BACKGROUND

A. Alternative Schedules

Pursuant to Education Code Section 88026, which states in part that the governing board may “exempt specific classes of positions from compensation for overtime in excess of eight hours in one day, provided that hours worked in excess of 40 in a calendar week shall be compensated on an overtime basis and that such exemption shall be applied only to those classes which the governing board…specifically find to be subject to fluctuations in daily hours not susceptible to administrative control.” Additionally, the District and California School Employee Association (CSEA) have met and conferred on the District’s implementation of this Education Code Section, and have agreed to maintain open communications regarding the specific classifications affected and the rationale for the alternative schedules.

In accordance with the cited Education Code and the agreement between the District and the CSEA the following alternative work schedules and classifications are hereby submitted. The specific classifications, working these alternate schedules will be exempt from overtime for hours worked in excess of 8 hours in any single workday but would receive overtime for any hours worked in excess of 40 for the calendar week.

Schedules: All schedules include either an hour or one-half hour unpaid lunch break.

This position is needed due to a newly funded Talent Search Grant. The Talent Search Program is a pre-college program that prepares and motivates middle through high school students for college.
