Description / Bequests:
- to ‘my dear Wife’ Jane Scown all household goods, furniture, plate, china, wines, spirits and liquors, stock in trade, book debts and all other personal estate, on trust that she pay ‘with all convenient speed’ all debts, except the mortgages, all funeral and testamentary expenses; the remainder to go to her for life or as long as she remains a widow; after her death or remarriage, the property to be equally divided between all his living children
- to wife for life or until she remarries, four freehold and two leasehold dwelling houses and premises ‘situate in the New Road leading from the Hamlet of Saint Thomas to Westgate’; after her death or remarriage the properties to go to his children as follows: - to daughter Betsy Ann, wife of George Deacon of Portsmouth, stonecutter, dwelling house and premises in New Road ‘now in my own occupation and which is the nearest of the said Dwellinghouses to my present Residence and adjoins the premises of Thomas Martin for her separate use and benefit independently and exclusively of her present or any future husband and without being in any wise subject or liable to the debts demands or engagements of such husband’; - to son Philip Scown of London, cordwainer, dwelling house and premises in New Road, adjoining the last mentioned dwelling house and premises on the west, now in the occupation of testator’s son Edmund Scown as tenant; - to son William Dixon Scown of St Thomas hamlet, mason, dwelling house and premises in New Road adjoining last named dwelling house and premises on the west and now in occupation of [no name] Coles; - to son Edmund Scown of St Thomas hamlet, mason, dwelling house and premises in New Road adjoining last named dwelling house and premises on the west and on the east abutting premises belonging to Thomas Farthing, now in occupation of Thomas Ball as tenant; - to Betsy Ann Deacon, Philip Scown, William Dixon Scown and Edmund Scown in equal shares as tenants in common and not joint tenants, 2 leasehold dwelling houses and premises in New Road for remainder of the leases
- to wife (if property is not disposed of during testator’s lifetime), dwelling house, stables and other premises in which testator now resides call ‘The White Lion Inn’, St Thomas hamlet, on trust to dispose of them as soon as possible after testator’s death and pay off mortgage of £350 owing on the White Lion and the 4 freehold dwelling houses and premises; if the sum raised is not enough, then the 4 freehold properties ‘shall bear the deficiency’ in equal shares; if there is a surplus in the sum raised then that surplus should be applied to payment of testator’s other debts and expenses
If any of the children die without leaving legitimate children reaching the age of 21, the property of that child to be divided among the surviving children share and share alike.
