173. MINUTES OF PROCEEDINGS

RESOLVED: THAT the minutes of the meeting of the Panel held on 3rd April , 2008, be approved as a correct record subject to the part of Minute 167 that relates to the construction of link road connecting the roundabout on Centenary Way (A576) to Daniel Adamson Road being amended to add an Informative requiring the applicant to improve the landscaping of the parcel of land to the north of the new road and to make clear that officers will raise with the Media City Transport Steering Group the need to consider future bus/bus stop provision along the new road and along Centenary Way and Broadway.

174. APPLICATIONS FOR PLANNING PERMISSION

(Full details of the matters referred to in this Minute and in Minutes 175 and 176 are contained in the report of the Director of Urban Vision Partnership Limited, as amended, in the case of the applications marked * in the supplementary report).

RESOLVED: (1) THAT the withdrawal from the agenda of application number *08/56047 relating to the erection of 2 metre high security fencing and gates at Poorlots Allotments, Allotment Road, Cadishead, be noted.

(2) THAT the withdrawal by the applicant, the Environment Directorate, of application number *08/56192 relating to the construction of a play area with a 2.4 metre high perimeter fence on the Ryder Playing Field, Ellesmere Road, Eccles, to permit consultation with local residents on its location be noted.

PLANNING APPLICATION NO. 08/55932/FUL, HASLEM HOMES - ERECTION OF 30 DWELLINGS AT THE FORMER BUILDERS YARD, BRAKESMERE GROVE/ HAYSBROOK AVENUE, WORSLEY, COMPRISING 14 THREE STOREY AND 16 - TWO STOREY UNITS WITH ASSOCIATED CAR PARKING AND CONSTRUCTION OF NEW VEHICULAR AND PEDESTRIAN ACCESSES - SECTION 106 AGREEMENT

RESOLVED: (1) THAT it be noted that Members were minded to grant planning permission, subject to the conditions detailed in the report now submitted, and that the Strategic Director of Customer and Support Services be authorised to enter into a legal agreement, under section 106 of the Town and Country Planning Act 1990, to secure a scheme for the provision of public realm, heritage enhancements and/or community infrastructure to meet the needs of the development.

(2) THAT the applicant be informed that the City Council is minded to grant planning permission, subject to the conditions as detailed in the report now submitted, on completion of such legal agreement.

(3) THAT authority be given for the decision notice relating to the application, to be issued, subject to the conditions as detailed in the report now submitted, on completion of such legal agreement.

(4) THAT authority be given to refuse the application, if the applicant fails to complete the section 106 agreement within a reasonable period, on the grounds that the proposals would be contrary to Policy H8 of the City of Salford Adopted Unitary Development Plan, and the policies contained within the Planning Obligations Supplementary Planning Document.

176. PLANNING APPLICATION NO. 07/55400/FUL, LANES FOR DRAINS LIMITED - ERECTION OF A THREE STOREY OFFICE BLOCK AT LANSDOWNE ROAD, ECCLES - SECTION 106 AGREEMENT

RESOLVED: (1) THAT it be noted that Members were minded to grant planning permission, subject to the conditions detailed in both the report and the amended report now submitted including a condition to ensure that the link access through to Naysmith Business Park is provided, and that the Strategic Director of Customer and Support Services be authorised to enter into a legal agreement, under section 106 of the Town and Country Planning 1990, to secure the provision of public realm and heritage improvements and contributions towards climate change.

(2) THAT the applicant be informed that the City Council is minded to grant planning permission, subject to the conditions as detailed in the reports now submitted, on completion of such legal agreement.

(3) THAT authority be given for the decision notice relating to the application, to be issued, subject to the conditions as detailed in the report now submitted, on completion of such legal agreement.

(4) THAT authority be given to refuse the application, if the applicant fails to complete the section 106 agreement within a reasonable period, on the grounds that the proposals would be contrary to Policy H8 of the City of Salford Adopted Unitary Development Plan, and the policies contained within the Planning Obligations Supplementary Planning Document.
