NOTICE OF JOINT PUBLIC MEETING OF

TOWN OF SHEBOYGAN TOWN BOARD and TOWN OF SHEBOYGAN PLAN COMMISSION

THURSDAY, June 29, 2017 @ 6:30 pm

The Town of Sheboygan Town Board and Town of Sheboygan Plan Commission will meet on Thursday, June 29, 2017 at 6:30 p.m. in open session at the Town of Sheboygan Town Hall, 1512 No. 40th Street, Sheboygan, Wisconsin. The purpose of the meeting is as follows:

1. Chairman Hein called the meeting to order and introductions of Planning Commission, Board members and Staff were made.

2. Approval of the Agenda-Motion Gumm, second Wagner to approve the agenda as

presented. Motion carried.

3. Amendment to Windmor Grading Plan-In Windmor along the west line, the bank took over and there was a drainage swalethat had no good outlet. Hillcrest asked for an amendment to approve a pipe which does not currently work. The new plan is to add 287 feet of PVC. Tom Holtan, Town Engineer from AECOM agreed. This is a change to the master plan from 2007 and the modification in 2016. Motion Schwinn, second Gumm to approve the change. Motion carried.

4. Proposed Land Use Agreement for Blind Horse Winery-Atty. Bauer gave a summary of the Land Use Agreement that is being proposed. The Blind Horse applied to raze and reconstruct an event barn. They were met with opposition by the neighbors so this is an attempt to work with the neighbors. The agreement will be set up in recordable form. When the agreement is agreed upon, it will be a recorded deed that will follow the property. Hein opened for floor for questions and or comments. Karen Schulze asked about the lights flashing in the neighbors homes by people turning their vehicles around in their driveways. Atty. Bauer stated that the Town cannot keep private citizens from doing that. A question was asked about the east side parking and Mr. Nye said that he cannot enforce the people from parking there. They have addressed this issue and he feels it has gotten better. Griffin had a few statements and questions regarding the agreement. He said that the agreement is not reversible once it is signed. He wanted clarification on the part that stated 10 business days and if approval or notification is needed. Atty. Bauer replied that only notification is needed. The next question was regarding special events. With the approval of two events it would be seven events total with the agreement. He then asked Nye about the events planned and if they had permits for all of them. Nye said he did not know that they needed approval for each one. Griffin wanted everyone to know what 75 decibelsis. When he did a reading earlier in the day at his office, his voice talking was 60 decibels. Mr. Moeller said that he takes his own readings and they have never exceeded the limit of 75 decibels. Hein said they tested last week and they could barely hear the music at the neighbors. In regards to the music, Griffin wanted clarification regarding band set up and the adjustment for decibel readings. Atty. Bauer explained the 75/85 adjustment and the one time factor. Atty. Bauer read the section of the agreement to Griffin. Nye said that the manager’s will be trained to take decibel readings. No decibel readings will be required for the food truck festivals. Nye said the sound panels they are installing will greatly reduce the noise as well. A resident asked about the hours of music being monitored and Atty. Bauer did say that per the agreement, between the hours of 12pm and 5pm, there is no limit. Hein suggested that the decibel level be 75 across the board and Moeller agreed. Moeller did state that he did not ask that there be no limits during this time frame. A neighbor did say that on June 2nd there was a band that was loud and clearly heard at her house. She believes her house gets the most sound and she would like reassurance about the panels and would like to know if she will be able to have input after the panels have been installed. She said that some bands are louder than others. Nye said that there is one performer that performs with a synthesizer and he said he will not bring him back to play. Atty. Bauer said there is extra time for the testing at the barn. The neighbor said she would like to be able to test out the panels. Moeller said he would like to install as soon as possible and he will contact the installer regarding availability. The suggestion was to extend to 180 days to ensure that the panels work. Nye did say he has a concern with the timeframe with construction. Atty. Bauer suggested one year from date of agreement will be allowed for a decibel adjustment. Nye stated that the music has been cut by 50% in the agreement. The neighbor is very appreciative of the adjustments that the Blind Horse has made. The neighbor said that she does not think that the agreement should be accepted until all of the neighbors have time to review it and give feedback. Hein explained that no approval will be made tonight. Gumm asked about the size of the barn. She was told it will be 2500 square feet and will be for 80 people or less. Schulze asked about the bathrooms at the proposed barn and she was told there would be two total, which is required by law. Hein explained that the agreement will be discussed at the Town Board meeting on Tuesday, July 18th, 2017.

5. July 8, 2017 and July 9, 2017 Blind Horse Food Truck Festival Event- Schulze asked if the agreement applies to this event. Atty. Bauer said no. Nye did say that they have been following the agreement. Schwinn asked about the date and the conflict with the Lions fest and if the Blind Horse could move the date in the future. Nye said that it would be no problem. Motion Wagner, second Schwinn to approve. Motion carried.

6. Adjourn – Town of Sheboygan Plan Commission. Motion Schulze, second Rahn to adjourn the meeting at 7:00pm. Motion carried.

Closed Session The Town of Sheboygan Town Board may convene into Closed Session pursuant to Section 19.85 (1)(c) of the WI Statutes for the purpose of considering employment, promotion, compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility. Roll call vote: Hein-Aye; Schwinn-Aye; Gumm-Aye; Wagner-Aye; Olson-Aye. Motion carried.

Open Session The Town of Sheboygan Town Board will convene in Open Session to make decisions on Closed Session items. Roll call vote: Hein-Aye; Schwinn-Aye; Gumm-Aye; Wagner-Aye; Olson-Aye. Motion carried.

7. Employee Matters-John Witters will receive three weeks of vacation and will go into the regular schedule. Motion Hein, second Schwinn to approve this schedule. Motion carried.

8. Retail Development- No action taken. Motion Schwinn, second Gumm to approve no action to be taken.

9. Adjourn-Motion Wagner, second Gumm toadjourn the meeting at 8:25pm. Motion carried.
