REGULAR MEETING

OF THE

ORANGEVILLE CITY COUNCIL

HELD ON

THURSDAY,

AUGUST 11, 2016

Present at said meeting were Mayor Roger Swenson, Council members Kirk McQuivey, Carol Stilson, Janet Tuttle, Kent Wilson. City Recorder Ruanne and City Treasurer Cindy Nielson. Excused Carole Larsen.

Also present: Phil Fauver – Emery County Progress

Mayor Swenson opened the meeting at 7:00pm. Opening prayer was offered by Janet Tuttle. Mayor Swenson led the Pledge of Allegiance.

  1. PUBLIC COMMENTS – none
  1. APPROVAL OF BILLS AND WARRANTS

Kirk McQuivey moved to approve all bills and warrants as presented. Second Carol Stilson. Voting: Janet Tuttle – aye, Carol Stilson – aye, Kent Wilson – aye, Kirk McQuivey – aye. Motion passed.

  1. APPROVAL OF MINUTES OF PREVIOUS MEETINGS

Kent Wilson moved to approve the minutes of the previous meeting. Second Janet Tuttle. Motion passed.

  1. CELEBRATION COMMITTEE – THANK YOU

Mayor Swenson commented on the great job that the celebration committee did for Orangeville Day this year. He expressed his appreciation to everyone that helped to make it a success.

  1. APPROVE USING $8,000.00 FROM B&C ROAD FUNDS FOR FLOOD MITIGATION

Kent Wilson informed the council that $8,000.00 from B&C Road Funds will be used toward the river project. Orangeville City has committed to Emery County that we will give them $8,000.00 Hopefully all properties on the south side of the creek will be without risk of being flooded and there will be jetty work done on the bridge. Currently he is helping Johansen and Tuttle to get easements from property owners. This money will be used for protection of the bridge and the road. Janet Tuttle moved to approve using $8,000.00 from B&C road funds for flood mitigation. Second Carol Stilson. Voting: Kirk McQuivey-aye, Kent Wilson-aye, Carol Stilson-aye, Janet Tuttle-aye. Motion passed.

  1. LANDLORD AGREEMENT/HOLDAWAY

Carol Stilson moved to approve the Landlord Agreement for Holdaway. Second Kirk McQuivey. Motion passed.

  1. REQUEST FOR COLLECTIONS-JONES

Cindy Nielson explained that M. Jones had closed their account and left a balance that they refused to pay. The deposit was put toward the balance leaving a balance of $85.74. Kent Wilson moved to send the M. Jones account to collections. Second Kirk McQuivey. Motion passed.

  1. RESOLUTION 2016-5 A RESOLUTION AMENDING THE 2015-2016 GENERAL FUND BUDGET

Kirk McQuivey moved to approve Resolution 2016-5 A Resolution Amending The 2015-2016 General Fund Budget. Second Carol Stilson. Motion passed

  1. RESOLUTION 2016-6 A RESOLUTION AMENDING THE 2015-2016 WATER AND SEWER FUND BUDGET

Kent Wilson moved to accept Resolution 2016-6 A Resolution Amending The 2015-2016 Water and Sewer Fund Budget as written. Second Janet Tuttle. Motion passed.

  1. RESOLUTION 2016-7 A RESOLUTION AMENDING THE 2015-16 MUNICIPAL BUILDING AUTHORITY BUDGET

Janet Tuttle moved to approve Resolution 2016-7 A Resolution Amending The 2015-16 Municipal Building Authority Budget. Second Carol Stilson. Motion passed.

  1. APPROVAL OF:
  • Cooperative Agreement by Public Agencies To Create A New Entity

To Manage Emergency Medical Services and Provide Rules of

Governance

  • Bylaws of the Emery County Emergency Medical Services
  • Articles of Incorporation of the Emery County Emergency Medical

Services

There were several concerns regarding this agreement from council members. After discussion it was decided to table this item until next month. Kent Wilson moved to table this item until next meeting. Second Kirk McQuivey. Motion passed

Cindy Nielson –

  • Remind everyone of the summer picnic on Aug. 29. Everyone needs to bring a salad.

Ruanne Leeflang –

  • Indicated to everyone the new code papers that had been passed. These need to be placed in their code books.

Carol Stilson –

  • Where do we stand on the shower and restrooms. The council was informed that we are waiting on the state.
  • Talked with Allen at the cemetery and he thought he had a worker that was going to come and work one day a week. Would it be possible to pay him a little? He has not showed up to work yet so we will wait and see what happens.
  • YCC met last week and discussed what they are planning for next year. They will paint the restroom at the cemetery in the spring.
  • The trees are down at Richard Fairbanks!! Thank you to Kim Heiniger for cleaning up the mess.
  • Cemetery – Allen is fighting sprinklers because of the dirt that gets into ever head.

Kent Wilson –

  • Russell Early is asking if he can use the city right of way to go around John Vaughn’s property and then dump into his property. CVSSD said they would not have any problems allowing him a right of way. Jacob suggested we have a contract with him, have it engineered through Johansen and Tuttle and go as close to the fence as possible. Verbal approval will be needed tonight and will make it formal at the next meeting. There will be no right of way privileges just permission to use it.
  • Met with Katlin Bell this afternoon and agreed to changes made on his time sheets. He will start using a voice entry on his phone when he is called out. Katlin did offer to tender his resignation but Kent felt we just need to clean up some bookkeeping. We need to be sure there is documentation. Mayor Swenson stated that in a conversation he had with a county deputy they feel that Katlin is the best animal control officer in the county. He does a very very good job.

Kirk McQuivey –

  • Maintenance is working on the playground equipment.
  • Fire Dept. everything is going good. The fireworks were great.
  • Could we do a pie auction at the Christmas party and use the money toward the fireworks.

Janet Tuttle –

  • Everything worked out really well for Orangeville Day. The foam pit was a lot of fun. Maybe next year try the parade in the evening.
  • Thanked the mayor for being a good sport for the pie throw.
  • Have had the last Lawn and Garden meeting until April of next year. There has been a good turn out each month.

Kent Wilson –

  • Do we charge people to use the Community Center if they want to do a fund raiser? Maybe they could show a movie outside.
  • Could we hire someone and pay $9.00 hr. to paint the red on the curbs and all the blue up and down Main Street. It would be cheaper to pay someone $9.00 than to have a city employee do it.
  • Has talked with property owners along the creek about easements and some want to make sure the construction remains within the confines of the river. They don’t want to lose any more property than they already have.
  • Contractors will begin working in Oct. They will be moving 12,000 cubic yards of sand.
