Notice of Claim Procedures for Oil Spill

In accordance with the Oil Pollution Act of 1990 (33 USC 2714(c)), this notification is to alert you of an oil spill that occurred between January 18 and January 30, 2018 from a tank beneath a pier west of Cannery Pier Hotel, 10 Basin Street, Astoria, Oregon. You may be entitled to make a claim for damages related to this oil spill.

Removal costs and damages which may be compensated include removal costs performed in accordance with the National Contingency Plan; damage to natural resources; damage to or loss of real or personal property; loss of subsistence use of natural resources; loss of government revenues; loss of profits and earnings capacity; and increased cost of public services.

The oil spill was identified on January 18, 2018 and reported to the United States Coast Guard. Oil escaped a tank beneath a pier and migrated west toward the West End Mooring Basin marina, and eastward along the shoreline for an indeterminate distance. Containment booms were placed to prevent migration of the oil, but the oil affected vessels and shorelines in the vicinity of Cannery Pier Hotel.

The Cannery Pier Hotel has been cooperating with the United States Coast Guard in responding to the spill. The tank was removed on January 30, 2018. Cannery Pier Hotel has assumed initial responsibility as a “responsible party” for the spill.

If you believe you have suffered damages from this spill, you are entitled to make a claim. Claims should be in writing, signed by the claimant, for a specified amount; and should include all evidence to support the damages. Any person may make a claim for “short term” damages representing less than the full amount to which the claimant ultimately may be entitled. Payment of such claim shall not preclude recovery for damages not reflected in any paid or settled partial claim.
