. No skirting or tablecloth will be provided; you may bring your own. If an electrical outlet is needed to operate your screening equipment please indicate that in Special Requirements. The Festival will attempt, but cannot guarantee, that it will be able to meet all needs.
3.Obligations of Vendor.Participants must provide all materials and have booth staffed during entire duration of the Wellness fair. The equipment and the area should be clean, neat, and organized. OSHA standards must be observed, where applicable. Any health fair participant using hazardous waste must provide their own transport containers and dispose of them properly.
4.Use of Likeness or Images.Vendor gives permission to the Plano International Festival Corporation and/or its agents and sponsors for the recording, reproduction, and broadcasting/telecasting of any visual or aural occurrences during the Plano International Festival or its preparation. Vendor agrees to permit the Plano International Festival Corporation and/or its agents to engage in the recording, reproduction, exhibition, broadcasting, telecasting, and distribution of my visual image, biography, voice, musical and/or theatrical performance, and musical text and/or written text materials used in such performance in connection with the production of the Plano International Festival.
5.Release.The undersigned hereby releases and forever discharges Plano International Festival Corporation, its officers, directors, employees, attorneys, agents, assigns, and related persons from any and all claims, demands, damages, actions, causes of action, or suits of any kind or nature whatsoever, and particularly without limitation on account of all injuries or claims, known and unknown, both to person and property, which may result or may in the future develop from any activities taking place in connection with the activities contemplated hereby.
6.Indemnity. The undersigned hereby indemnifies and agrees to defend and hold the Plano International Festival Corporation and its sponsors harmless from and against any and all claims, demands, loss, damage, or expenses resulting from the negligent acts or omissions of the Organization or the negligent, reckless or intentional acts or omissions of the Vendor or its agents or representatives which may occur or relate to the Festival.
7.Audit Rights. Vendor preemptively agrees to the release of any and all records necessary for the audit by the City of Plano of all transactions between the Plano International Festival Corporation and its participants.
8.Removal from the Wellness Fair. Plano International Festival Corporation reserves the right to remove Vendor from the Wellness Fair immediately under any of the following circumstances:
a.Display of offensive material;
b.Disruptive or disorderly conduct;
c.Illegal activity;
- Engaging in any act or course of conduct that could result in injury or harm to the participants in the Wellness Fair.
