RESOLVED: (1) THAT the Strategic Director of Customer and Support Services be authorised to enter into a legal agreement, under section 106 of the Town and Country Planning Act 1990, to secure the payment of a commuted sum to the value of £191,967 for, and implementation of, improvements to existing open space, such open space to be in close proximity to the development site, in accordance with policies H6 and H11 of the City of Salford Unitary Development Plan.

(2) THAT the applicant be informed that the City Council is minded to grant planning permission, subject to the conditions as detailed in the report now submitted, on completion of such legal agreement.

(3) THAT authority be given for the decision notice relating to the application to be issued, subject to the conditions as detailed in the report now submitted, on completion of such legal agreement.

(4) THAT authority be given to refuse the application if the applicant fails to complete the section 106 agreement within a reasonable period on the grounds that the proposals would be contrary to Policies H6 and H11 of the City of Salford Unitary Development Plan.
