‘being desirous of making some alteration’ to her will of 1841
John Martin of Callington, brother was appointed as sole executor but if the testator out lived him then her nephew John Martin of Newton was to be sole executor.
Since this would deprive her brother’s family of the remainder of any effects after payment of debts and expenses which she had intended they should receive, the testator now appoints in case of the death of her brother before her, the eldest, unmarried daughter of her brother to be joint executor with nephew John Martin, instead of her late nephew, Thomas John Martin who was originally appointed.
Whereas by her will the testator has given her niece, Ann Blight Martin ‘(now Dingle)’ the sum of £100, by some inadvertence the niece was called to witness the execution of the said will whereby it appears she cannot by law, claim the legacy. The testator gives and bequeaths to niece Ann Blight Dingle the said sum of £100 as bequeathed by the testator’s will of 29 Nov 1841.
Executor: eldest unmarried daughter of testator’s brother John Martin of Callington
