CONDITIONS OF HIRING PNCA PREMISES

1.  PNCA reserves the right to refuse/cancel the booking of Auditorium to any party without assigning any reason.

2.  The party hiring the auditorium will be responsible for all losses/damages to the auditorium property.

3.  There are 412 seats in the auditorium. No extra chair is allowed. The party hiring the auditorium shall ensure that in any case entry of the person to the auditorium shall not exceed 412.

4.  When premises are hired 35 seats specified by PNCA shall be reserved without charge for the PNCA’s use and the hirer shall provide cards/tickets for those seats or PNCA will issue its own passes/cards for entry in to the hall.

5.  So that PNCA protocols may be observed the hired shall give the PNCA advance notice of the attendance at any function of distinguished visitors. Heads of Government or persons representing them.

6.  The hirer shall be responsible for the maintenance of good order in and around the premises during the period for which the premises are hired.

7.  Smoking/drinking/eating is strictly prohibited in the auditorium. No briefcase bag, Tiffin box, camera, food packets, bottles etc are allowed inside the auditorium. The party hiring the auditorium will ensure that the restrictions are strictly adhered to.

8.  No open fire/inflammable material/smoke effect will be allowed within the premises of auditorium or green rooms etc.

9.  Weapons of any kind will not be allowed within the premises.

10.  The hire shall be responsible for leaving the premises clean and tidy at the time conclusion of the hiring and in case of failure the PNCA will carry out such cleaning or other work as may be required to restore the premises to a satisfactory condition at the expense of the hirer.

11.  Posters, banners, publicity materials will be allowed to be displayed only at the specified place provided for in or outside the premises of the auditorium.

12.  No loudspeakers will be allowed in any part of the auditorium premises without the prior permission of the Incharge.

13.  No extra lights will be provided for in or outside the auditorium.

14.  The party/organization hiring the auditorium shall not be permitted for installation of tents or erection of temporary structures.

15.  No cooking will be allowed within the premises of auditorium/galleries.

16.  The Event Manager, Security Manager, Incharge Business Operations and PNCA officers and staff on duty shall have admission to the venue premises or any part thereof at all times.

17.  No party will be allowed to handle the auditorium properties without the consent of the Incharge of the auditorium.

18.  The hirer shall not make any statement in media, print as well as electronic, advertisements or on stage of PNCA which directly or indirectly implies that the use for which the premises are hired is conducted or promoted by the PNCA.

19.  The hires or his staff shall not make any statement on PNCA’s stage against the PNCA, Government or its officers and staff, any deviation from these instructions will entail actions against the hirer including black listing etc.

20.  The hirer shall provide in advance detail of the event including script of stage plays and brief of cultural programs and shall not deviate from the already approved script/programme.

21.  In case of cancellation/postponement of the confirmed booking the cancellation/postponement charges as per PNCA rules shall apply.

22.  Federal, Provincial and local taxes if any will be the liability of party hiring the auditorium.

23.  Refund of Security deposited will be made through cross cheque on written request after adjustment of dues loss to the property of the auditorium, if any. Security deposited not claimed within 1 year from the dated of booking shall be forfeited.

24.  PNCA will not be responsible for the losses/ damages to the properties of the hirer used in the performance or kept in the auditorium premises.

25.  The exhibit including painting and artwork will be sold according to the artwork’s sale policy duly approved by the PNCA administration.

26.  Car parking is available at the adjunct plot near to the main reception at the owner’s own risk and the PNCA shall not be responsible for any loss to the car.

27.  The hirer shall comply with the provision of the PNCA Act, 1973 the dramatic performance Act, 1876 the by-laws, statutes and regulations of PNCA and with provisions of all the Acts and regulations applicable to the hirer including the local Government Ordinance and any regulation made thereunder and shall indemnify and keep indemnified the PNCA against all losses, expenses, liabilities, claims and damages incurred as a result of the hirer breach of any such act, by law statutes or regulations.

28.  The hirer shall comply with the Copyright Act 1961 with respect to recording and/ or broadcasting of any activities taking place within the premises of PNCA.

29.  The hirer shall indemnify and keep indemnified the PNCA against all losses, expenses, liabilities, claims and damages incurred by the PNCA for infringement of copyright arising from the hirer’s use of the premises that the activity for which the premises are hired does not infringe copyright.

30.  Any dispute between the hirer and the PNCA arising from or in relation to any hiring of premises or from the terms and conditions of Hire shall be submitted to the arbitration by a person appointed by the Chief Executive/Director General of the PNCA and the decision of the arbitrator shall be binding on the hirer and the PNCA.
