December 6 / 2016 Summer Outing Education Foundation Fundraiser – A Great Day & Great Fun!!
The AGC of North Dakota 2017 Summer Outing Education Foundation Fundraiser was a fun and hugely successful event, thanks to the efforts of the Committee, the Associates Division and Participants. You helped raise a total of $31,157.11 and had lots of fun, food and networking. This year we had 211 golfers on the course and a total of 240 attendees for the event. If you get a chance please give a big thank you to all the Event Sponsors, andSilent Auction Contributors/Bidders. These sponsorships and contributions are a very important part of the Summer Outing fund raising effort. We also want to thank the Summer Outing Committee led by Jon Shilling of General Equipment & Supplies, Inc., Susan Shearer of Harvey Sand & Gravel, Matt Halvorson of Halvorson Company, Inc., John Laskey of Northwestern Equipment, Inc., Mark Sandness of Capital City Sporting Clays, LLC, Ben Canning of Cobb, Strecker, Dunphy & Zimmermann, Inc., Dan Nelson of Zurich Surety, and Mark Julik of Dawson Insurance for their exceptional efforts in planning the event. Thanks to Dave Halvorson & Paige Shockman of Halvorson Company, Inc. for raising $1200 for the scholarship fund with the on-the-green game on hole #15. Big thanks to Susan Shearer of Harvey Sand & Gravel and Jeri Heiser for grilling the brats, hot dogs, at the Hot Dog Stand 1. A special thanks to 2017 AGC of ND President Rob Rebel of Knife River ND Division for serving the membership at Hot Dog Stand 1. This year USI Insurance Services, LLC manned Hot Dog Stand 2 which did a great job getting those hungry golfer fed on the back nine. Dinah and Stacey did an outstanding job with registration and raising money and getting team pictures on Hole # 13. If you want a picture of your team visit our Flickr site on the AGC of ND homepage. You all made the day an amazing experience! All around it was an outstanding event and everyone appeared to be in no hurry for it to end; likely due in part by the nicer temperatures. If you haven’t participated in the AGC Summer Outing you may want to put July 18-19, 2017 on your calendar now and plan to attend the 2018 AGC of North Dakota Summer Outing; we guarantee you won’t be disappointed whether you attend the Division meeting/member social or golf in the tournament at Hawktree. We hope to see you here in Bismarck next year! We believe everyone who participates in this Education Foundation Fundraiser is a winner, but as with most things there are awards connected to these types of functions. AGC of America Innovation Award

In 2018, AGC of America will celebrate 100 years of serving the construction industry. While we celebrate and recognize the past and the present, we are also looking to address the issues currently affecting the industry, in order to ensure the future of construction. In this spirit, AGC is introducing the Innovation Award to provide incentive to encourage free thinkers within the field to provide pioneering solutions to a challenge faced daily by its members. Examples of issues needing innovative solutions include, but are not limited to:
• Workforce shortage and lack of diversity
• Technology advancements
• Jobsite safety
• Sustainability
• Project complexity
The Innovation Award is open to all AGC members in good standing and to students currently enrolled in an ABET- or ACCE-accredited program. The final submission deadline for entries is 11:59 p.m. ET, Monday, October 30, 2017. To apply click here.

Ready to Comply with OSHA's Silica Rule?
AGC Provides Educational and Compliance Assistance Materials for Contractors
Beginning on September 23, 2017, contractors must comply with OSHA's respirable crystalline standard for construction, while Virginia Occupational Safety and Health began enforcing the new standard on June 23, 2017. To help educate AGC members, AGC has developed the "Respirable Crystalline Silica in Construction" members-only webpage designed to provide contractors with a better understanding of how to comply.
The information on the page includes the following:
  • Plain text summary of the rule
  • Compliance flow chart
  • Enhanced Table 1
  • Air monitoring andobjective data collection form
The standard provides a comprehensive and complex regulatory scheme for protecting construction workers from exposure to respirable crystalline silica containing dust. The scope of the standard applies to all occupational exposures to respirable crystalline silica and significantly lowers the permissible exposure limit (PEL) from 250 micrograms/m3 to 50 micrograms/m3. In addition to the new PEL, contractors will also have to comply with a host of ancillary provisions such as respiratory protection (when required by the standard), housekeeping, medical surveillance, and recordkeeping.

AGC Safety Training Schedule for Q4 in the Works – Please Help
Greetings All,
I am sure we are all busy with a variety of projects throughout the State, so the last thing on most minds is Safety Training. This time of year usually does not lend itself to employee training as most companies prefer do training either in the fall/winter or spring. With that in mind, I will be putting together a training schedule for the remainder of the year soon. I will be scheduling classes throughout the State and am looking for input from members as to what you would like to see and when. We do have some minimum class size requirements (10) particularly when out of town travel is required.

AGC Recommends U.S. DOT Regulatory Reforms
Covers DBE Program, ELD Mandate, Environmental Permitting & More
On July 24, AGC submitted more than 50 pages worth of regulatory reform recommendations to the U.S. Department of Transportation (U.S. DOT) in response to the department's request for comment. In this comprehensive document, AGC put forth recommendations for improving the highway work zone safety, Federal Motor Carrier Safety Administration mandate on electronic logging devices, the Disadvantaged Business Enterprise Program, and the federal environmental review and permitting processes, among other things. AGC also recommended that U.S. DOT eliminate its local hire pilot program and rescind the outstanding proposed rule for such a program. Read More

Labor Department Requests Input on Revising Overtime Rule
On July 26, the U.S. Department of Labor (DOL) formally published aRequest forInformation(RFI) on the 2016changesto the Fair Labor Standards Act (FLSA) overtime regulations. In line with AGC's regulatoryrecommendations, this RFI is the first step the DOL is undertaking to revisit the overtime rule, which dramatically increased the salary threshold for exempt employees. AGC and its members were concerned that imposing such a large and immediate increase might result in unintended consequences, particularly for small construction companies, construction employers in lower-wage regions, and construction personnel. Crane Operator Prep Class and NCCCO Certification Written Exams
The AGC of North Dakota once again will be facilitating 2 NCCCO Crane Operator Certification programs. The first program will be held at the AGC of ND office in Bismarck, ND on October 10-13, 2017 and the second program will be held at the Delta by Marriott (Ramada Plaza Suites) in Fargo on January 9-12, 2018. Registration for the two classes is open even though we don’t have a test site number from NCCCO as of yet. If you wish to register your operators please do so and submit the candidate or recertification applications to the AGC office and we will complete the test site information. Revised Form I-9 Now Available
On July 17, 2017, the U.S. Citizenship and Immigration Services (USCIS) released a revised version ofForm I-9, Employment Eligibility Verification. Instructions for how to download Form I-9 are available on the Form I-9 page. Employers can use this revised version or continue using Form I-9 with a revision date of 11/14/16 N through Sept. 17. On Sept. 18, employers must use the revised form with a revision date of 07/17/17 N. Employers must continue following existing storage and retention rules for any previously completed Form I-9.
