The Associate Committee meeting of 16.10.11 would be held at Holiday Club, Panchsheel Colony (near Chirag Delhi-Sheikh Sarai flyover), New Delhi keeping in view the increased number of the delegates at scheduled time of 11 a.m. Sh. S/Sh. Sharma, Manda and I would be on LTC trip since 02.10.11 to 09.10.11 during the Dusshera holiday week.

Another meeting was held with the ADG, HRD (HRM) on the issue of promotional parity of the basic entry counterparts as intended in various records of CBEC. He was in total agreement of the issue and said that the merger seems the only method to attain it but prospective measures would be of no use for the Central Excise personnel. He discussed which date/year should be taken into consideration for the purpose. No doubt, the merger since very beginning only will give the actual justice but he was agreed that there should be no problem in merger since 1980 because of having precedent of reviewing all the promotions since then as per the verdict given by SC in 1996. Supernumeratory vacancies would be required to attain parity in the matter without reverting any body. He said that he would get the number of supernumeratory vacancies calculated required for the purpose and have next meeting on the issue after one week. The method of notional promotions was also discussed with him.

A Director of DOPT was also contacted to get guidance on the issue. She opined that one of the best ways to open the promotional avenues for the Central Excise personnel is also the creation of separate service for them taking into account their huge number of officers at entry level. A few of other authorities of DOPT will also be contacted after Dusshera holiday week.

The senior advocate, Sh. Rao, on service matter was also contacted. In the conference with him, he suggested that we should also file an immediate case in the CAT with our Inspectors seeking directions on the basic entry promotional parity taking the help of SC verdict. He opined that DOPT provisions would have no effect on the case whether there exist such provisions or not. He said that the existence or non-existence of provisions is not the issue and needs not be worried. One more conference will be held with him after Dusshera holiday week.
