Permits to Discharge

The Owner/Operators of all Class III and Class IV Food Services Establishments (FSE) licensed in the City of Stamford, are required by law to obtain from the Water Pollution Control Authority, a “Permit to Discharge” the wastewater generated from the FSE into the City’s Sanitary Sewer System.

Outlined below are requirements and procedures for the Owner/Operators of Class III and Class IV FSE’s to obtain and maintain a “Permit to Discharge” issued by the Stamford Water Pollution Control Authority (SWPCA).

1.  The Food Service Establishment shall operate in compliance with the requirements, procedures, practices and policies set forth by the Stamford Water Pollution Control Authority, the City of Stamford Code of Ordinances including but not limited to Article V. “Abatement of Fats, Oils and Grease Discharge into Public Sewers”, and the State of CT DEEP General Permit for the Discharge of Wastewater Associated with Food Service Establishments. An inspection shall be conducted at the FSE by the SWPCA Regulatory Compliance Inspector to determine if the FSE is in compliance with the above provisions.

2.  It is the responsibility of the Owner/Operator of the FSE to obtain from SWPCA, a “Permit to Discharge” within 60 days from the date the approved FOG Abatement Plan has been implemented at the Food Service Establishment.

3.  It is the responsibility of the Food Service Establishment Owner/Operator to contact the SWPCA Regulatory Compliance Inspector to arrange for a compliance inspection no sooner than 30 days and no later than 60 days from the date the approved FOG Abatement Plan has been implemented at the Food Service Establishment.

4.  “Permits to Discharge” are valid for two (2) years from the date of issuance. It is the responsibility of the Owner/Operator of the Food Service Establishment to renew their “Permit to Discharge” prior to the expiration date.

5.  The process for renewing a “Permit to Discharge” includes the following:

§  The Owner/Operator of the FSE has ensured that the policies, practices, and procedures outlined in the approved FOG Abatement Plan have been maintained as part of the operation of the Food Service Establishment. The Owner/Operator of the FSE has maintained compliance with the requirements outlined in Section 1 of this document.

FSE Permit to Discharge

§  Prior to 60 days from the expiration date of the Permit to Discharge, the Owner/Operator of the FSE shall complete a Permit to Discharge Renewal Application and submit to SWPCA the following:

  1. The completed and signed Permit to Discharge Renewal Application
  2. Copies of all Interior and External FOG Management Log Sheets and manifests pertaining to the storage and disposal of all renderable and non-renderable grease generated by the facility for the previous two years.

§  Prior to 30 days from the expiration date of the Permit to Discharge, the Owner/Operator shall contact the SWPCA Regulatory Compliance Inspector to arrange for a compliance inspection of the Food Service Establishment as part of the renewal process.

6.  In the event it is determined by SWPCA, the operation of the Class III or Class IV Food Service Establishment is no longer in compliance with all applicable laws, regulations, ordinances, policies, practices, and procedures related to the Discharge of Fats, Oils, and Grease into the City of Stamford Sanitary Sewer or Stormwater Conveyance Systems, the SWPCA has the authority to revoke at any time, the “Permit to Discharge” issued to the Owner/Operator of the Class III or Class IV Food Service Establishment. Should it become necessary for SWPCA to issue a “Cease and Desist” Order for non-compliance, the Owner/Operator of Class III or Class IV Food Service Establishment will no longer be allowed to discharge wastewater generated from the Food Service Establishment into the City’s Sanitary Sewer System.

7.  Unannounced spot inspections of the Food Service Establishment will also be conducted by the SWPCA Regulatory Compliance Inspector to ensure compliance the City’s FOG Abatement Program.
