On page 1, line 2, after the word and comma "highways," delete the words "the fiscal court" and remove the opening bracket and strikethroughs from the word "and"; and
On page 1, line 3, remove the strikethroughs and closing bracket from the words "county judges/executive" and after the comma "," delete "and the city government in"; and
On page 1, line 4, delete "respect to municipal highways,"; and
On page 1, line 9, after the word "department" delete the comma "," and insert the word "or" and after the words "fiscal court" delete ", or city government"; and
On page 1, line 11, after the word "highways" delete the comma "," and remove the brackets and strikethroughs from the word "or" and after the words "county roads" delete ", or"; and
On page 1, line 12, delete "municipal highways"; and
On page 2, lines 3 through 7, by deleting lines 3 through 7 in their entirety and inserting in lieu thereof the following:
"(4)A fiscal court shall require all persons applying for a permit issued under Section 2 of this Act to enter into a cooperative agreement with the fiscal court. The cooperative agreement shall provide for an equitable apportionment of the incremental costs for design, maintenance, construction, or reconstruction of those roads and bridges on which the person will be operating under the permit issued under Section 2 of this Act. A fiscal court may require as part of a cooperative agreement for the person to give the fiscal court a bond to ensure payment of the equitable costs associated with the permit issued under Section 2 of this Act. All funds collected under this subsection shall be expended on those roads covered by the cooperative agreement.
(5)A fiscal court shall not be relieved of expending its normal routine maintenance on all roads covered by cooperative agreements under the provisions of this section.
(6)A person who entered a cooperative agreement with a fiscal court under the provisions of subsection (4) of this section may terminate the agreement by submitting written notice to the fiscal court. If a person terminates a cooperative agreement with a fiscal court, the permit issued under Section 2 of this Act shall immediately be revoked by the fiscal court."; and

On page 2, line 22, after the words "as the" delete "local government" and insert "fiscal court"; and
