Description / Religious preamble
Bequests:
-  to friends Solomon Spettigue, gentleman, William Rowe, surgeon, Langford Frost, gentleman, and William Burnard, the survivor of them and their executors and administrators for the term of 99 years, if the testator’s rights in them still exist at the time of his death, all land, tenements and hereditaments both freehold and customary and leasehold ‘in the borough of Dunheved otherwise Launceston and elsewhere in the county of Cornwall’ in trust as follows:
-  two fields at ‘Dunheved’ [borough of Launceston] now in possession of Mr Joseph Hales held by the testator in fee simple, the rents, issues and profits to go to testator’s son John Harvey until grandson Roger Harvey, son of John Harvey, reaches 21 when they pass to Roger Harvey, his heirs and assigns forever; if Roger Harvey dies before reaching 21 the property goes to granddaughters Jane Harvey and Deborah Harvey, daughters of son John Harvey, their heirs and assigns forever, share and share alike
-  three fields at Dunheved [borough of Launceston] now in possession of William Ford held by testator in fee simple, the rents, issues and profits to go to testator’s son Edward Harvey for life, and thereafter to granddaughters Maria Elizabeth and Jane, daughters of son Edward Harvey, their heirs and assigns forever, share and share alike
-  barn and mowhay with appurtenances at Dunheved [borough of Launceston] now in the possession of William Ford, which is customary land of the borough, the rents issues and profits to go to testator’s son Edward Harvey for life and thereafter to granddaughters Maria Elizabeth and Jane, daughter of son Edward Harvey, their heirs and assigns forever, according to the custom of the borough
-  messuage and tenement in Trethevy in the parish of South Petherwin and the field called the Clampitts in Dunheved [borough of Launceston] now in possession of William Hobb, the rent, issues and profits to go to daughter Elizabeth Wall and her assigns, for her own use, separate and apart from her present or any future husband and notwithstanding her coverture to dispose of it by will or deed as she think fit during the same term that the testator has in the property
-  dwelling house and garden with appurtenances in Back Lane, Dunheved [borough of Launceston], now in the possession of Samuel Perry, being customary lands of the borough, to daughter Elizabeth Wall to be disposed of by will or deed as she shall think fit, notwithstanding her coverture, and to her heirs and assign forever according to the custom of the borough
-  messuage and tenement with appurtenances called Squires Tenement in West Gate in [borough of Launceston] held by testator in fee simple to go to granddaughter Jane, daughter of John Harvey, her heirs and assigns forever
-  tenement called Bannick Tenement near Broad Street in [borough of Launceston] now in possession of Ann Glanville which testator holds in fee
simple to granddaughter Deborah, daughter of John Harvey, her heirs and assigns forever
-  field called Quarry Park in St Thomas Street now converted into an orchard [borough of Launceston] held by testator in fee simple to grandson David Harvey, his heirs and assigns forever, after the death of testator’s wife Deborah
-  as for the term of 99 years relating to Quarry Park, the trustees to raise by sale or mortgage or from rents and profits the sum of £10 each for granddaughters Jane, Deborah and Charity, daughters of John Harvey to be paid when they each reach the age of 21
Bequests after death of testator’s wife:
-  to grandson David Harvey testator’s largest silver tankard
-  to son Edward Harvey testator’s other silver tankard
-  to daughter Elizabeth Wall testator’s silver teapot
-  to daughter Jane Harvey testator’s silver Pint and half Pint and one half of household goods
-  to Solomon Spettigue, William Rowe, Langford Frost and William Burnard in trust, dwelling house and appurtenances in which testator now lives in [borough of Launceston], the rents, issues and profits to go to wife Deborah Harvey for life, and after her death to daughter Jane Harvey and her assigns for life, and after her death to her children, their executors, administrators and assigns, for the remainder of the testator’s estate and interest therein; if Jane dies during the life of wife Deborah, without issue, wife to dispose of property as she sees fit; if daughter outlives wife but dies without issue, property to go to daughter Elizabeth Wall and her assigns, for her own use separate and apart from her present or any future husband, to dispose of as she sees fit for the remainder of the term. As to the term of 99 years relating to this property, the trustees to raise by sale or mortgage or from rents and profits the sum of £20 for grandson David Harvey and £10 for granddaughter Deborah Harvey to be paid when they each reach the age of 21
-  to daughter-in-law Charity, wife of John Harvey, to take rents, issues and profits for her own separate use, free from control of her husband, for life, and after her death to grandson Edward Harvey, his heirs and assigns forever, garden and appurtenances in Back Lane, [borough of Launceston], which testator holds in fee simple
