NOTICE INVITING SEALED BIDS

CITY OF PORTERVILLE SHOOTING RANGE PROJECT

BID NO.: 10/11 – CP1734

SEALED PROPOSALS will be received by the Purchasing Agent in the City Hall, 29l N. Main Street, Porterville, California, 93257, until 2:30 P.M. on October 26, 2010 and promptly thereafter all proposals that have been duly received will be publicly opened and read aloud for furnishing to said City all labor, materials, equipment, transportation, and services for the City of Porterville Shooting Range Project.

Prices shall include, but not be limited to, all necessary labor, equipment, material and associated appurtenances to furnish and install the chain link fencing, pervious concrete slab, earthen berm, and all other necessary appurtenances for the City of Porterville Shooting Range Project according to the detailed guide specifications.

Instructions to Bidder, plans, project manual, and proposal forms may be inspected at City Hall, 291 N. Main Street, Porterville, California and copies of said documents may be obtained from the Purchasing Agent upon payment of $35.00 non-refundable fee for each set. No bids shall be receivedfrom a non-official Plan Holder nor on bid forms not directly furnished by the Purchasing Agent.

A Certified Check, Cashier's Check, or Bidder's Bond in the amount of ten percent (10%) of the bid made payable to the City of Porterville will be required to accompany each proposal.

Any contract entered into pursuant to this notice will incorporate only the applicable provisions of the State Labor Code. This project is wholly funded by local revenues and is therefore exempt from prevailing wage requirements.

Affirmative action to ensure against discrimination in employment practices on the basis of race, color, national origin, ancestry, disability, gender, or religion will also be required.

The City hereby affirmatively ensures that minority business enterprises will be afforded full opportunity to submit bids in response to this notice and will not be discriminated against on the basis of race, color, national origin, ancestry, disability, gender, or religion in any consideration leading to the award of contract.

No qualified disabled person shall, on the basis of disability, be excluded from participating in, be denied the benefits of, or otherwise be subject to discrimination.

No bid will be accepted from a Contractor who is not duly licensed in accordance with the provisions of Chapter 9, Division III, of the Business and Professions Code, and has a current Class A, General Engineering, or Class B, General Building, State of California Contractor's license.

The right is reserved by the City of Porterville to reject any or all bids, to evaluate the bids submitted and to award the contract according to the proposal which best serves the interests of said City.

The successful bidder will be required to furnish the City of Porterville with a "Performance Bond" in the amount of one hundred percent (100%) of the contract and a "Labor and Materials Bond" in the amount of one hundred percent (100%) of the contract amount.

Upon receiving the "NOTICE OF AWARD," the successful bidder has TEN (10) DAYS to submit the signed contract together with all required bonds, insurance and licenses to the Project Manager, and meet with the City in a PRE-CONSTRUCTION MEETING to discuss any problems or questions pertaining to this project. It is the Contractor's responsibility to contact the City's Project Manager immediately, to arrange for the PRE-CONSTRUCTION MEETING during the TEN (10) DAY PERIOD.

The Contractor shall have forty (40) working days from the effective date of the NOTICE TO PROCEED to complete the required work.

The Contractor shall pay the City LIQUIDATED DAMAGES in the amount of five- hundred ($500) a day for each calendar day the project is delayed beyond the "TIME OF COMPLETION DATE."

The City will withhold ten percent (10%) retention from payments due the Contractor until thirty-five (35) days after date of recordation of the Notice of Completion. The Contractor may elect to receive one hundred percent (100%) of payments due under the contract by depositing securities of equivalent value with the City in accordance with the provisions of the California Government Code Section 4590.
