Sir,
After carefully considering the question of converting staff Artists of All India Radio / Doordarshan as Government servants, the Government have taken the decisions detailed in the following paragraphs.
I. Staff Artists to be treated as ‘Artists’
2. The Government has now decided that the following categories of staff artists of All India Radio and Doordarshan will be treated as ‘Artists’ :-
All India Radio Doordarshan
(i)Announcer / Compere (i)News presenter
(ii)Newsreader – cum – Translator (ii)Presentation Announcer
(Senior)
(iii) Newsreader (iii) Presentation Announcer
(Junior)
(iv) Conductor (iv) Instrumentalist
(v) Music Composer (v) Music Composer
(vi) Instrumentalist
(vii) Drama Voice
(viii) Translator-cum-Announcer
(Indian Language and Foreign Language)
3. A separate order will be issued regarding fee scales and other terms and conditions of service for “Artists indicated in para 2 above; thereafter they will be required to exercise an option in writing within a period of two months indicating their willingness or otherwise to be treated as ‘Artists’. The option will be invited by Director General, All India Radio and Director General, Doordarshan. The option once exercised will be final.
4. The staff artists who exercise the option to be treated as ‘Artists’ will be eligible for pension. The pension scheme that would be applicable to such artists would be worked out and announced along with the terms and conditions of service referred to in Para 3 above.
5. Those staff artists who do not elect to become ‘Artists’ will be allowed to become “Artist’, will be allowed to retain their existing grades and fee scales and continue on the present terms and conditions of service as per their respective contracts. Therefore they will not be eligible for pension.
II. Staff Artists to be treated as Government Servants.
6. The categories of staff artists of All India Radio and Doordarshan on long term contracts not covered under those mentioned in para 2 above and who have not attained that age of superannuation i.e. 58 years as on 28.02.1982, will be treated as “Government Servants” and the conditions of service applicable to Government servants would become applicable to them subject to the following conditions :-
(a) The staff Artists will be required to exercise an option in writing within a period of two months to be invited by Director General, All India Radio and Director General, Doordarshan indicating their willingness or otherwise to be treated as “Government Servants”. The option once exercised will be final.
(b) Such of the Staff Artists, who opt to be treated as Government servants will be screened by duly constituted Screening committees will take into account their (i) qualifications, (ii) experience and (iii) record of service and ascertain whether they are fit to be treated as Government servants. The Committee will also assess their suitability for the purpose of fitting them into corresponding scales of the regular civil establishment.
7. The screening committee for placement/fitment in Group ‘A’ and Group ‘B’ posts will be presided over by a nominee of the union public service commission. For group ‘C’ posts, the composition of the screening committee will be (i) Deputy Director General (Administration), (ii) Deputy Director General (Programme) (iii) Director of Programmes (Personnel) in All India Radio and (i) Deputy Director General (Programme and Training), (ii) Deputy Director General (Programme) and (iii) Controller of Programme in Doordarshan.
8. Those staff artists who are found fit to be treated as “Government Servants” will be entitled to the same pensionery benefits as are applicable to Government Servants in the regular service. They will however, not be entitled to any special benefits as at present available to them as Staff Artists/
9. Those staff artists who do not elect or are not found to become “Government Servants” or those who have attained the age of 58 on or before 26.02.1982 and have been allowed to continue on their present contractual terms will be allowed to continue under the present terms and conditions of service as per their respective contracts. They will not, therefore, be entitled for pension.
10. The conditions of service as indicated in the above paragraph for staff artists to be placed in either of the categories i.e. ‘Artists’ or ‘Government Servants’ would be given effect to from 6th March, 1982.

Reference is invited to this directorate communication No.34/1/82-S.VII (Vol.III) dated 26th November, 1984 and communication No.10/21/83-SVII dated 3rd January, 1985.
2. As already communicated, the vacancies falling in the category of senior producers, producers, translators, auditors, scripts Editors and Science officers are not to be filled up in view of the notification of the revised recruitment rules. Some of the stations have sought clarification whether vacancies in the other categories are also not required to be filled up. It is clarified that all vacant post in the categories of Assistant Editor (Tribal scripts), Assistant Editor (Scripts), Assistant Editor (farm & Home), Educational Broadcast, School Broadcast (Family Welfare) scripts writers, production assistants, sub-Editor (Scripts) and Sub-Editor are not to be filled up and this will be operative from 23rd October, 1984. In cases where offers had already been issued before 23rd October 1984, these cases may be processed but where offers have not been made the panels prepared etc will not be valid for appointment after 23rd October, 1984.
3. In order to decide the mode of the selection allocation to fill up the vacant posts in the above mentioned categories, it is requested that the correct position about the number of sanctioned posts, number of posts filled up and number of posts vacant in the above mentioned categories may kindly be furnished in the attached proform positively by 25th Feb, 1985.
The receipt of the Memorandum may be acknowledged.

