Pursuant to Article 19, paragraph (3) of the Act on the Right of Access to Information (Official Gazette “Narodnenovine” no. 25/13), the Information Commissioner adopts these

CRITERIA

FOR THE DETERMINATION OF THE FEES FOR THE ACTUAL MATERIAL COSTS AND THE COSTS OF THE DELIVERY OF INFORMATION

Article 1

These criteria prescribe the fees for the actual material costs incurred during the provision of information as well as the fees for the provision of the requested information which are paid by the user of the right to information, and which are generated through the provision of information under the Law on Access to Information.

The criteria also apply to the fees for the actual material costs incurred during the provision of the re-use of information.

Article 2

The fees for actual material costs are determined as such:

1. Copy of an A4 size page – 0.25 HRK

2. Copy of an A3 size page – 0.50 HRK

3. Copy of a colour A4 size page – 1.00 HRK

4. Copy of a colour A3 size page – 1.60 HRK

5. Electronic record on a CD – 4.00 HRK

6. Electronic record on a DVD – 6.00 HRK

7. Electronic record of a memory card depending on the amount of memory – 210.00HRK for 64 GB, 150.00 for 32 GB, 120.00 for 16 GB, 50.00 for 8 GB, 30.00 for 4 GB.

8. Conversion of a page of a document from a physical to electronic format - 0.80 HRK

9. Conversion of video clips, audio tapes or floppy discs to electronic records - 1.00 HRK

The cost of the delivery of the information is calculated according to the valid price list of regular postal services.

Article 3

The fees for the actual material costs and the delivery fees which are not specified in Article 2 of these Criteria will be determined by the public authority in such a way that the average market price for the service, the depreciation cost the public authority has and the cost of postal services will be charged.

The time spent by a public authority employee collecting, preparing and providing information to the user of the right to access information does not represent an actual material expense.

Article 4

The public authority will provide the user with information upon the receipt of a proof of payment.

The public authority will require the user to pay the expected amount of actual material costs or delivery costs to the public authority’s account within eight days should that amount exceed 150.00 HRK. Should the user of the right of access to information not pay the said amount within the given time limit, it shall be deemed that the user to the right to information has waived his request.

Article 5

For the sake of efficiency and cost-effectiveness as well as proportionality in protecting the rights of parties and public interest, the public authority may decide not to charge the user of the right to information for the costs incurred during the provision and delivery information if the amount does not exceed the amount of 50.00 HRK.

Article 6

On the date of entry into force of these Criteria, the Criteria for the Determination of Fees from Article 19, paragraph 2 of the Act on the Right of Access to Information (Official Gazette 172/03 and 144/10) shall cease to be valid.

These Criteria shall enter into force on the eighth day from the day of their publication in the Official Gazette.