Ministry of I & B has confirmed that as per instruction contained in their letter No. 45011/29/91-B(A), dated 29.11.1991 all staff Artists/Artists except foreign nationals who were in service on 06.03.1982 will automatically be deemed as Govt. Servant unless they opt-out of Scheme. Some other pointes in this regard are clarified with the approval of Ministry of I & B in enclosed copy of DG All India Radio’s letter No.29/5/92-SVIII, dated 19.11.1992.

Subject : - Staff Artists/Artists of All India Radio.
A number of letters have been received in this directorate from various heads of stations/station directors for clarification regarding the orders issued by Ministry of I&B vide their letter No. 45011/29/91-B(A), dated 29.11.1991. The following points are clarified with the approval of ministry of I&B vide their U.O.No. 905/52-B(A), dated 5.11.1992.
(i) Those Staff Artists/Artists under the 1982 scheme who have not opted out of the scheme to deem them as Government Servants, will be deemed as Government Servants with effect from 06.03.1982 or the date of their initial appointment thereafter as the case may be. Entries in this regard may be made in their service books by respective stations / offices.
(ii) Those staff Artists/artists under the 1982 scheme who are deemed as Government servants will be covered by CGEGIS – 1980, leave encashment benefits, stagnation increment and any other benefit as applicable to regular Civilian Central Government Employees.
(iii) The cases of those who have retired or died between 6.3.1982 and 29.11.1991 will be dealt as per pro-visions contained in the order dated 29.11.1991 by respective stations / offices.
(iv) Those who opt to remain as Staff Artists / Artists will continue to be governed by the existing terms and conditions as applicable to Staff Artists/Artists.
(v) These who become Government servants will be covered by CGEGIS-1980 and this will take effect from 1.1.1992. Deductions are accordingly to be made by all stations depending upon the pay scales.
(vi) Those who have become Government servants and are governed under CGEIS -77 will be reimbursed the contributions made by them as per rules on the subject.

Sir,
I am directed to refer to the Ministry of Information and Broadcasting letter No.45011/26/80-B(A), dated the 3rd May 1982 according to which certain categories of Staff Artists of All India Radio and Doordarshan were given option to be treated as Government Servants and the other categories of Staff Artists were given an option to be treated as “Artists” to be governed by separate terms and conditions, which were later on specified in this Ministry’s letter No.45011/26/80-B(A) dated the 26th August, 1983. This arrangement had been given effect to from 6th March, 1982. The scheme of classification of staff artist in the two organisation into govt. Servants and ‘Artists’ has been reconsidered by the Government. The revised decision taken in this behalf are detailed in the following paragraphs.
2. All Staff Artists/Artists under the 1982 Scheme working in All India Radio and Doordarshan (except Foreign nationals) who were in service on 8th March, 1982 or appointed as such thereafter will be deemed as Government Servants. Such Staff Artists/Artists instead of being governed by separate conditions of service laid down in the contract and other orders issued in this regard from time to time shall be governed by normal conditions of service applicable to Civilian Central Government employees.
3. Such Staff Artists/Artists under the 1982 Scheme who may wish to opt out of the decision of the Government to deem Staff Artists/Artists as Government Servants will have to give a specific option in this regard. Such staff Artists/Artists it will continue to be governed by their existing contractual terms and conditions.
4. Staff Artists/Artists of All India Radio and Doordarshan who do not opt out vide para 3 above, will be deemed as Government Servatns and the option shall be exercised within a period of six months from the date of issue of these order and the option once exercised shall be final. The staff Artists/Artists deemed as Government servants.
(a) Shall be governed by conditions of service including pensionary benefits as applicable to Civilian Central Government employees; and
(b) The Contract service rendered prior to 6th March, 1982 will be treated as qualifying service in terms of rule 17 of the CCS (pension) Rules, 1972 in which case the employees contribution of all such Staff Artists/Artists under the 1982 Scheme to the Contributory Provident fund (OPF) alongwith interest will be transferred to their General provident Fund Account and the employer’s contribution with interest thereon shall be resumed by the Government/
5. Staff Artists/Artists deemed as Government Servants in accordance with these orders shall retire on superannuation on attaining the age of 58 years. If any such person has already crossed the age of 58 years. If any such person has already crossed the age of 58 years. He/She will be deemed to have retired on attaning the age of 58 years and the service beyond that date will be treated as on re-employment.
6. Corresponding number of Civil posts will be created for Staff Artists/Artists of All India Radio and Doordarshan who are deemed as Government Servants under these orders.
7. Staff Artists / Artists of All India Radio and Doordarshan who opt to continue on contractual terms under para 3 of this order will also be entitled to protection of Article 311 of the Constitution.
8. The Staff Artists in All India Radio and Doordarshan under the 1982 Scheme who were categorized as Artists were given the following basic pre-revised fee scales :-
